TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Municipal Garage, 3587 Terrace Road, Cortland, New York with Supervisor Williams presiding. Members present: Supervisor, Thomas A. Williams Councilman, Jay E. Cobb Councilman, David J. Donlick Councilman, Jeffrey D. Guido Councilman, Gregory K. Leach Town Clerk, Kristin E. Rocco-Petrella Others present were: Town Attorney, John DelVecchio; Highway Sup’t. Larry Drach; Deputy Town Clerk, Abigail Albro; Recreation Director, John McNerney; Town Residents: Dr. Kathleen Fitzgerald, Patrick Fitzgerald; Barbara Leach; and News Reporter: Yuner Gao from the Cortland Standard. Others joining via Zoom video/telephone conference: Supervisor’s Secretary, Patty O’Mara; Assistant to the Supervisor’s Secretary, Amanda Rainbow; and News Reporter: Kevin Smith from the Cortland Voice. Supervisor Williams called the Regular Meeting to order. Councilman Guido made a motion, seconded by Councilman Donlick, to approve the Draft Town Board Minutes of May 4, 2022, May 18, 2022 and June 1, 2022. All voting aye, the motion was carried. Councilman Guido made a motion, seconded by Councilman Donlick, to receive and file the Cortlandville Board of Assessment Review Minutes of May 25, 2022. All voting aye, the motion was carried. RESOLUTION #176 AUTHORIZE PAYMENT OF VOUCHERS – JUNE Motion by Councilman Donlick Seconded by Councilman Leach VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as follows: Funds A, B, DA, DB, Voucher #729-804 HG, SF, SS, SW General Fund A $ 37,083.05 General Fund B $ 3,962.76 Highway Fund DA $ 0.00 Highway Fund DB $ 19,669.70 Gutchess Lumber SC Project HG $ 183.14 C’Ville Fire District SF $ 0.00 Sewer Fund SS $ 63,421.24 Water Fund SW $ 74,161.05 Funds CD1, CD3, CD4 Voucher #(None) BMills Rehab CD1 $ 0.00 Town Wide Rehab CD3 $ 0.00 Business Devl CD4 $ 0.00 Funds TA, TE Voucher #(None) Trust & Agency TA $ 0.00 Expendable Trust TE $ 0.00 Supervisor Williams offered privilege of the floor to Dr. Kathleen Fitzgerald. Town resident, Dr. Kathleen Fitzgerald addressed the Board regarding a section of hedgerow that has been cut down across the street from her home on Katie Lane. She stated it is the only section of hedgerow missing on the entire street, and she believes this section of hedgerow is on town property. Dr. Fitzgerald stated she has done research including contacting NYS DEC and United States Department of Wildlife Tracking and that this missing section of hedgerow has caused “a pathway of least resistance” for the deer. Dr. Fitzgerald was concerned about the number JUNE 15, 2022 TOWN BOARD MEETING PAGE 2 of deer, their behavior, and the damage they are causing to the shrubbery. Dr. Fitzgerald ended by saying she feels this section of hedgerow was removed to retrack the deer off her neighbor’s property and onto hers and she asked the Town to “stop it”. Councilman Cobb made a motion, seconded by Councilman Leach, to receive and file the following monthly reports: 1. Town Parks & Recreation Department, John McNerney – May 2022; 2. Code Enforcement Officer, Kevin McMahon – May 2022; 3. Town Supervisor – May 2022; 4. Town Clerk – May 2022; 5. Tax Collector – May 2022; 6. Town Justice Mathey, Town Justice DeMarco – May 2022; 7. Cortland Community SPCA – May 2022; and 8. Water & Sewer Department – May 2022. All voting aye, the motion was carried. Councilman Guido made a motion, seconded by Councilman Donlick, to receive and file correspondence from Charter Communications, dated June 10, 2022, regarding programming changes. All voting aye, the motion was carried. Under new business, Town Clerk Rocco-Petrella reported the Summer 2022 edition of the Town’s Newsletter Talk of the Town, would be available later this week. Attorney DelVecchio had no new business to report. Town Board Member Reports: Councilman Donlick apprised the Board he is working on feasibility studies with different companies regarding electric vehicle chargers in the Town. The feasibility studies are suggesting the Town should put in more electric vehicle chargers