Whereas, on February 8, 2021, the Ithaca Town Board
held a public hearing and subsequently adopted as Public
Interest Order authorizing the Town of Ithaca King Road
East Water, Main Extension Water Irnprovement (tAe ;`Im-
provement-) and the establishment of the Town of Itha-
ca King
Road East Water Main Extension, Water Improve-
ment Area ("Water Improvement Area"), through TO Res-
olution 2021-019; and
Whereas, the notice of public hearing stated that the ini-
tially determined Maximum estimated cost to said Water
Improvement Area was $1,050,000 and the adopted Pub-
lic. Interest Order stated that the maximum amount pro-
posed to be ex nded by tine w e Ton of Ithaca for them l-
provement is V0050,000, and I I
Whereas, due to unforeseen road conditions, additional
asphalt restoration will be needed in various areas within
the projeLt, and the cost of asphalt has increased due to
the rise in oil prices; and
Whereas, no other changes are proposed to any aspect of
the Improvement or Water Improvement Area; and I
Whereas, TO Resolution, 2021-102 authorized the Director
of Engineering to approve change orders to the contract,
without further authorization of this Board, provided
that the maximum amount of_such.,chanqe orders does
not exceewd $39,000.00 (a p oxitriately 3.8 6% of_ the �OOV
awarded bid of $1,0 11 ,000 in aggregate and the total
pro ect cost, includingng the contract, engineering, leal
ancl other, expenses, does,not exceed the maximum au�,
thorized cost of the project of $1.050,000.00; and
Whereas, the Director of Engineering has approved
chan e orders totaling $38,500.00 for halt restoration,
whicg does not leave an amount thatawspal be adequate if
additional unforeseen issues are encountered; and

ducting a public hearing on such proposaVto Increase the

sons Interested in the subject thereof concerning the
same; and '
Whereas, copies of said, Order were duly publish-
ed and posted according to law, and said Town Board
did, at the time and place ,specffled in said order, duly
meet and consider such proposal and held a public hear-
ing In which it heard all persons interested In,the subject
thereof, who appeared at such tirne and place, concern-
Ing the same;'and
Whereas, the,,rown Board now desires to authorize the,
increase in the maximum amount to be expended on the
Improvement based on the evidence offered at such time
and place, now, therefore, be it
Resolved, by the Town Board that it be and hereby is de-
termined as follovvs:

quired by law and is'otherwise sufficient,
(2) It is in the public Interest to authorize the Increase in
the maximum proposed to be expended on the Improve-
ment as hereinafter described, and be it
Further Resolved, that the Town Board does hereby au-
thorize 'the increase in the maximum proposed to be ex-
pended by the Town of Ithaca for the Improvement, in-
cluding costs of rights of way, construction costs, legal
fees and other expenses,,frorn $1,050,000 to $1,112,100,
and Ise it
Further Resolved, that this Order is subject to a permis-
sive referendum in the manner provided in Town Law Ar-
ticle 7 and Town Law Section 209-cl; and be it,
Further'Resolved, it is hereby determined that the esti-
mated expense of the aforesaid Improvement does not
exceed one -tenth of one percent of the full valuation of
the taxable real property in the area of said Town outside
of villages and, therefore, in accordance with the provi-
sions o? subdivision 13(a) of Section 209-q of the Town
Law the permission of the State Comptroller, is not re-

2. Sheriffs Report — Sheriff Osborne
Sheriff Osborne went through a presentation on the Unarmed Pilot Program associated with the
Public Safety Reimagined initiative.
Mr. DePaolo asked about how they handle noise complaints and the recent changes to conceal
carry laws.
Sheriff Osborne responded that they initially respond as a community relations type of
interaction and ask them to turn it down if we hear it in person and we do use the Town's
ordinance to issue a ticket if warranted or numerous instances at one location.
As to the conceal carry changes, we are waiting on direction from the State. There are
requirements for training being provided by the Sheriff's office and that is something we cannot
provide currently and again, awaiting some type of guidance or plan from the State on how that
can happen.
Ms. Bleiwas commented that she agrees with his concerns regarding the training and said
"bravo" on the Pilot program and having a way to respond that keeps his people safe too.
Mr. Rosen also commended the Sheriff on the Program and asked if that response is going to be
enough for the person who may want something more official or in the instance of a car accident
where a police report is needed or a robbery.
Sheriff Osborne responded that that was discussed at length and using the robbery example, if an
incident occurred while someone was on vacation for example, a deputy would be required to
take pictures or fingerprints; something stolen from a porch would not require a deputy as there

is no imminent threat or possibility of capturing the culprit, but a report would be generated and
patrols would be notified of the complaint/incident and would increase patrols in the area.
For an accident with property damage, as in a car accident, that would require a deputy to
respond.
Mr. Howe thanked the Sheriff for updating the Town and being available to answer questions.

