Cowett, G. Gillespie, R. Segelken, and Alternate J. Leijonhufvud Code Enforcement Officer B. Cross, Attorney R. Marcus, Trustee J. Marshall Members of the Public Item 1 – Meeting called to order Chair F. Cowett opened the meeting at 7:02 pm. Chair F. Cowett appointed J. Leijonhufvud as a full voting member for the meeting. Chair F. Cowett welcomed Trustee J. Marshall as the new Board of Trustees liaison to the Planning Board. Item 2 – March 28, 2016 Minutes Motion: G. Gillespie Second: R. Segelken RESOLUTION No. 180 APPROVING MINUTES OF MARCH 28, 2016 RESOLVED, that the written, reviewed and revised minutes of the March 28, 2016 meeting are hereby approved. Aye votes – Chair F. Cowett, G. Gillespie, R. Segelken, J. Leijonhufvud Opposed- None Item 3 – Public Comment No members of the public wished to comment. Item 4 – Continuation of Site Plan Review – 1001 Highland Road Minor Subdivision Chair F. Cowett stated that a new subdivision plan was not received in time to provide sufficient public notice and therefore the public hearing scheduled for the Board’s April meeting would be postponed until the Board’s meeting on May 23. 2 Code Enforcement Officer B. Cross explained that the new subdivision plan submitted by the applicant removed the L-shaped leg in the original plan and is more regularly shaped; Parcel A, the remainder lot, comprises 11.2% lot coverage and is therefore compliant with zoning requirements and is also compliant with zoning requirements for average width and average depth; Parcel B, the new subdivided lot, has an average width of 98.2 feet and an average depth of 143 feet, neither of which is compliant with zoning requirements of 125 feet average width and 150 feet average depth and will require a variance from the Village’s Zoning Board of Appeals. The applicant D. Lennox stated that the new subdivision plan removes a triangular piece near the northern property line so as to retain an existing fence. Code Enforcement Officer B. Cross added that removing the triangular piece increased the average depth measurement. The applicant provided Part 1 of the SEQRA Short Environmental Assessment Form which the Board reviewed. 3 4 5 6 7 8 The Board reviewed Parts 2 and 3 of the SEQRA Short Environmental Assessment Form. 9 10 Code Enforcement Officer B. Cross noted the Board’s reference in Part 3 to the building of a “single family home,” and noted that the Zoning Board could grant a variance on the condition that a one family residence and not a two family residence be built on Parcel B, the subdivided lot. D. Lennox acknowledged to the Board that he had discussed the possibility of such a condition with Code Enforcement Officer B. Cross and that he supported this condition due to the smaller size of the subdivided lot. Motion: G. Gillespie Second: R. Segelken RESOLUTION No. 181 TO DETERMINE PROPOSED ACTION WILL NOT RESULT IN AN ADVERSE ENVIRONMENTAL IMPACT RESOLVED, that the Village of Cayuga Heights Planning Board has determined that the proposed minor subdivision at 1001 Highland Road will not result in any significant adverse environmental impacts. Aye votes – Chair F. Cowett, G. Gillespie, R. Segelken, J. Leijonhufvud Opposed- None Motion: J. Leijonhufvud Second: R. Segelken RESOLUTION No. 182 TO HOLD A PUBLIC HEARING ON THE PROPOSED MINOR SUBDIVISION AT 1001 HIGHLAND ROAD RESOLVED, that a public hearing will be held on May 23, 2016 at 7:10 p.m. regarding the site plan review for the proposed Minor Subdivision at 1001 Highland Road. Aye votes – Chair F. Cowett, G. Gillespie, R. Segelken, J. Leijonhufvud Opposed- None D. Lennox asked about the site plan review process moving forward and whether he would need to appear again before the Board following the May 23 meeting. Chair F. Cowett replied that the Board had discussed at its March 28 meeting granting site plan approval with the condition of submitting at a future date a plan showing the location of any house to be built on the subdivided lot. 11 Attorney R. Marcus stated that D. Lennox would not need to appear before the Board to submit such a plan, and asked if D. Lennox would want to submit a plan to the Board at its May 23 meeting. A discussion followed about submitting a plan at the Board’s May 23 meeting. D. Lennox concurred with the Board that, given the subdivision’s need for a variance from the Village’s Zoning Board of Appeals at the ZBA’s June 6 meeting, it would be best not to submit a plan at the Planning Board’s May 23 meeting. Item 5- Other Business R. Segelken asked Code Enforcement Officer B. Cross about construction at the florist in Corners Community shopping center and whether it would be possible to construct a roof over an exterior stairway to promote safety. Code Enforcement Officer B. Cross replied that constructing such a roof would be possible, but this would require a variance from the Village’s Zoning Board of Appeals because the shopping center already exceeds zoning requirements for lot coverage. G. Gillespie asked Chair F. Cowett about the Zoning Revision Committee. Chair F. Cowett replied that the Zoning Revision Committee has provided Attorney R. Marcus with a draft of a revised Village zoning ordinance for his review. Item 6 – Adjourn Meeting adjourned at 7:50 pm.