than initially planned. Supervisor Williams added that there would be no cost to the Town for installing the electric charging stations. The Town would continue to look into the best options for installing electric charging stations. Councilman Leach apprised the board he attended the Cortland Dairy Parade last week and saw the McGraw Marching Band there. He stated that he was impressed with the incredible show they put on and was glad they were one of not-for-profit organizations selected to receive ARPA money from the Town. Supervisor Williams added he was happy to see the ARPA money going towards rebuilding our community. Councilman Guido apprised the Board that a Town resident reached out to him regarding the status of the reduction of speed limit request for Bennie Road. The Town submitted the request to the NYS Department of Transportation (DOT) in November 2020, after installing stop signs at the Bennie Road and Walden Oaks intersection. Per Town Clerk Rocco-Petrella, it can take up to two years for the DOT to complete the traffic study and to report findings to the Town. She would follow up with the DOT as to the status of the study, but suspected it was not complete. Supervisor Williams reported: Remote Meetings: Supervisor Williams apprised the Board he spoke with another Board Member regarding the ability to join a board meeting remotely and take action. Town Clerk Rocco-Petrella explained there is new legislation involving joining a meeting remotely and it involves adopting a new local law. Supervisor Williams, Attorney DelVecchio and Town Clerk Rocco-Petrella agreed to look into it and report back at the next meeting with more information. Councilman Leach made a motion, seconded by Councilman Cobb, to receive and file correspondence from NYS Homes & Community Renewal, dated May 31, 2022, regarding the Town’s May 11, 2022 monitoring visit for the NYS Community Development Block Grant Town- wide Housing Rehabilitation Grant Program (CDBG #287HR323-19), in which the Town was found to be in compliance with the requirements and commended for the excellent work in administering the grant. All voting aye, the motion was carried. JUNE 15, 2022 TOWN BOARD MEETING PAGE 3 RESOLUTION #177 SCHEDULE SPECIAL TOWN BOARD MEETING FOR JUNE 27, 2022 AT 5:00 P.M. FOR THE PURPOSE OF AWARDING THE BID FOR THE GUTCHESS LUMBER SPORTS COMPLEX PHASE 2 Motion by Councilman Guido Seconded by Councilman Cobb VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby schedule a Special Town Board Meeting for Monday, June 27, 2022 at 5:00 p.m. to be held at the Municipal Garage, 3587 Terrace Road, Cortland, New York, for the purpose of awarding the bid for the Gutchess Lumber Sports Complex Phase 2. RESOLUTION #178 AUTHORIZE EVENTS TO BE CONDUCTED BY THE CORTLAND CRUSH NYCBL BASEBALL INC. AT THE GUTCHESS LUMBER SPORTS COMPLEX Motion by Councilman Cobb Seconded by Councilman Guido VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED WHEREAS, the Town Board received a request from William McConnell, GM/Head Coach representing the Cortland Crush Baseball to allow the following to be conducted at the Gutchess Lumber Sports Complex: Concessions from June 16, 2022 until July 31, 2022; and the sale of Craft Beer on select dates; and WHEREAS, the Town Board discussed the requests, therefore BE IT RESOLVED, the Town Board does hereby authorize the Cortland Crush NYCBL Baseball Inc. to conduct Concession at the Gutchess Lumber Sports Complex from June 16, 2022 until July 31, 2022 in accordance with the appropriate approvals from the Cortland County Health Department for the sale of food, and it is further RESOLVED, the Town Board further authorizes Craft Beer to be served on selected dates, subject to the appropriate approvals from New York State for the sale of alcoholic beverages and the completed waiver forms for the Town of Cortlandville for each date. RESOLUTION #179 ESTABLISH THE STANDARD WORKDAY FOR ELECTED AND APPOINTED OFFICIALS OF THE TOWN OF CORTLANDVILLE FOR THE YEAR 2022 Motion by Councilman Guido