Administer Oath of Office to Trustees elected on March 19, 2013 – Stephen Hamilton, Richard Robinson, and Peter Salton, by Village Clerk Mills B. Public Hearing on Proposed Local Law D, Tax Cap Override: VILLAGE OF CAYUGA HEIGHTS PROPOSED LOCAL LAW D OF THE YEAR 2013 A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW §3-C Be it enacted by the Board of Trustees of the Village of Cayuga Heights as follows: Section 1 Legislative Intent: It is the intent of this local law to allow the Village of Cayuga Heights to adopt a budget for the fiscal year commencing in 2013 that requires a real property tax levy in excess of the tax levy limit as defined by General Municipal Law §3-c. Section 2 Authority: This local law is adopted pursuant to subdivision 5 of General Municipal Law §3- c which expressly authorizes a local governing body to override the property tax cap for the coming fiscal year by the adoption of a local law approved by a vote of sixty percent (60%) of said governing body. Section 3 Tax Levy Limit Override: The Board of Trustees of the Village of Cayuga Heights, County of Tompkins, is hereby authorized to adopt a budget for the fiscal year commencing in 2013 that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law §3-c. Section 4 Severability: If a court determines that any clause, sentence, paragraph, subdivision or part of this local law or the application thereof to any person firm or corporation or circumstance is invalid or unconstitutional the court order or judgment shall not affect impair or invalidate the remainder of this local law but shall be confined in its operation to the clause, sentence, paragraph, subdivision or part of this Local Law or in its application to the person individual firm or corporation or circumstance directly involved in the controversy in which such judgment or order shall be rendered. Section 5 Effective Date: This Local Law shall take effect immediately upon filing with the Secretary of State. Appoint Trustee Elizabeth Karns as member of the Board of Directors for the Greater Tompkins County Municipal Health Insurance Consortium, with Mayor Kate Supron as alternate Appoint Clerk Mary Mills as member of the Greater Tompkins County Municipal Health Insurance Consortium Joint Committee. F. Consider the following resolutions: a. That Tompkins Trust Company, Ithaca, NY be designated the official depository for Village funds for the 2013 Fiscal Year, with a maximum deposit of $4,000,000. b. That the Clerk be authorized to notify Tompkins Trust Company of the following names to be honored on checks for the 2013-14 Fiscal Year with two signatures required for each check . 1. Kathryn Supron, Mayor or Elizabeth Karns, Acting Mayor 2. Joan M. Mangione, Treasurer or Richard Robinson, Acting Treasurer 3. Mary E Mills, Clerk c. That the Ithaca Journal be designated the official newspaper of record for Official Year beginning April 1, 2013. d. Set the date and time for regular meetings of the Board of Trustees to the 2 nd Monday of month: May 13th , June 10th , July 8th , Aug 12th , Sept 9th , Oct 15 th (Tuesday – day after Columbus Day will be held at the CHFD), Nov 12th (Tuesday – day after Veterans Day will be held at the CHFD), Dec 9th , Jan 13th , Feb 10th , Mar 10th , Apr 1st – Organizational meeting (Tues – would be held at the CHFD) e. Set the time and date for next regular meeting Apr 15, 2013 @ Marcham Hall, 7:00pm. f. Set the date and time for regular meetings of the Planning Board to the 4 th Monday of the month: April 22nd , May 28th (Tuesday – day after Memorial Day will be held at the CHFD), June 24 th , July 22 nd , Aug 26 th , Sept 23 rd , Oct 28 th , Nov 25 th , Dec 23 rd , Jan 27 th , Feb 24 th , Mar 24 th g. Set the date and time for regular meetings of the Zoning Board of Appeals is on an as needed basis (prior years has been the 1 st Monday of the month).
