Minutes of a Special Meeting to discuss West Remington Road held July 27, 1988,
7:00 p.m. in the Village Hall.

Mayor Anderson opened.the meeting with a short comment about new information that
had been distributed to Trustees ingluding: . '
1) A petition from North Sunset residents asking-to keep W. Remington Road closed
for environmental.considerations, etc.
2) Minutes of. the July 17.,•1967 meeting of VCH.Board relating to W: Remington Road.
3) Several letters dated July 18, 1967 stating that the closing of the road was a
temporary arrangement and thatilthe Board undertakes to reopen the road and'put it
in safe_and usable condition when a Village property owner whose property fronts on
the road prepares to build on his property." •
4) A letter from Prof: Dennis Shepherd giving other details around the purchr.se of
his property in 1964 qnd 1965.
The Mayor had received a letter from Jean Robinson posing 9 questions relevant to
the opening of the road which he read and commented on.
Each Trustee in turn was asked for a report on telephone calls and other recent,
comments from Villagers, and each responded briefly with a mixture of positive and
negative opinions touching on the costs of hiring an outside engineer, differences,
in valuations of properties at their time of purchase, assurances of land owners
that road access would be provided, risks involved in development of a park area,
and the necessity of Village access to sewer and water lines. The audience was
then invited to comment briefly on this issue.

John Rogers•asked to speak. He noted that as the owner of several lots on W.
Remington Road, he had a direct conflict of interest in the matter, and he had.
refrained from acting as Village Engineer in this instance on the advice of the
Village Attorney and the concurrence of the Board of Trustees. He asked if there
were any questions for him as a property owner. There were none, and he left the
meeting.
Mrs. Katz asked for a separation between the road problem and the development
potential -for owners of property.who had been assured of access to their properties.
Mrs. Mosher reported that the W. Remington srea'was noisy when the road was open.
The trees muffle noise.
Charles Wharton was concerned about the.sewer and water overload and complained
ebottt sewage odors. The.Mayor promised to check into this situation.
Daphne Roe insisted thht more information was needed before a decision was made.
Gertrude Shepherd felt.that'.a nature preserve was a poor idea in that location
because of potential strollers and trespassers on private property.
Dooley Kiefer reminded the group that the road was closed because of nuisance and
disturbance. Homes on•W. Rdmington would be a deterrent to parties and picnickers,
nuisances of all kinds, and because of its location it was not suitable for a wild
area. She also suggested that in view of the 1967 Board action, the present Board
could do no less than honor the commitment.
Mary Cullen isn't against the road but doesn1t want additional noise.
Roger Sovocool raised numerous questions in an effort to clarify the legal position
of the Village.
1) Is W. Remington a street? If soy the Village is obligated to make it safe.
What should it do to make it safe?
2) Should the cost of opening the street and paving be assumed by the Village, the
property owners, or part by each party?
3) Since the Town and 'the Village are joint owners, who should pay? (They have the
same obligation.)
4) In summary - We.have two options -.to open or abandon. We are liable either °way.
5) As to water lines and hydrants, they are usually charged back to developers. Also
utilities for houses.
Question, from Trustee Camp.- Is Tyler Road comparable to West Remington? Sovocool
thought not, inmost respects.,
The question of costs was discussed at.length by the-Board in an effort to establish
how they would be assessed, what realistic estimates would be, 'etc. The feeling was
expressed that'a public hearing would be required, and that property-owners would
likely share costs of opening the road, and•all costs of providing utilities.
Sovocool expressed the opinion that all property with frontage on•W. Remington would
be subject to assessment as a benefit district.
Motion by Trustee Pimentel, second by.Trustee Kira:
RESOLUTION 3940.- HONOR COMMITMENT MADE BY BOARD OF TRUSTEES IN 1967
VOTED to honor the commitment made'in :;1967•by the Board of Trustees and that this
Board move to re -open West Remington.Road at a date no later than April 27, 1989-
Trustees Fleming, Pimentel; Wheeler, Kira voted YES. Trustees Camp and Searle voted
AGAINST. Motion carried.

Motion by Trustee Fleming, second by Thustee Wheeler:
RESOLUTION '3941 - SECURE SERVICES OF AUTHORIZED ENGINEER
VOTED to authorize.the Mayor to secure the services of an authorized engineer to
figure the costs of building a road with and without a cul de sac at the bottom
of W. Remington Road'. Unanimously passed.
A motion to adjourn was made by Trustee Camp, seconded by Trustee Kira. Unanimously
passed. * **
