HomeMy WebLinkAboutLL 03 of 1997 Water Billing & ServiceTOWN OF ITHACA LOCAL LAWNO._2 OFTHE YEAR 1997 A LOCAL Law to amend local law no.2,1976,BY CLARIFYING DUE DATES OF BELLS,USE OF CURRENT UNPAID BILLING INFORMATION FOR LIEN PURPOSES AND TO EXTEND TIME BEFORE SUPERVISOR MAY TERMINATE SERVICE Be it enacted by the Town Board of the Town of Ithaca as follows: Section 1. Local Law No. 2 for the year 1976, adopted August 23, 1976, and subsequently amended, is further amended as follows: A.Section 4 C. is deleted and a new Section 4. C. is inserted reading as follows: "C.If water rates or other charges payable under this law are not paid within 30 days from the date on which they are due, an additional charge or penalty of ten per cent (10%) shallbe added to the water rates or charges due. For this purpose, the date on which such rates are deemed due is the date on which the bill is issued or,if no bill isissuedthe fifteenthdayfollowingthe close of each calendar quarter during whichwater was consumed (i.e. the due date for water rates relating to water consumed in the first calendar quarter of the year 'shall be April 15). The Town Supervisor,or other person designated by the Supervisor, in the event such rates or charges are not paid within 60 days from the date on which they are due, maycausea noticeto be delivered or mailed to the owner or to any other person designated by the owner,addressed to the address to which bills are to be sent, and to the occupant of the premises, addressed atthepremises,stating the amount dueand demanding paymentthereof withina periodof at least ten (10)days of the dateof the notice and statingthat if such payment is not made, the water service may be discontinued,without further notice, and, at the expirationof suchperiod the Town Supervisor, or any employee or officer of the Town or of any contracting municipality or the Commission,designated by the Supervisor or theTownBoard,mayenteron said premises and cause the water service tobe disconnected.In addition toanyother chargesdue to the Commission or Town,thereshallalso be due to the Towna chargeof$25.00for disconnecting and a charge of$25.00for re-connecting such water service." B. Section 4 D. is amended by adding at the end thereof the following: "For purposes of providing the information required to implement the provisions of Section 198 (d)of the Town Law, the Town Clerk shall, no later than November 1of each year provide the statements showing unpaid water charges as of the immediately preceding October 15,which statements shall contain the ^information and be utilized as set forth in Section 198(d) of the Town Law. wateraie.n4,wp5 iMchUocallaw,July9, 1997 12:23pm f Failure to provide the statements by such date, or to include all unpaid water rates as of said October 15, shall not invalidateany amounts that are included on a subsequently supplied statement nor shall it invalidate the levy of any impaid water rates on any tax bill." Section 2. In the event that any portion of thislocal law is declaredinvalid by a final order of a court of competent jurisdiction,the validity of the remaining portions shall not be affected by such declaration of invalidity. Section3. This local law shall take effect fivedays after its adoptionor upon its filing with the Secretary of State of the State of New York.
