Minutes 11/6/1989/(� 7 MINUTES of Regular Meeting - 10/16/89 Certificate of the Tax Collector showing a balance of $7,616.45 including 9 per- ®centum of the amount of principal and interest. The Trustees returned the Account of Unpaid TAxes to the Tax Collector and authorized transfer to Tompkins County of the Account and Certificate of delinquent taxes as provided in Section 1436 of the Real Property Tax Law in the amount of $7,616.45 for collection by the County under the terms of the county of Tompkins Local Law No. 7 of 1981. Unanimously passed. Trustees Camp, Fleming, Pimentel, Searle and WEiss voting yes. Trustee Pimentel reported that he had received a request from Robert Calkins of 104 Corson Place for the removal of the Ash tree memorial located in Sunset Park and the Crabapple tree located near his property line. During discussion, it was mentioned that the fence along the back of the Calkins and Balliett properties is on Village property. No action. Moved by Trustee Fleming, seconded by Trustee Pimentel: RESOLUTION 4086 - ENTER EXECUTIVE SESSION VOTED to enter Executive Session at 10:54 to discuss a Police Department personnel matter and also pending litigation. Unanimously passed. Trustees Camp, Fleming, Pimentel, Searle and Weiss voting yes. Attorney Oesterle reported that the Village has received a request from the PBA to entertain their considering unionization. She stated that the Village must form a procedure to recognize them as a valid bargaining unit and was authorized to con- tact Jim Dennis for information on how to proceed. The Attorney will send copies of the rules portion of the statute to Trustees. Adjourned to regular meeting 11:25 p.m. Moved by Trustee Pimentel, seconded by Trustee Searle to adjourn the regular meet- ing at 11:27 p.m. � 1/ Anne Krohtd Clerk MINUTES of a Special Meeting - 11/6/89 Minutes of a special meeting of the Board of Trustees of the Village of Cayuga Heights held November 6, 1989 at 7:00 p.m. in the Village Hall. PRESENT: Mayor Anderson; Trustees Camp, Fleming, Searle, Weiss, Wheeler; Attorneys Oesterle and Sovocool; Treasurer Silber; Supt. of Public Works Rogers. ABSENT: Trustee Pimentel. OTHERS PRESENT: Mary Call, Mr /Mrs. Dennis Shepherd, Tom McCarthy, Joan Turcotte, Dooley Kiefer, David Donner, Kay Newman, PattyMutkoski. Mayor Anderson called the meeting to order at 7:00 p.m. stating that the primary purpose of the special meeting was for discussion of the Remington Road issue but that first, Mary Call wished to speak to the Board regarding tipping fees; and relative to this, she read the pertinent points of a resolution to mandate the 168 MINUTES of a Special Meeting - 11/6/89 container -fee system, effective March 1, 1990, which the County Board is consider- ing adopting at its meeting on November 8. She explained that by this system, permitted haulers (in this case, the Village itself) "shall be authorized to sell disposal tags to be attached to every container - without which the refuse will not be collected - and that the cost of the tipping fee will be written on the tag in order to set a limit on what haulers can charge." There was some discussion concerning the recycling program and the question was raised as to whether it would be expanded in the near future to include plastics and cardboard. Dooley Kiefer made the statement that volume is what people should be charged on since it is easy to buy a standard garbage container by volume and not weight. Opinions raging from people's buying habits to taxation at the "point of sale" (tax plastics out of existence) were expressed by the Board and the audience. It was felt that the Vil- lage should have a choice of not using the sticker method -that the Village and the City who do their own hauling should b offered the option of doing it a dif- ferent way. Mayor Anderson asked Mrs. Call to seek answers to: how much each 40# tag is going to cost, what percentage of the total amount they are presuming will be allocated to keeping track of tags for administrative overhead, are we going to have to pick upother waste in another truck - another crew - for things that used to be thrown in routinely? It was noted that it is premature for the County to try to settle the issue on Wednesday and it was suggested that the resolution be tabled until Barbara Eckstrom or someone from her staff can talk to the Village Board. Mrs. Call mentioned that if the Board should consider a Village -wide mailing before the next scheduled issue of VILLAGE VOICES, the County would like to include informa- tion in the publication and is willing to contribute some amount of money toward the cost. Mrs. Call and Jack Rogers left the meeting at 8:00 p.m. Mayor Anderson opened discussion on the Remington Road issue and Attorney Oesterle distributed copies of a Confidential Memorandum Regarding Remington Road Issues which she stated is intended to remain with Trustees. She explained that the reason for labeling it as such is because it discussed potential litigation. It was moved by Trustee Weiss to enter Executive Session to discuss potential consequences, to which Patty Mutkoski cautioned that the Board should also con- sider, while in Executive Session, all possible lawsuits, including taxpayers for use of taxpayers' funds. DooleyKiefer stated that she came to the meeting to hear what the Village's options are; that the Village has an obligation to reopen the road and if the Board has in- formation that contradicts that, the public deserves to hear it. The Treasurer stated that, according to the Engineer's survey, the cost range for improving the road is $385,000 to $583,000. It was agreed that the confidential memo from the Attorney would be reviewed in Executive Session and public discussion would follow in the reconvened special meeting. Motion byTrustee Weiss, seconded by Trustee Searle: RESOLUTION 4087 - ENTER EXECUTIVE SESSION VOTED to enter Executive Session at 8:10 p.m. for the purpose of discussing potential litigation. Trustee Camp, Fleming, Searle, Weiss and Wheeler voting yes. Trustee Wheeler left the meeting at 9:35 p.m. Villagers Newman, McCarthy, Mutkoski, Mr. /Mrs. Shepherd returned to the meeting. Motion byTrustee Camp', seconded byTrustee Weiss: RESOLUTION 4089 - INSTRUCT VILLAGE ATTORNEY TO PREPARE PROPOSED RESOLUTION FOR ABANDONMENT OF REMINGTON ROAD VOTED to instruct the Village Attorney to prepare a proposed resolution for aban- donment of that portion of Remington Road owned by the Village of Cayuga Heights for discussion at the next public meeting of the Board of Trustees and a public hearing thereafter. Trustees Camp, Fleming, Searle, Weiss voted YES. Msa Brief discussion followed between the Board and Villagers present. Trustee Searle proposed that a special edition of the VILLAGE VOICES be mailed in early December to inform residents about agenda items of concern to the Village, i.e., Remington Road, Savage Farm, Fire Truck Update, increased cost for waste and sludge disposal, Village representation to County Committees, etc. The Board will consider this. Meeting adjourned 10:00 p.m. A o Clerk MINUTES of a Public Hearing - 11/20/89 Minutes of a public hearing of the Board of Trustees of the Village of Cayuga Heights held November 20, 1989 in the Village Hall to consider. proposed Local Law Nol 1 of 1989 - Amendment to Zoning Ordinance. PRESENT: Mayor Anderson; Trustees Camp, Fleming, Pimentel, Searle, Weiss, Wheeler; Attorney Oesterle; Treasurer silber; Supt. of Public Works Rogers; Police Chief Wall; Fire Chief Millier. OTHERS: Jim Napoleon, John Majeroni, Mr. /Mrs. Shepherd, Dr. /Mrs. Humphrey, Jon Humphrey, Dooley Kiefer, Kay Newman, Midge Wilson, Patty Mutkoski, Marian Kira, Tom McCarthy, Mr. /Mrs. Oscar Rothaus. Mayor Anderson read Section 7.a. of the Zoning Ordinance and noted the proposed change in wording to read as follows: "Size of Lots. Lot sizes in all districts shall be as follows:..."
