Re: Board of Zoning Appeals Action on Request for Interpretation of Section 9 of the Village
Zoning Ordinance (Fences and Walls)
Dear Ms. Kiefer and Ms. Wetherbee,
On January 28, 2008, after due publication of notice, the Board of Zoning Appeals (BZA)
continued the appeal for the interpretation of the Village Ordinance regarding fences and walls and in
particular the fence at 100 West Upland Road. This appeal had been brought to the Board by Ms.
Dooley Kiefer and public comments were heard on January 7, 2008. The Board noted that Ms. Kiefer
was not present at this meeting, although the hearing on her appeal had not been competed on January
7th and that Peter Wetherbee was in attendance at this meeting to represent his parents.
The letter from Dirk A. Galbraith, attorney for the property owners, dated January 24th, 2008,
to the Zoning Board of Appeals was read into the record (copy enclosed). The contention expressed
in that letter was that the reduction of the fence to a uniform height of four feet or less rendered the
matter now before the Board moot.
The Village Zoning Officer stated on the record that the wooden fence in question, as
represented in Mr. Galbraith’s letter, was in fact removed and the remaining fence is at 4 feet (or less)
in height as measured from the sidewalk grade. This measurement is documented by a survey map
prepared by T.G. Miller Engineer’s and an elevation drawing prepared by Jagat Sharma, AIA, and
confirmed the Zoning Officer’s own measurements. The removed wooden fence panels have been
replaced by 36” high plastic fabric and a 48” high “snow fence”, which are temporary in nature.
