The property is described as 3893 Route 11 (Tax ID 87.00-04-10.000) within the Town of Cortlandville. It is zoned I-2 (General Industrial), is within the Aquifer Protection District, and is within an Area of Special Flood Hazard in accordance with the Code of the Town of Cortlandville, hereafter the Code. The conditional permit, aquifer protection special permit, and floodplain development permit review is being referred to the Cortland County Planning Board because the property is located within 500 ft. of NYS Route 11. ______________________________________________________________________________________ ANALYSIS - The applicant is requesting a site plan review, conditional permit, aquifer protection special permit, & floodplain development permit so they may construct a propane & bio-propane storage and wholesale distribution site with rail siding. Bulk storage and freight / trucking terminals are permitted in I-2 (General Industrial) districts subject to site plan review and conditional permit. It should be noted that bulk storage of fuel, explosives, and chemicals is not permitted in I-2 (General Industrial) districts. The Code does not define the term “fuel”; however, it does use the term “fuel” in other definitions: “gasoline station” and “filling station”. Since both of these definitions address fuels that are liquid, the term “fuel” has been determined to connote liquid fuel. Therefore, the proposed use for the bulk storage of LP gas is permitted and the applicant has applied for a site plan review and conditional permit. As this development exceeds $150,000 in development cost, the applicant has also applied for an Aquifer Protection Special Permit. As the applicant is developing in an area of special flood hazard, the applicant has also applied for a floodplain development permit. This is the third application for this parcel that has been referred to the County Planning Board.
