HomeMy WebLinkAbout05-18-2009Minutes of Meeting Village of Cayuga Heights Zoning Board of Appeals May 18, 2009 Present: Chairman Jack Young, Members Bob Powers, Peter McClelland, Allison Smith, Zoning Officer Brent Cross, and Cody Danks Burke. 5:05 pm: Chairman Young called the meeting to order and explained the purpose of the meeting was to consider the request by Leslie Danks Burke for a front yard setback of 22’ instead of the 25’ that is required by the zoning ordinance. This request was being continued from the 5/4/09 meeting due to an address error in the advertisement of the public hearing. A corrected notice was advertised for today’s meeting. 5:06 pm: The Public Hearing was opened. Since nobody was present to comment on the request, the Public Hearing was then immediately closed. 5:07 pm: Mr. McClelland inquired if the Clerk had documented the work of the Board at the last meeting in which the members discussed the case and formally addressed the standard questions that are asked and answered for all cases. Chairman Young shared a copy of the meetings from the previous meeting that include the Board’s responses to the standard questions. 5:08 pm: Chairman Young presented the following motion: RESOLVED, that a variance is hereby granted to Leslie Danks Burke for the property at 109 Oak Hill Road (tax parcel 14-2-4) for a decrease in the front yard setback to 22 feet for the proposed covered front porch. The motion was seconded by Mr. Powers, the vote was unanimously in favor. Mr. Danks Burke was reminded that the approved variance was subject to appeal for the next 30 days, and any work done before then would be subject to such an appeal. 5:09 pm: Chairman Young closed the meeting. PUBLIC NOTICE NOTICE is hereby given that on May 18, 2009 the Village of Cayuga Heights Zoning Board of Appeals will conduct a Public Hearing(s) at the Village Hall, 836 Hanshaw Road, to consider the following application(s): 5:00 pm: Variance request by Leslie Danks Burke, owner, to construct a new front porch addition at 109 Oak Hill Road (tax parcel 14-2-4) with a front yard setback of 22’, which is less than the 25’ required by the Village of Cayuga Heights Zoning Ordinance Section 6: Yard Requirements.
