Cross, Zoning Officer RE: Cornell Child Care Center (CCCC), 150 Pleasant Grove Road REPORT: I have received a request to change the maximum occupant load of this building to allow an increase in enrollment of children. After researching the appropriate fire code formula for required area/exits, I have concluded that the existing building was constructed with adequate features to allow the increased occupancy. No new construction is needed except for the issuance of new “occupant load” signs for the individual rooms. Since the original construction of this building was approved by the Village Trustees (acting as PB on 5/21/07) through the Site Plan Review process, the project was approved for an enrollment (not including staff) of 158 children. The CCCC is now requesting approval to enroll upto 180 children (see attached narrative). . This seems like it could be considered a minor change (14% increase), but after discussion with the Village Attorney, we determined that the Village Site Plan Review does not specifically provide for “administrative” or abbreviated PB review. Therefore, the proposed change in enrollment will require a change in the conditions of the original SPR approval. The CCCC will make a preliminary presentation at the 12/16/13 PB meeting. If there are no unresolved issues, then the PB will need to set a public hearing for the next meeting and make a SEQR classification (likely Type II). As the property is located within 500’ of the Town of Ithaca, I will forward the information to the Tompkins County Planning Department for consideration of NYS GML 239 review so that we have their comments in time for the public hearing.