Seconded by Councilman Donlick VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby establish the following as standard workdays for elected and appointed officials and will report the following days worked to the New York State Local Employees’ Retirement System based on the record of activities maintained and submitted by these officials to the Town Clerk: Elected/Appointed Standard Term of Record of Officials: Name: Workday: Office: Activities: Town Councilman Gregory K. DelVecchio 6 hours 01/01/2022-12/31/2023 15.84 JUNE 15, 2022 TOWN BOARD MEETING PAGE 4 Councilman Guido made a motion, seconded by Councilman Leach, to receive and file and fully executed Agreement between the Town of Cortlandville and the County of Cortland, received June 7, 2022, regarding Cortland County Investing $500,000 of their Federal American Rescue Plan Act Funds (ARPA) into Gutchess Lumber Sports Complex (GLSC). All voting aye, the motion was carried. Councilman Guido made a motion, seconded by Councilman Cobb, to receive and file updated correspondence from the Cortland County Board of Elections, dated June 3, 2022, regarding the use of the Town of Cortlandville Municipal Garage for the Federal Primary Election on Tuesday, August 23, 2022. All voting aye, the motion was carried. RESOLUTION #180 ACKNOWLEDGE RECEIPT OF THE PROPOSED LOCAL LAW OF 2022 – “A LOCAL LAW ADOPTING THE TOWN OF CORTLANDVILLE’S VACANT PROPERTY LAW IN THE TOWN OF CORTLANDVILLE, NEW YORK”, AND SCHEDULE A PUBLIC HEARING FOR JULY 6, 2022 AT 5:00 P.M. Motion by Councilman Cobb Seconded by Councilman Guido VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby acknowledge receipt of the proposed Local Law of 2022, “A Local Law Adopting the Town of Cortlandville’s Vacant Property Law in the Town of Cortlandville, New York”, as prepared by the Town Attorney, and it is further RESOLVED, the Town Board hereby schedules a public hearing on the proposed Local Law for Wednesday, July 6, 2022 at 5:00 p.m. to be held at the Municipal Garage, 3587 Terrace Road, Cortland, New York. Councilman Cobb made a motion, seconded by Councilman Leach, to receive and file correspondence from John Soshinsky, dated June 8, 2022, regarding his support for the Homer, Cortlandville & Solon Solar Energy Project of EDF Renewables. All voting aye, the motion was carried. With no further comments or discussion to be heard, Supervisor Williams requested the Board convene to an Executive Session to discuss contracts and personnel. Councilman Cobb made a motion, seconded by Councilman Leach to recess the Regular Meeting to an Executive Session to discuss contracts and personnel. All voting aye, the motion was carried. The meeting was recessed at 5:34 p.m. Councilman Guido made a motion, seconded by Councilman Leach, to adjourn the Executive Session and reconvene the Regular Meeting. All voting aye the motion was carried. The Executive Session was adjourned at 6:06 p.m. Members of the public were invited to return to the meeting at this time. RESOLUTION #181 APPROVE AGREEMENT BETWEEN CRESTLINE SOFTWARE LLC DBA/MUNIBILLING AND THE TOWN OF CORTLANDVILLE TO PROVIDE UTILITY BILLING SOFTWARE FOR THE TOWN WATER & SEWER DEPARTMENT Motion by Councilman Cobb Seconded by Councilman Donlick VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED JUNE 15, 2022 TOWN BOARD MEETING PAGE 5 BE IT RESOLVED, the Town Board does hereby approve the Software Subscription Agreement between Crestline Software LLC dba MuniBilling and the Town of Cortlandville to provide utility billing software for the Town Water & Sewer Department for a term of five years, and it is further RESOLVED, the Town Board further authorizes the expenditure of $15,495.00 for the initial startup cost, as well as the annual fee of $6,972.00 for the billing software (billed quarterly), with the option to provide printing of the quarterly bills for approximately $1,992.00 per year (plus postage), and it is further RESOLVED, that Water & Sewer Superintendent, Brian Congdon is hereby authorized to sign the agreement.
