HomeMy WebLinkAboutLL 08 of 2016 Chickens & Domestic Animals TOWN OF ITHACA LOCAL LAW NO. 8 OF THE YEAR 2016 A LOCAL LAW AMENDING THE TOWN OF ITHACA CODE, CHAPTER 270 ENTITLED "ZONING", REGARDING THE KEEPING OF DOMESTIC ANIMALS IN THE CONSERVATION ZONE AND THE KEEPING OF CHICKENS IN MEDIUM DENSITY RESIDENTIAL ZONES Be it enacted by the Town Board of the Town of Ithaca as follows: Section 1. Chapter 270 (Zoning), Article V (Conservation Zones) of the Town of Ithaca Code, §270-14 titled "Permitted accessory buildings or uses" is amended by adding a new subsection J reading as follows: "J. The keeping of domestic animals in accessory buildings, provided that no such building shall be nearer than 30 feet to any lot line of any adjoining owner, and further provided that there shall be no raising of fur-bearing animals, or kennels for more than three dogs over six months old." Section 2. Chapter 270 (Zoning), Article IX (Medium Density Residential Zones) of the Town of Ithaca Code, §270-68 titled "Permitted accessory buildings and uses" is amended by adding a new subsection K reading as follows: "K. The keeping of chickens, provided that: (1) No more than six hens shall be allowed on each lot; (2) No roosters shall be allowed; (3) Coops shall be located in the rear yard and be located no less than 20 feet from any property line; (4) Coops and enclosures must be kept in a neat and sanitary manner and must be cleaned on a regular basis so as to prevent offensive odors; (5) Chickens must be kept in a humane condition; (6) Chicken feed must be stored in rodent-proof containers; and (7) Chickens shall be confined at all times to the property on which they are kept." Section 3. In the event that any portion of this law is declared invalid by a court of competent jurisdiction, the validity of the remaining portions shall not be affected by such declaration of invalidity.
