Minutes 4/2/1990f(1.3 MINUTES of Annual Organizational Meeting - April 2, 1990 Minutes of the Annual Organizational Meeting of the Board of Trustees of the Village of Cayuga Heights held April 2, 1990 immediately following the Public Hearing. PRESENT: Mayor Anderson; Trustees Camp, Fleming, Pimentel; Weiss, Wheeler; Acting Attorney Oesterle; Treasurer Silber; Supt. of Public Works Rogers; Police Chief Wall; Fire Chief Millier. ABSENT: Trustee Searle. OTHERS: Pat Mutkoski, Mrs. Thorbecke, Mrs. Maynes, several other Villagers. Mayor Anderson called the meeting to order at 7:50 p.m. Motion by Trustee Fleming, seconded by Trustee Pimentel: VOTED to approve the minutes of a Public Hearing and Regular Meeting held March 19, 1990 as previously furnished Trustees in copy form subject to clarification of the former that comments made by Mr. How and Ms. Wilson relative to Oak Hill parking situation were favorable. Unanimously passed. Trustees Camp, Fleming, Pimentel, Weiss and Wheeler voting yes. Moved by Trustee Pimentel, seconded by Trustee Camp: VOTED to approve the minutes of a Special Meeting held March 26, 1990 as previously furnished Trustees in copy form. Unanimously passed. , Trustees Camp, Fleming, Pimentel, Weiss and Wheeler voting yes. Motion by Trustee Pimentel, seconded by Trustee Fleming: VOTED to approve the Abstract of Audited vouchers dated April 2, 1990 in the follow- ing amounts: General Fund - $18,519.29; Sewer Fund - $13,846.80. Unanimously passed. Trustees Camp, Fleming, Pimentel, Weiss and Wheeler voting yes. Mayor Anderson reported receiving the following letters: - Most of the correspondence was concerning Remington Road. - Mr. Zack would like to buy a strip of land by William Scott's property (251). - The Board would like to keep it. It was a bridle path. Would the school like to buy it? The Trustees will look into the matter. Fire Chief Millier presented his written report which is on file. Chief Millier expressed his,thanks to the Board for their support during the last year. ' Community Center - No report. Treasurer reported that the tax level is 23% of the total permitted. / e N. MINUTES of Organizational Meeting - 4/2/90 Motion by Trustee Camp, seconded by Trustee Fleming: ® RESOLUTION 4135 - ADOPT INVESTMENT POLICY FOR VILLAGE OF CAYUGA HEIGHTS VOTED to adopt the Investment Policy which is the standard form for Villages provided by New York State. Copy attached to Official Minute Book. Unanimously passed. Trustees Camp, Fleming, Pimentel, Weiss and Wheeler voting yes. The Mayor asked that Department Heads re- examine their capital needs for the next 5 years, with time priorities for 1) essential items and 2) desirable items. Attorney - No report. I . Police Chief Wall presented his statistical report which is on file. Police Chief is pleased with the new police car, delivered here on April 2, 1990. Supt. of Public Works Rogers filed his written report in the Village Office. The Supt. reported that the streets to be resurfaced this year are Cayuga Park Circle, Comstock, Oak Hill Place, Forest Drive and Hampton Road. Trustees Camp and Weiss would like to see the shoulders paved on Cayuga Heights Road. Trustee Weiss asked what grading is? Jack explained that it would create a wider flatter road. David Wall likes the dip in the road by President Rhodes' house. Triphammer Road bridge will be closed June 2nd. Cayuga Heights Raod will be the major artery to Cornell Rniversity. The bridge may be closed 6 months. Trustee Wheeler asked the Chief to check intersections that may need signs, (Cayuga Heights Road), and also how much should we do to improve Cayuga Heights Road. Trustee Wheeler would like to have property owners notified by mail 2 weeks before work is started on the road. He thinks there would be less ill feeling. Trustee Camp would like to have them notified twice, 2 weeks apart. Stream and ditch maintenance on either side of Klinewoods Road will be done this