4. Public hearings regarding:
Mr. Howe opened the public hearings at 5:56 p.m. There was no one wishing to address the
Board on any of the public hearings.
There were no questions from the Board on any of the draft local laws that have been discussed
previously at both the Town Board and committee levels.

Chapter 270, Zoning, of the Town of Ithaca Code"
TB Resolution 2022 -112: Adopting Local Law 12 of 2022, Revising Site Plan
Requirements in Chapter 270, Zoning, of the Town of Ithaca Code
Whereas, at its meeting on June 1.3, 2022, the Town Board of the Town of Ithaca discussed a
proposed local law to revise the site plan requirements in the Town of Ithaca Town Code,
Chapter 270, Zoning, and adopted a resolution for a public hearing to be held by said Town on
July 11, 2022, at 5:30 p.m. to hear all interested parties on the proposed local law entitled "A
Local Law Revising Site Plan Requirements In Chapter 270, Zoning, Of The Town Of Ithaca
Code"; and
Whereas, notice of said public hearing was duly advertised in the Ithaca Journal; and
Whereas, said public hearing was duly held on said date and time and all parties in attendance
were permitted an opportunity to speak on behalf of or in opposition to said proposed local law,
or any part thereof, and
Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and
its implementing regulations at 6 NYCRR Part 61.7, it has been determined by the Town Board
that adoption of the proposed local law is a Type II action because it constitutes "routine or
continuing agency administration and management, not including new programs or major
reordering of priorities that may affect the environment," and thus this action is not subject to
review under SEQRA; and
Whereas, the Town Board finds it is in the best interest of the Town and its citizens to adopt the
local law; now, therefore, be it

amending Town of Ithaca Code Chapter 239, Taxation, rej!ardinj! exemptions for Senior
Citizens and Certain Disabled Persons with Limited Income
Whereas the Ithaca Town Board reviewed the proposed local law entitled "A Local Law
Amending Town of Ithaca Code Chapter 239, Taxation, regarding Exemptions for Senior
Citizens and Certain Disabled Persons with Limited Income" and held a duly scheduled and
publicized public hearing at its meeting on July 11, 2022, at which time all persons wishing to
address the Board on the proposed local law were heard, and
Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
adoption of the proposed local law is a Type II action because it constitutes "routine or continuing
agency administration and management, not including new programs or major reordering of
priorities that may affect the environment," and thus not subject to review under SEQRA; now,
therefore, be it
Resolved, that the Ithaca Town Board adopts Local Law 13 of 2022 entitled "A Local Law
amending Town of Ithaca Code Chapter 239, Taxation, regarding exemptions for Senior Citizens
and Certain Disabled Persons with Limited Income."

TB Resolution 2022 - 114: Adopting Local Law 14 of 2022 to Override the Tax Levy Limit
established in General Municipal Law §3-c
Whereas, municipalities of the State of New York are limited in the amount of real property taxes
that may be levied each year under the tax levy limit established in General Municipal Law §3-c,
and

Whereas, subdivision 5 of General Municipal Law §3-c expressly authorizes a municipality to
override the tax levy limit by the adoption of a local law approved by vote of at least sixty percent
(60%) of the governing body, and
Whereas, a public hearing on the proposed local law entitled "A local law to override the tax levy
limit established in General Municipal Law §3-C' ; was duly advertised and held by the Town
Board at its July 11, 2022 meeting, and
Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
adoption of the proposed local law is a Type 11 action because it constitutes "routine or continuing
agency administration and management, not including new programs or major reordering of
priorities that may affect the environment," and thus not subject to review under SEQRA; now,
therefore, be it
Resolved, that the Town Board adopts Local Law 14 of 2022 entitled "A local law to override the

