HomeMy WebLinkAboutTB Minutes 2022-06-07 SpecialMEETING OF THE ITHACA TOWN BOARD Tuesday, May 7, 2022 at Noon Minutes Present: Rod Howe, Rich DePaolo, Rob Rosen, Bill Goodman and Paulette Rosa, Town Clerk Others — Dan Mitchell, Ithaca Beer. Mr. Howe opened the meeting at 12 noon and noted that this is a special meeting with the single agenda item of discussing and acting on a modification of an existing noise permit for Ithaca Beer to correct a date of an event. Notice was given to the media as required by law, and an email sent to neighbors for whom we have addresses. 1. Consideration of an amendment to an existing noise permit for Ithaca Beer from June 24th to June I I th Mr. DePaolo stated that he understood what was being asked, but he was glad that Mr. Mitchell was present because one of the accommodations for these permits is that the residents know what is happening when so they can plan accordingly. He said that it would be good for Mr. Mitchell to double check calendars and permit applications to ensure this doesn't happen in the future. Mr. Mitchell responded that this was his misunderstanding on what Mr. Wilbur had put in the application. He said he would have asked for one per month and didn't understand that there was a particular date for each month. Mr. Mitchell said he tries to secure these permits before going out and trying to book bands. For example, the Wednesday night music; I can go out and look for bands knowing I have those days, and it is easier given they are local bands. He said he thought this was similar, as it is harder to book larger bands and in the case of the 18th, he was not informed that there would be music in their standard event package when they booked the date. Mr. Mitchell said he would look at the application and look to book for those dates or just skip them. The Beer and Bikes on June 1 lth is from 5-8p.m. Mr. DePaolo responded that it is important to have a date so the neighbors know when it is happening. We are looking at putting some flexibility in the process, but that is just starting. Mr. Mitchell said he understands this is all on him and he will start getting solid dates for the larger events much earlier than he has. TB Special 2022-06-07 (Filed 6/9) Mr. Rosen stated that this is a unique situation given the typographical error and we are addressing that without setting a precedent. Mr. Goodman said he was glad Mr. Mitchell was here, and he is concerned about the incorrect information on the original application, and he would encourage Mr. Mitchell to check the application(s) in the future. He added that Town Staff and the Sheriff had to deal with the complaints associated with the May event and he would not be so in favor of doing this in the future. Mr. Mitchell responded that it is absolutely his fault and he understands that this is not something he wants to deal with or you want to deal with. Mr. Howe added that Ms. Rosa did send out an email to the known neighbors that this meeting was happening, and she will add further information to the neighborhood notice for the June 13" public hearing. He asked if Mr. Mitchell had a way to notify the neighbors himself. Mr. Mitchell said they had been communicating pretty well with the neighborhood, then the canned music came in to play and a neighbor went to the State and the Liquor Board and he was brought back into the loop. He said he will definitely reach out again and try to reopen the communication channels with the neighbors. TB Resolution 2022-097: Amending the Noise Permit issued on May 9, 2022 to correct an incorrect date Resolved that this Board waives the need for an application and public hearing due to extenuating circumstances, that being an inaccuracy in the application for the Reggae Fest on June 24h where the correct date was June 1 Vh, and be it further Resolved that this Board amends the existing Noise Permit for Special Events granted to Ithaca Beer on May 9'h to rescind the event on June 24'h and grant the event on June I I 1h , and be it further Resolved that Dan Mitchell shall attempt to reengage communication channels with the neighborhood and the Town will send notification of the change and the scheduled public hearing for an additional event on June 18 1h to the neighborhood as is standard. -ubmitted by Paulette Rosa, Town Clerk