spring. Trustee Camp is concerned about the policy on chipping. He would like the day changed! The Villagers are doing more cleaning and there is increased w000d out for, the chipper. The shrubs on Hanshaw Road must be moved and the retaining wall at Mike Timmons' is trespassing on Village right -of -way. The Mayor with the help of Chief Wall will enforce these problems. The Trustees would like the Engineer to estimate what bulky trash pick -up will cost the Village. The Village will not pick up toxic waste. There is a Sheriff's Deputy in Tompkins County just to enforce the trash laws. Should we replace the boiler in the Village Hall? Local plumber said the boiler is ok at this time. 'The Engineer has found some slate that can be used to repair the roof on the Village Hall. He suggests that we buy it after June 1st. Clerk - No report. The Mayor read the Canvas of Election for the March 1990 Election: /qS MINUTES of Organizational Meeting - 4/2/90 Village Party: Mayor: Ronald E. Anderson 97 votes Trustee: D. Wayne Fleming 95 votes Trustee: David Pimentel 95 votes Trustee: Gordon Wheeler 94 votes There were 82 votes on the public counter, 15 blank votes and 17 absentee ballots. Mayor Anderson appointed Trustee Fleming as Deputy Mayor. Motion by Trustee Fleming, seconded by Trustee Pimentel: RESOLUTION 4136 - APPOINTMENTS VOTED to approve the following appointments with the exception of c, d, e, as listed below: a. Jeffrey A. Silber, Treasurer for two official years at 1990 -91 salary of $8,000. b. Anne M. Krohto, Clerk for two official years at 1990 -91 salary of $22,700. f. Roger B. Sovocool, Attorney for one official year at 1990 -91 salary of $11,000. g. Trustee Camp, Acting Treasurer for one official year. h. Trustee Pimentel, Village Forester for one official year. i. Warren Blye, Acting Village Justive for one official year at $15.00 per court sitting. j. Robin Cisne, ZBA Member for a two -year term, to run to April 1992. Unanimously passed. Trustees Camp, Fleming, Pimentel, Weiss and Wheeler voting yes. Motion by Trustee Wheeler, seconded by Trustee Camp: RESOLUTION 4137 - OFFICIAL DEPOSITORY VOTED that the Tompkins County Trust Company, Ithaca, NY be designated as the official depository for the Village funds for the 1990 -91 fiscal year. Unanimously passed. Trustee Camp, Fleming, Pimentel, Weiss and Wheeler voting yes. Motion by Trustee Wheeler, seconded by Trustee Camp: RESOLUTION 4138 - OFFICIAL CHECK SIGNATURES VOTED that the Clerk be authorized to notify the official bank of the following names to be honored on checks for the 1990 -91 official year, with two signatures required: 1. Ronald E. Anderson, Mayor, or D. Wayne Fleming, Deputy•.Mayor. 2. Jeffrey A. Silber, Treasurer, or Willaim 0. Camp, Acting Treasurer. 3. Anne M. Krohto, Clerk. Unanimously passed. 1 1 f MINUTES of Organizational Meeting - 4/2/90 Trustees Camp, Fleming, Pimentel, Weiss and Wheeler voting yes. Motion by Trustee Wheeler, seconded by Trustee Camp: RESOLUTION 4139 - OFFICIAL NEWSPAPER VOTED that the Ithaca Journal be designated the official newspaper for the 1990 -91 official year. Unanimously passed. Trustees Camp, Fleming, Pimentel, Weiss and Wheeler voting yes. Motion by Trustee Wheeler, seconded by Trustee Camp: RESOLUTION 4140 - LEVY AND EXTEND TAXES, SPECIAL ASSESSMENTS AND SEWER RENTS VOTED resolved, that the amount of $549,893.00 be levied upon the taxable real property of the Village for the 1990 -91 fiscal year as real property taxes. Also VOTED RESOLVED, to authorize and direct"the:Clerk to'eztend-and. carry out upon the Assessment Roll -I the - ambunt to be levied against each`.parcel of real property shown thereon, according to the total levy of $549,893.00. Also VOTED RESOLVED, that the amount of $34,750.00 be levied upon the benefited properties in the Village for the 1990 -91 fiscal year as special assessment on the water district. Also VOTED RESOLVED, that =the--amount,of $516,526.00:be