5. Community Choice Aggregation — Update
Mr. Howe gave a brief update as a reminder that the process is moving forward and a full report
and an action item will be coming shortly. He encouraged members to watch or attend one of
the webinars on CCA that are available.
6. Consider award of 2022 Sewer Rehab Project
Mr. Thaete gave an overview of the bids and details of the project.
TB Resolution 2022 - 116: Authorization to Award Contract for the 2022 Sanitary Sewer
Rehabilitation Proiect
Whereas the 2022 Ithaca Town Budget included $300,000 for the rehabilitation of Sanitary Sewers
and Manholes; and
Whereas pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
approval, construction and implementation of the Sanitary Sewer Rehabilitation Project 2022
(Project) are a Type 11 Action because the Action constitutes "replacement, rehabilitation or
reconstruction of a structure or facility, in kind, on the same site," and thus the Project is not subject
to review under SEQRA; and

Whereas on. June 28, 2022, the Director of Engineering (Director) received bids for the Project;
and
Whereas the Director reviewed the bids and qualifications received and has determined the lowest
responsive bid in the amount of $216,636.90 was made by the lowest responsible bidder, Camden
Group, Inc.; 9008 State Route 13, Camden, NY 13316; and
Whereas the lowest responsive bid was under the estimate by $83,363.10 and an additional 10%
contingency is customary and recommended in the amount of $21,663.69 for a total of
$238,300.59; now therefore be it
Resolved, that the Town Board hereby authorizes the award of the contract for the Town of Ithaca
2022 Sanitary Sewer Rehabilitation Project to Camden Group, Inc.; and be it further
Resolved, that the Town Supervisor is authorized to execute such contract subject to approval of
the final contract documents by the Director and Attorney for the Town; and be it further
Resolved, that the Director is authorized to approve change orders to such contract upon receipt of
appropriate justification provided the maximum amount of such change orders shall not in the
aggregate exceed $21,663.69 without prior authorization of this Board, and provided further that
the total project cost, including contract, engineering, legal, inspection, and other expenses, does
not exceed the maximum authorized cost of $238,300.59 for the project.

7. Consider authorization to sign Ridgecrest Rd watermain easements
Mr. Thaete noted that obtaining easements for these types of projects is normal.
TB Resolution 2022 -117: Approval of and authorization to execute water easements
associated with the Ridgecrest Road Water Improvement Project
Whereas, pursuant to a resolution dated March 14, 2022, The Town of Ithaca Town Board has
determined it to be in the public interest to establish the Town of Ithaca Ridgecrest Road Water
Improvement Project, and
Whereas, the Town of Ithaca owns and maintains and plans to install municipal water
infrastructure, as part of the improvement project, on portions of property located along
Ridgecrest Road that serves or facilitates the provision of municipal water, and
Whereas, the proposed municipal water easements generally lie within the rights -of -way along
Ridgecrest Road, now therefore be it

Resolved, that the Town Board of the Town of Ithaca approves the proposed Permanent Water
Easements and Rights -of -Way and authorizes the Town Supervisor to execute these documents,
subject to the approval of the Attorney for the Town.

8. Consider authorization to apply for CFA grant for Babcock Ridge Trail and Site
enhancements
Mr. DePaolo asked about the choice of stone dust for the paths and why not simply maintain
some of the natural paths.
Ms. Ritter responded that we usually use stone dust and Mr. Thaete added that he would get with
Mr. Smith to discuss.
TB Resolution 2022 - 118: Authorization to Apply for Funding through the 2022
Environmental Protection Fund Grants Program for Parks, Preservation and Heritage for
design and construction of the Culver Road Preserve — Babcock Ridge Trail and Site
Enhancement Proiect
Whereas, the New York State Office of Parks, Recreation & Historic Preservation (OPRHP) has
announced the availability of funding under the 2022 Environmental Protection Fund Grants
Program for Parks, Preservation and Heritage, which includes categories for design and
construction under the Parks Program, and
Whereas, the maximum assistance allowed toward the cost of the project is $500,000, with a
25% Local match required, and
Whereas, the Town of Ithaca is seeking to develop designs and construct passive recreational
facilities (parking, trails, stormwater facilities, gazebo, picnic tables, benches, signage, etc.) on
the Babcock Ridge portion (Town of Ithaca Tax Parcel No.'s 31.-1-14.2 and 31.-1-14.4) of the
Culver Road Preserve, and
Whereas, the Town of Ithaca estimates the total cost of this project to be approximately
$281,700, based on cost estimates provided by two qualified design consultants and the Town of
Ithaca's Engineering, Public Works, and Planning Departments, and
Whereas, grant applications are due by July 29, 2022; now, therefore, be it
Resolved, that the Supervisor of the Town of Ithaca, or designated representative, is hereby
authorized and directed to file an application for design and construction costs for the Culver
Road Preserve — Babcock Ridge Trail and Site Enhancement project under the 2022
Environmental Protection Fund Grants Program for Parks, Preservation and Heritage in an
amount not to exceed $281,700.00 ($70,425.00 Town of Ithaca local share), and upon approval

of said request to enter into and execute a project agreement with OPR:HP for such financial
assistance to the Town of Ithaca.

