Absent: Trustee Andolina, Attorney Marcus, Clerk Mills
Mayor Supron called the meeting to order at 7:00 PM
Planning Board acting Chair Gillespie, consultant George Frantz along with members of the
Planning Board gave a Power Point Presentation providing an update on the Comprehensive Plan
(including Chair Martin Harms by SKYPE). The Comprehensive Plan has been a work in
progress for two years and a draft has been completed.
Mayor Supron read the Privilege of the Floor (PoF) guidelines
Mayor Supron opened the PoF at 7:45 PM
L. Ungberg- Spoke about the reoccurring flooding issues in her yard. (See written stmt –
Appendix A).
R. Bors - Would like the board to keep in mind a petition which was signed by several residents
who wish the current ordinance regarding fences to stay in place.
S. Grubb - Provided a statement that the deer pose a safety threat. (See written stmt - Appendix
A).
D. Fernandez - Favors a lenient fencing ordinance which allows protection from deer eating
plants. (See written stmt - Appendix A).
A. Baker - indicated she was upset as a trustee interrupted her during PoF during the last Board
meeting and spoke in support of deer fencing.
J. Stein - Stated there are no fencing restrictions in the City of Ithaca with a few exceptions.
J. LaVeck – indicated he was upset as a trustee interrupted a speaker during PoF at the last board
meeting.
A. Serling - Spoke in support of new a fence ordinance.
C. Temple – Spoke in favor of a fencing ordinance. Tax payers deserve the right to have
fencing.

Report of Fire Superintendent Tamborelle
Submitted report
Informed the board many members of the Fire Department have helped out in areas
devastated by the recent weather disasters.
Fire Dept. is hosting CHES auction.
Open House on October 8th
Report of Asst. Superintendent DPW Frisbie –

DPW crews were on call at all hours during recent storm to handle any issues caused by
heavy rainfall
Report of the Mayor –
Proposed Local Law “I” version 3 and version 4 will not be discussed so Board members
will have time to review. Proposed laws will be posted to the website for the public to
view.
Williamson Law Book Accounting & Budgeting software- Williamson provided a
demonstration to the Mayor, Clerk’s office, and treasurer on Friday. Treasurer
Greenberg discussed waiting on starting new software until after the year has been closed
in the current software. Board discussed the many benefits of switching to the
Williamson software.

Resolution #6945 to approve the purchase of the Williamson Law Book Accounting &
Budgeting software at the quoted price of $3,850 along with the annual maintenance
agreement of $875 with two users with the recommendation of the Mayor and Treasurer.

Municipal Resolution to recognize UAW Union-
Proposed Resolution #6946 to Recognize United Auto Workers (UAW) Local 2300 as
Exclusive Representative for the Non-Management Technical, Office and Clerical Staff
of the Southern Cayuga Lake Intermunicipal Water Commission
WHEREAS, Southern Cayuga Lake Intermunicipal Water Commission received a letter
requesting the Commission recognize the UAW Local 2300 as the exclusive representative of
the non-management technical, office and clerical staff of the Commission for the purposes
of collective bargaining on August 2, 2011, and
WHEREAS, the Commission has determined that it is in the best interests of the
Commission, and the goodwill of its employees, to recognize the UAW Local 2300 instead
of rejecting the request, for the titles of Account Clerk Typist and Technical Services
Coordinator, excluding any seasonal or temporary office or clerical staff; and
WHEREAS, the Commission on August 4, 2011 unanimously approved the recognition of
the UAW Local 2300 as the exclusive representative for collective bargaining purposes of all
Account Clerk Typist(s) and Technical Services Coordinator, excluding all seasonal or
temporary employees;
THEREFORE BE IT
RESOLVED, that the Board of Trustees of the Village of Cayuga Heights does hereby
approve the Southern Cayuga Lake Intermunicipal Water Commission’s recognition of UAW
Local 2300 as the exclusive representative for collective bargaining purposes of all Account
Clerk Typist(s) and Technical Services Coordinator, excluding all seasonal or temporary
employees; and be it further
RESOLVED, that in accordance with the requirements of Section 201.6 of the New York
Civil Service Rules and Regulations, the Village Clerk of the Village of Cayuga Heights is
hereby authorized and directed to publish a written notice of this recognition of UAW Local
2300 in the Ithaca Journal published in the City of Ithaca, Ithaca, New York, for not less than
one (1) day, and to post a copy of same on the Clerk’s signboard for not less than five (5)
working days.

Overtime hours are more than usual due to a full time police officer being out on account
of illness

Renewal Hess Contract for Natural Gas supply- Contract price may be locked in now for
the February 1, 2012-January 31, 2013 term. Currently offering $5.58/DTH variable rate
or $6.13/DTH fixed rate.

ZBA approved variance request to Community Corners Center to increase their number
of signs and the amount of square footage. New proposed signs will provide a business
directory making it easier for visitors at the Center to find businesses.
Fine tuning performance of phosphorus treatment at the WWTP. There has been
improvement, but numbers vary. DEC allowing another year to work with vendor to
achieve stability. The Village is still in compliance with the current DEC regulations.
Responded to L. Ungberg comment about a yard that was over grown with vegetation
and was alleged to be blocking a stream flow of water - the property owner had been
cited for not maintaining the stream area on their property. When called to court, the
property owners argues saying they were growing wildflowers and it would be against
their rights to be forced to mow them. Village Council advised to not pursue the matter.

Submitted report
Finger Lakes Technologies Group, Inc service contract proposal
Deputy Clerk Korbel read to the Board comments supporting the company from
current customers by Clerk Mills and explained the cost savings of switching to
Finger Lakes. The Board decided they would like more information before
making a decision.

Report of Attorney Gutenberger -
Attorney Gutenberger had nothing to report
Trustee Szekely asked about the status on the TCAT easement. No change in status.
Mayor Supron will follow up with TCAT directly.
Trustee Privilege of the Floor –
Trustee Szekely would like the board to receive copies of the full Comprehensive Plan
Trustee Szekely stated the damage caused by deer is worse than ever. Szekely asked
Attorney Gutenberger whether the Village had any recourse against the judge who has
failed to give his ruling after 60 days. There is no re-course to Attorney Gutenberger’s
knowledge; however she will look into it.