Levied upon-the benefited properties connected to the Village Sewer System for the 1990 -91 fiscal year. Also VOTED RESOLVED, to aUth&ize and direct the Clerk to extend and carry out upon the Sewer Rent Assessment Roll the amount to be charged against each benefited property according to the total levy of $516,526.00. Unanimously passed. Trustees Camp, Fleming, Pimentel, Weiss and Wheeler voting yes. Motion by Trustee Camp, seconded by Trustee Fleming: RESOLUTION 4(41 - ESTABLISH RATES VOTED to establish rates for taxes, special assessments, and sewer rents for the fiscal year 1990 -91 as follows: Real Property Tax Sewer Plant Disposal & Maintenance $ 6.44/M 1397.40 Units in Village Less State Aid $1.49 $ 76.00 /Unit 101 Units for Cornell, Agway etc. at Village Rate $ 76.00 /Unit !96 19 �? Trustees Camp, Fleming, Pimentel, Weiss and Wheeler voting yes. Motion by Trustee Camp, seconded by Trustee Weiss: RESOLUTION 414A - ADOPT BUDGET WITH EXCEPTION OF SALARY ITEM VOTED to adopt the 1990 -91 Budget and Appended Salary and Wage Schedule with ex- ception of the Salary of the Supt. of Public Works until further discussion. Trustees Camp and WEiss voted YES. Trustee Pimentel, Wheeler and Fleming OPPOSED. Motion by Trustee Pimentel, seconded by Trustee Fleming: RESOLUTION 4'145 - ADOPT BUDGET VOTED to adopt the 1990 -91 Budget and Appended Salary and Wage Schedule. Trustees Pimentel, Wheeler and Fleming voted YES. Trustees Camp and Weiss OPPOSED. Motion by Trustee Fleming, seconded by Trustee Camp: RESOLUTION 4I44 - ADD DELINQUENT WATER BILLS AND A/R TO 1990 -91 ROLL VOTED to authorize the Clerk to add to the Village Tax Roll for 1990 -91, the amount of $2,588.12 due for delinquent water use bills for the calendar year 1989 and $598.14 due in overdue accounts receivable. Unanimously passed. Trustees Camp, Fleming, Pimentel, Weiss and Wheeler voting yes. Motion by Trustee Fleming, seconded by Trustee Camp: RESOLUTION 4145-- SET DATE FOR REGULAR MEETINGS FOR 1990 -91 OFFICIAL YEAR VOTED to set the date for regular meetings for the 1990 -91 official year as the third Monday in each month, except the Annual Organizational Meeting which is held on the first Monday in April each year. Unanimously passed. Trustees Camp, Fleming, Pimentel, Weiss and Wheeler voting yes. The next regular meeting of the Board of Trustees shall be Monday, May 21, 1990 at 7:30 p.m. in the Village Hall. TI L MINUTES of Organizational Meeting - 4/2/90 Motion by Trustee Weiss, seconded by Trustee Camp: ® RESOLUTION 4146 - ENTER INTO EXECTIVE SESSION VOTED to enter into Exective Session at 9:30 p.m. to discuss a personnel matter related to the appointment of Superintendent of Public Works and other legal matters. Unanimously passed. Trustees Camp, Fleming,�Pimentel, Weiss and Wheeler voting yes. The Supt. of Public Works, Treasurer and Clerk were excused. Submitted by Beverly Besemer in the absence of Anne Krohto The Attorney reviewed applicable state law and the 1970 Village of Cayuga Heights Code of Ethics as they apply to the case in question. Matters relating to lawsuits connected with the sewer motatorium were also discussed. Motion by Trustee Pimentel and seconded by Trustee Wheeler, to leave Executive Session. Unanimously passed. Trustees Camp, Fleming, Pimentel, Weiss and Wheeler voting yes. Leave Executive Session at 10:02 p.m. Motion made by Trustee Wheeler and seconded by Trustee Fleming to appoint Mr. Rogers to the positions of Building Commissioner, Engineer, and Zoning Officer (paragraphs c, d, and a as excluded in a previous motion). Unanimously passed. Trustees Camp, Fleming, Pimentel, Weiss and Wheeler voting yes. Motion made by Trustee Fleming and seconded by Trustee Camp to adjourn. Unanimously passed. PRESENT: Mayor Anderson; Trustees Camp, Fleming, Pimentel, SEarle, Weiss, Wheeler; Attorneys Oesterle and Sovocool; Treasurer Silber; Supt. of Public Works Rogers; Police Chief Wall; Fire Chief Miller.