9. Discuss contribution to the Emerald Necklace Gateway Access Project
Mr. Howe gave an overview of the project, noting that it would enhance the inlet valley and the
Gateway Trail access. Questions on other funding were asked and Mr. Howe noted that Finger
Lakes Land Trust will use their own funds or funding streams if the described contributions are
not met.
The Board was in favor of moving forward with an agreement.
10. Resolution of Appreciation — Rich Tenkate
Ms. Drake reminded members of the retirement party and to sign the resolution of appreciation
to be presented.
TB Resolution 2022 - 1.19: Recognition and Appreciation of Richard TenKate's Dedicated
Years of Service
Whereas Richard TenKate started his career at the town on July 6, 1993, as a Highway Laborer
and was promoted to a Motor Equipment Operator on February 12, 1996, and then a Working
Supervisor on April 12, 1999; and
Whereas Rich was promoted to his current position of Deputy Highway Superintendent on March
26, 2018, and has provided his expertise and talents faithfully to the town since; and
Whereas Rich was resolute about ensuring that the roadways were properly maintained and safe,
especially during winter months, given that he had spent many years of his career maintaining the
South Hill plow route; and
Whereas Rich used his ingenuity and skills many times over the years on such projects as the Stone
Quarry box culvert, Snyder Hill stormwater system, building the South Hill trail and a vast number
of road paving and storm drainage projects like Deer Run; and
Whereas Rich shared his vast knowledge and skills with less experienced staff throughout his
career and helped several learn the process and procedures for fixing watermain breaks during late
nights and freezing cold weather; and
Whereas the Public Works has benefited from Rich's institutional knowledge of highway
operations, street names and locations, history on projects and his engagement in the placement
and installation of road signs; and

Whereas the Town of Ithaca has greatly benefited from Rich's devotion, knowledge, and his desire
to serve our community in order to make it a better place to live; and
Whereas Rich has decided to retire from the Town of Ithaca, effective July 23, 2022, after twenty-
nine (29) years of dedicated service; now, therefore, be it

Regarding: Local Law to Enable Community Choice Aggregation
The Town of Ithaca has considered the possibility of starting a Community Choice Aggregation (CCA)
program for several years. Most recently, a Town committee has been collaborating with the City of
Ithaca, CCA innovator Local Power, and Sustainable Tompkins to draft legislation that would enable a
local CCA program. The Planning Committee has reviewed and discussed the CCA Local Law more than
once, and at its June 16, 2022 meeting, the Committee moved the legislation on to the Town Board for
consideration, factoring in review by Susan Brock.
The CCA Law would enable an innovative program designed to be an efficient and affordable way to
engage the entire local population in achieving time -critical local and state goals for decarbonization and
equity. Once the program is developed by the City and Town of Ithaca, other municipalities in Tompkins
County and the region will be offered participation.
The proposed CCA program is the next-gen evolution of programs that are already providing proven
results to millions of customers in New York, California, Ohio, Illinois, and New Jersey. The CCA program
will meet or beat electric and gas supply rates for basic service but use a higher percentage of
renewable energy at inception. It will also partner with each municipality to offer their residents and
businesses the opportunity to access low -interest financing to invest in new distributed energy
resources such as solar arrays, microgrids, or building efficiency and electrification upgrades.
The Town will consider the local development and customer ownership options at a later date, while
participating in all other CCA initiatives at launch. Any municipality joining this CCA could follow a similar
two-step process of receiving grid power first, before deciding on the development of locally -sited
energy projects.
The New York State Public Service Commission (PSC) must approve an Implementation Plan before the
CCA can begin operations. The Implementation Plan will be prepared in the fall by a competitively
selected CCA Administrator and approved by the Town before it is submitted to the PSC for approval.
The Implementation Plan will provide additional details of the CCA program, such as plans for value-
added services, DER Voluntary Investment options, and a public outreach plan.
We look forward to discussion on this issue and hope to consider the local law for adoption at the August
Town Board meeting. Please let us know if you have any questions or comments.
