Frantz Members of the Public: (See Sign In Sheet) Item 1 – Meeting called to order Called to order by Chair M. Harms at 7:02 pm. Item 2 – Review and approval of June Minutes Motion: F. Cowett Second: S. Cunningham RESOLUTION No. 74 APPROVING MINUTES OF JUNE 27, 2011 RESOLVE, that the written, reviewed and revised minutes of June 27, 2011 meeting are hereby approved. Aye votes – All in favor Opposed- None Item 3 - Public Comment No members of the public wished to comment. Item 4 - Pleasant Grove Subdivision Public Hearing S. Cunningham recused himself and sat as a member of the public. Public Hearing opened by Chair M. Harms. Village Superintendent B. Cross updated the board that an agreement has been drawn between the Pleasant Grove Lane Homeowner’s Association and J. Sokoloff. (See Appendix). Village Superintendent B. Cross also informed the board that the determination of the Tompkins County Department of Planning is that the project will have no negative impacts pursuant to 239 of NYS General municipal Law. (See Appendix) Meeting #23 Planning Board June 27, 2011 Page 2 D. Corson, Treasurer of the Pleasant Grove Lane Homeowner’s Association, stated J. Sokoloff has been invited to join the Homeowner’s Association contingent upon the board’s Final Subdivision Plat Approval. Chair M. Harms read the proposed resolution concerning the Final Subdivision Plat Approval aloud to the public. RESOLUTION #75 VILLAGE OF CAYUGA HEIGHTS PLANNING BOARD RESOLUTION ADOPTED ON JULY 25, 2011 FOR PRELIMINARY AND FINAL SUBDIVISION PLAT APPROVAL FOR THE PLEASANT GROVE ROAD SUBDIVISION Motion made by: Fred Cowett Motion seconded by: Henry Richardson WHEREAS: A. This matter involves consideration of the following proposed action: Preliminary and Final Plat approval of the Pleasant Grove Road Subdivision, a major subdivision by Jason Sokoloff of Sokoloff Properties, Inc. to divide 176 Pleasant Grove Lane (Tax ID# 11.-2-7.8) into 3 lots; Lot A consisting of 1.02 acres, Lot B consisting of .64 acres, and Lot C consisting of .60 acres for the purpose of constructing a single family house on Lot A and a single family house on Lot C; and B. On May 23, 2011 the Village of Cayuga Heights Planning Board, based upon (i) its thorough review of the applicant’s Short Environmental Assessment Form (the Short EAF”), Part I, and any and all other documents prepared and submitted with respect to this proposed action and its environmental review, (ii) its thorough review of the potential relevant areas of environmental concern to determine if the proposed action may have a significant adverse impact on the environment, including the criteria identified in 6 NYCRR Section 617.7(c), and (iii) its completion of the Short EAF, Part II including the findings noted thereon, made a negative determination of environmental significance (“Negative Declaration”) in accordance with SEQR for the above referenced proposed action, and determined that an Environmental Impact Statement would not be required; and C. On May 23, 2011, the Village of Cayuga Heights Planning Board reviewed the Preliminary Plat and Final Plat and accompanying subdivision application materials submitted by the applicant and determined, having completed the SEQR review and having made its SEQR determination, that the preliminary plat application was complete; and D. On July 25, 2011, the Village of Cayuga Heights Planning Board held a duly noticed public hearing on the Pleasant Grove Road Subdivision Preliminary Plat and Final Plat, and thereafter reviewed and analyzed the issues raised during such public hearing and otherwise raised in the course of its deliberations, including any environmental issues or considerations that might require reconsideration of its Negative Declaration and any possible conditions that might be imposed in conjunction with preliminary and final plat approval to be granted for such subdivision; and Subdivision Preliminary/Final Plat App Res. 7.25.11 E. On July 25, 2011, the Village of Cayuga Heights Planning Board (i) determined that no further public hearing would be required for the purpose of acting upon the Preliminary and Final Plat approvals for the Pleasant Grove Road Subdivision, (ii) further reviewed the possible conditions and requirements to be attached to any approvals to be granted for the Preliminary and Final Plats, and (iii) confirmed what, if any, condition(s) and requirement(s) should be attached to any approval to be granted for the Preliminary and Final Plats; Meeting #23 Planning Board June 27, 2011 Page 3 NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The Village of Cayuga Heights Planning Board, based upon all of its foregoing review and action, hereby grants approvals of the Preliminary and Final Plats for the Pleasant Grove Road Subdivision, subject to the following conditions and requirements: A. Acceptance and incorporation of Lot A into the Pleasant Grove Lane Homeowners Association, specifically to evidence and verify sufficient road access to the property fronting on Pleasant Grove Lane (Lot A). 2. The Chairperson of the Village of Cayuga Heights Planning Board is hereby authorized and directed to sign such approved Final Plat (i) upon compliance with all of the foregoing conditions and requirements for which compliance is required prior to such signing of the Final Plat, and (ii) in accordance with all applicable State and local laws, regulations and provisions. The vote on the foregoing motion was as follows: AYES: Unanimous – Graham Gillespie, Fred Cowett, Henry Richardson, Martin Harms NAYS: None The motion was declared to be carried. S. Cunningham rejoined the board table. Item5- Board Membership Issues Chair M. Harms previously sent an email to the board stating he will be absent from the Planning Board beginning August 12 until December 18 while teaching abroad. (See Appendix). The board discussed how his absence will affect the board. The board discussed appointing an acting Chair during Chair M. Harms absence and also discussed how to recruit a new alternate. Item 6- Comprehensive Plan The board continued to review the draft Comprehensive Plan. The board discussed with G. Frantz changes and suggestions that could improve the plan. G. Frantz brought a map to review future land uses. Item 7 - Other Business The board would like to pass a resolution recognizing M. Morris for his service to the Planning Board. A proposed resolution will be drafted by VCH Deputy Clerk A. Korbel and will be presented at the August meeting. Item 7 - Adjourn Meeting adjourned at 10:26 PM.
