HomeMy WebLinkAboutLL 04 of 1996 Rezone Manos Lands on E KingLOCAL LAW NO. 4 FOR THE YEAR 1996 A LOCAL LAW AMENDING THE TOWN OF ITHACA ZONING ORDINANCE REZONING LANDS ON EAST KING ROAD OWNED BY BILL J. MANOS (TAX PARCEL 44-1-4.312) FROM MULTIPLE RESIDENCE TO RESIDENCE DISTRICT R15. Be it enacted by the Town Board of the Town of Ithaca as follows: Section 1. Recitals. A. The Town of Ithaca, by Town of Ithaca Local Law No. 3 of the year 1983 rezoned certain lands along East King Road, then known as Town of Ithaca tax parcel 44-1-4.3 to a Multiple Residence District in response to an application by Bill J. Manos. B. In the ensuing fifteen years, the Multiple Residence development planned for such property never occurred. C. In 1992, the Town of Ithaca by Town of Ithaca Local Law No. 22 of the year 1992 rezoned a portion of the Multiple Residence District to Residence District R30 and Residence District R15, which portions so rezoned became the site of the Hospicare Hospice facility and an adjoining residential subdivision. D. The remaining portion of the Multiple Residence District lying to the west of the Hospicare facility was conveyed to Cornell University and has been added to lands included in the South Hill swamp and as a result is being rezoned from Multiple Residence District to Residence District R30. E. After the Hospicare rezoning and the Cornell University property rezoning, there is left only a small 2.58 acre parcel on the easterly end of the Multiple Residence District zoned Multiple Residence. F. By reason of the rezonings and change of use that has occurred referred to above, the original plan pursuant to which the property was originally zoned Multiple Residence may no longer be implemented and has, in effect, been abandoned. G. The recently adopted Comprehensive Plan for the Town of Ithaca suggests that the area be identified as "Suburban Residential". H. The zoning areas around tax parcel 44-1 -4.312 are Residence District R15 on the west, north, and east. The area across the street from said parcel is zoned in part Residence District R15 to the southwest and Residence District R30 on the southeast. I. In view of the abandonment of the original plan which gave rise to the original rezoning to Multiple Residence District, and the subsequent development of a portion of the Multiple Residence District zone as the Hospicare facility and a single or two family residential subdivision, the Town believes in furtherance of the general welfare of the community and the Comprehensive Plan that it is appropriate to rezone tax parcel 44-1-4.312 from Multiple Residence District to Residence District R15. Section 2. Rezoning of Land to Residence District R15. The Town of Ithaca Zoning Ordinance as readopted, amended, and revised effective February 26, 1968, and as subsequently further amended be further amended by rezoning the premises known generally as Town of Ithaca tax parcel No. 44-1-4.312, consisting of approximately 2.58 acres on East King Road from Multiple Residence District to Residence District R15. Section 3. Amendment of Zoning Mao. The Zoning Map of the Town of Ithaca as adopted by the Town Board and as modified and approved by the Town Board on various occasions through September 20, 1993, as the same may have been subsequently amended to date, is hereby further amended by rezoning those lands described in Section 2 above from Multiple Residence District to Residence District R15. Section 4. Partial Invalidity. In the event that any portion of this law is declared invalid by a court of competent jurisdiction, the validity of the remaining portions shall not be affected by such declaration of invalidity. Section 5. Effective Date. This law shall take effect 10 days after its publication as required pursuant to Section 264 of Town Law.
