SPECIAL TOWN BOARD MEETING The Special Town Board Meeting of the Town Board of the Town of Cortlandville was held via Zoom video and telephone conference as permitted by the Executive Order of the State of New York, with Supervisor Williams presiding. Members present: Supervisor, Thomas A. Williams Councilman, Jay E. Cobb Councilman, Jeffrey D. Guido Councilman, Theodore V. Testa Town Clerk, Kristin E. Rocco-Petrella Absent: Councilman, Douglas E. Withey Others present were: Town Attorney, John DelVecchio; Supervisor’s Secretary, Patty O’Mara; Assistant to the Supervisor’s Secretary, Amanda Rainbow; and Highway Sup’t. Larry Drach. Supervisor Williams called the Regular Meeting, recessed from December 15, 2021. Except for Councilman Withey, all other Board members were in attendance. Town Clerk Rocco-Petrella mentioned that the 2022 Town/County tax bills would be mailed on December 30th. Supervisor Williams mentioned that the Town Clerk’s office was down a staff member and recognized the staff for their hard work to get the tax bills out on time. Town Clerk Rocco-Petrella agreed and thanked Supervisor Williams for the acknowledgement, which she would pass along. Attorney DelVecchio reported: Solar Committee: Attorney DelVecchio informed the Board that the Solar Committee conducted its last meeting earlier this month. The revisions to the ordinance were 98% done. Committee member, Mike Barylski was looking at the “visual impact analysis”. Attorney DelVecchio expected a final product to be provided to the Town Board in January 2022 and would work with Supervisor Williams to discuss how the Board should proceed once the draft is complete. Supervisor Williams reported: Supervisor Williams apprised the Board that the Town Hall will be closed on Thursday, December 30, 2021 at 12:00 pm. Revise Town Board Meeting Schedule and Holiday Schedule: Supervisor Williams reminded the Board they approved the Town Board Meeting Schedule and Holiday Schedule at the December 15, 2021 meeting. However, after further review an error was discovered on both schedules regarding the date of Election Day which would require both the Meeting Schedule and the Holiday Schedule to be amended. RESOLUTION #355 AMEND TOWN BOARD RESOLUTION #344 OF 2021 – “ESTABLISH SCHEDULE OF TOWN BOARD MEETINGS FOR THE YEAR 2022” Motion by Councilman Guido Seconded by Councilman Testa VOTES: AYE – Williams, Cobb, Guido, Testa NAY – 0 ABSENT – Withey ADOPTED DECEMBER 29, 2021 SPECIAL TOWN BOARD MEETING PAGE 3 BE IT RESOLVED, the Town Board does hereby amend Town Board Resolution #344 of 2021, “Establish Schedule of Town Board Meetings for the Year 2022”, to add a third meeting during the month of November, to be held on November 9, 2022 at 5:00 pm. RESOLUTION #356 AMEND TOWN BOARD RESOLUTION #345 OF 2021 – “APPROVE HOLIDAY SCHEDULE 2022” Motion by Councilman Cobb Seconded by Councilman Testa VOTES: AYE – Williams, Cobb, Guido, Testa NAY – 0 ABSENT – Withey ADOPTED BE IT RESOLVED, the Town Board does hereby amend Town Board Resolution #345 of 2021, “Approve Holiday Schedule 2022” to correct the date of Election Day from November 1, 2022 to Tuesday, November 8, 2022. RESOLUTION #357 REAPPOINT JOHN A. DELVECCHIO, ESQ. AS TOWN ATTORNEY Motion by Councilman Cobb Seconded by Councilman Testa VOTES: AYE – Williams, Cobb, Guido, Testa NAY – 0 ABSENT – Withey ADOPTED BE IT RESOLVED, the Town Board of the Town of Cortlandville does hereby reappoint John A. DelVecchio, Esq. as Town Attorney for a two-year term (per NY Town Law § 24) commencing January 1, 2022 until December 31, 2023. Town Bookkeeper: Supervisor Williams congratulated Town Bookkeeper, Megan Johnson for the successful completion of the Calculus course that she was enrolled in this past semester. He complimented her for working hard on her studies and noted that the remainder of the courses she will be taking will be for accounting. Purchase of Equipment - Trackhoe Excavator: Supervisor Williams and Highway Sup’t. Drach explained that the Highway Department was in desperate need for a Trackhoe Excavator, the cost of which would be shared between the Town Highway Department and Water/Sewer Department. Both departments have funding for the equipment in their 2022 budget lines. A new machine would cost approximately $110,000; however, one was not available. Highway Sup’t. Drach explained that the Town would receive a significant discount to purchase a used Trackhoe Excavator with approximately 107 hours on it. The equipment would be purchased from the Sourcewell Contract. RESOLUTION #358 AUTHORIZE HIGHWAY SUPERINTENDENT AND WATER/SEWER SUPERINTENDENT TO PURCHASE A TRACKHOE EXCAVATOR FOR THE TOWN HIGHWAY DEPARTMENT AND TOWN WATER/SEWER DEPARTMENT Motion by Councilman Testa Seconded by Councilman Cobb VOTES: AYE – Williams, Cobb, Guido, Testa NAY – 0 ABSENT – Withey ADOPTED DECEMBER 29, 2021 SPECIAL TOWN BOARD MEETING PAGE 4 BE IT RESOLVED, the Town Board does hereby authorize and direct the Town Highway Superintendent and Water/Sewer Superintendent to purchase a Trackhoe Excavator, Volvo ECR88D Mini SN 217168 from Alta Equipment Company (NYS OGS Contract PC69437, Contract 032119-VCE), for an amount not to exceed $103,000, the cost of which shall be split between the Town Highway Department and Water/Sewer Department’s 2022 budget for equipment. No further comments or discussion were heard. Councilman Guido made a motion, seconded by Councilman Testa to recess the Regular Meeting to an Executive Session to discuss personnel, contracts, and threatened litigation. All voting aye, the motion was carried. The meeting was recessed at 5:25 p.m. Councilman Cobb made a motion, seconded by Councilman Guido, to adjourn the Executive Session and reconvene the Regular Meeting. All voting aye the motion was carried. The Executive Session was adjourned at 5:43 p.m. Supervisor Williams explained that no further action was necessary.
