Minutes 9/18/1995150 VILLAGE OF CAYUGA HEIGHTS BOARD OF TRUSTEES Minutes of a regular meeting of the Board of Trustees of the Village of Cayuga Heights held September 18, 1995 at 7:30 PM in the Village Hall. PRESENT: Mayor Anderson; Trustees Bisogni, Collyer, Fleming, Kira, Kozen, Pimentel; Attorney Tyler; Treasurer Silber; Supt. of P.W. Cross; Police Chief Wall; 2nd Asst. Chief Evans. OTHERS: M/M Richard Agard, Mrs. Weaver, Dr. and Mrs. Markowitz, Mr. Joseph Rosenblum, Robin Palmer, Kay Newman, Ithaca High students. Mayor Anderson called the meeting to order at 7:35 PM opening it to comments from the public. Mrs. Beverly Agard voiced her complaint regarding the recently- erected, illuminated sign on the commercial property owned by Dr. Markowitz and known as the Medical Arts Building located at 408 E. Upland Road. She stated that its appearance is garish and out of character with the neighborhood, and it is too close to the road. She feared it would set a precedent. Mr. Agard, Mrs. Weaver and Ms. Newman voiced similar complaints. Zoning Officer Cross explained that he had spent considerable time reviewing the application for the free - standing, illuminated sign and found it to be in compliance with the Zoning Ordinance. Dr. Markowitz commented that the purpose of the illuminated sign was to let people know where his office is located. He maintained that it is a conforming, "conservative and professional" sign with "low illumination." Trustee Kozen asked Dr. Markowitz if he considered turning it off when he closes his office. The Trustees agreed to observe the sign after dark and will offer suggestions at a future time. Mr. Joseph Rosenblum of.3O8 Highgate Road appeared to voice his opinions regarding the solution to the drainage problem on Highgate Road and to criticize the method currently being used, to wit: open drainage ditches. Mr. Rosenblum stated he would like to see the ditches enclosed and curbing installed. It was the consensus that the Public Works Committee will discuss the issue. Motion by Trustee Kira, seconded by Trustee Fleming: VOTED to approve the Minutes of the August 21, 1995 regular meeting, as previously furnished Trustees in copy form. Trustees Bisogni, Collyer, Fleming, Kira, Kozen, Pimentel voted YES. Robin Palmer distributed copies of the Cable Franchise Renewal Agreement for perusal by Board members to comment on at a later meeting. The Mayor reported that the Tompkins County Planning Federation asks that a member be named from the Village Board. Trustee Bisogni agreed to serve. There was no monthly report from the CHCA. William Evans, 2nd Asst. Chief presented the report of the Fire Department in the absence of Supt. Day and a copy has been placed on file in the Village Office. Status of the new Rescue Truck - should be in any day. The used Rescue Truck is being published for sale on a national level. Open House is scheduled for October 14 from 12 Noon'to 4 PM. The Treasurer's Financial Reports are on file. The Treasurer reported that street expenditures went down this year and O&M cont ri- ' bution from the State needs to be examined, and he will do so. Question relative to the renewal of the Fire Protection Contract with the Town of Ithaca concerning the lack of mention in the Contract of Hazardous Materials Response., Treasurer Silber will discuss this with Supt. Day. 151 Minutes of Regular Meeting - 9118195 2 Motion by Trustee Fleming, seconded by Trustee Pimentel: RESOLUTION 4693 - APPROVE TRANSFER VOTED to approve the transfer as recommended by the Treasurer as follows: FROM G1990.4 WWTP Contingency TO G8130.41 WWTP Other - $7,500 Trustees Bisogni, Collyer, Fleming, Kira, Kozen, Pimentel voted YES. *,t,t Motion by Trustee Pimentel, seconded by Trustee Kira: VOTED to approve the Abstract of Warrants dated 9/18/95 in the following amounts: General Fund — $18,059.86; Sewer Fund - $21,812.90; Water Fund - $139.28 (after deletion of the second entry for* Blue Book bill for $230.05). Trustees Bisogni, Collyer, Fleming, Kira, Kozen, Pimentel voted YES. Attorney Tyler reported that Carol McTague, Municipal Consultant for NYS Commission on Cable Television, will be in the.area in October and he and the Mayor, and anyone else wishing to join them, will meet with her. There was brief discussion concerning the Memo he received from Supt. Cross regarding situations in the Village where trees growing on private property have their limbs growing over Village rights -of- way thereby posing a potential hazard. He recommended sending general notices to property owners of this hazard - possible inclusion with Tax Bills. Trustee Kira, Attorney Tyler and Will Evans left the meeting. Police Chief Wall submitted his monthly report which has been placed on file. Motion by Trustee Fleming, seconded by Trustee Collyer: RESOLUTION 4694 - AUTHORIZE POLICE CHIEF TO ADVERTISE FOR SALE OF USED POLICE CAR VOTED to authorize Chief Wall to advertise for the sale of the used 1992 Chevrolet Caprice Police Car at a minimum price of $4,000 and to state the Village has the right to reject any or all bids. Trustees Bisogni, Collyer, Fleming, Kozen, Pimentel voted YES. Supt, of P.W. Cross submitted his monthly report which is on file in the Village Office. Supt. Cross explained the nature of the request from BOCES to waive the sewer back - charge for the two sewer units assessed on the construction of the new addition. BOCES officials contend that because the same student population will be using the new building while the old building is being renovated and not in use, it all equals out and they should not be billed for the new hookups. Their request was denied. Motion by Trustee Pimentel, seconded by Trustee Fleming: RESOLUTION 4694 - AUTHORIZE PURCHASE FOR DPW VOTED to authorize the purchase of two boxes and a salt5cinder spreader for a total cost not to exceed $7,400. Trustees Bisogni, Collyer, Fleming, Kozen, Pimentel voted YES. Motion by Trustee Fleming, seconded by Trustee Pimentel: RESOLUTION 4695 - ENTER INTO AGREEMENT RE DRUG AND ALCOHOL TESTING VOTED RESOLVED, that the Village of Cayuga Heights agrees to enter into an intermu- ' nicipal agreement with Tompkins County, City of Ithaca and the Towns and Villages of Tompkins County for the purpose of implementing the drug and alcohol testing as required by the Omnibus Employee Testing Act of 1991, per review by the-Village Attorney. Such agreement shall contain terms and conditions as deemed necessary to protect the Village's interest, and shall provide for the sharing of costs upon an equitable basis between the parties. Such agreement shall extend through December 31, 1996. Trustees Bisogni, Collyer, Fleming, Kozen; Pimentel voted YES. 1 5 2Minutes of Regular Meeting - 9/18/95 There was discussion concerning the letter from David Boyd, Director of the Ithaca- Tompkins County Transportation Council in which he requests that the Village include this Agency in current and future reviews conducted under the State Environmental Review Act. Motion by Trustee Pimentel, seconded by Trustee Fleming: RESOLUTION 4696 - INCLUDE ITHACA- TOMPKINS COUNTY TRANSPORTATION COUNCIL AS INTERESTED AGENCY FOR FUTURE.REVIEW ACTIVITIES `• C VOTED that the Village of Cayuga Heights will include the ITCTC as an "Interested Agency" for all current and future reviews conducted under 6 NYCRR Part 617, the State Environmental Review Act and also as an "Involved Agency" for current and future review activities that affect the metropolitan transportation system (sic the approved federal -aid functional class system and federally- funded transit system.
