1. Call to Order and Pledge of Allegiance—Mr. Howe opened the meeting at 5:30 p.m. and
lead the pledge.

Mr. Howe opened the public hearing. There was no one wishing to address the board and the
hearing was closed.
Mr. Moseley summarized, saying there was some ambiguity regarding what constituted an
attached unit and this fixes that.
TB Resolution 2022 -046: SEOR: Proposed Local Law Adding and Revising Accessory
Dwelling Unit Definitions in Chapter 270, Zoning, of the Town of Ithaca Code
Whereas, this action is the enactment of a local law adding and revising accessory dwelling unit
definitions in Chapter 270, Zoning, of the Town of Ithaca Code; and
Whereas, this is a Type I Action for which the Town of Ithaca Town Board is acting as Lead
Agency in an environmental review with respect to the enactment of this local law; and
Whereas,the Town Board,at its regular meeting held on April 11,2022 has reviewed and accepted
as adequate the Full Environmental Assessment Form (EAF), Parts 1, 2 and 3, for this action,
prepared by the Town Planning staff, now, therefore, be it
Resolved, that the Town of Ithaca Town Board hereby makes a negative determination of
environmental significance in accordance with Article 8 of the Environmental Conservation Law,
6 NYCRR Part 617 New York State Environmental Quality Review, and Chapter 148
Environmental Quality Review of the Town of Ithaca Code for the above-referenced action as
proposed,based on the information in the EAF Part 1 and for the reasons set forth in the EAF Parts

TB Resolution 2022 -047: Adoption of a Local Law Adding and Revising Accessory Dwelling
Unit Definitions in Chapter 270,Zoning, of the Town of Ithaca Code
Whereas, in 2017 the Ithaca Town Code was amended to allow detached accessory dwelling units
(standalone structures) in certain residential zones, introducing a new option for accessory
dwelling units (ADUs) that had previously only been allowed as attached to a principal structure
or constructed as part of another accessory structure (i.e. garage or barn), and
Whereas, after several years of implementing the revised ADU provisions, the Town Planning
Committee became aware of issues arising from the lack of specificity in the definitions of the two
types of ADUs, and at meetings on June 18, 2020, and July 16, 2020 discussed and recommended
adding and revising the ADU definitions, and then further refined the language and referred it to
the Town Board on December 16, 2021, and
Whereas, at its meeting on March 14, 2022, the Town Board of the Town of Ithaca discussed the
proposed local law and scheduled a public hearing for April 11, 2022, at 5:30 p.m. to hear all
interested parties on the proposed local law entitled "A Local Law Adding and Revising Accessory
Dwelling Unit Definitions in Chapter 270, Zoning, of the Town of Ithaca Code", and
Whereas, notice of said public hearing was duly advertised and the public hearing held on said
date and time and all parties were permitted an opportunity to speak on behalf of or in opposition
to said proposed local law, and
Whereas, pursuant to the New York State Environmental Quality Review Act("SEQRA") and its
implementing regulations at 6 NYCRR Part 617, adoption of said local law is a Type I Action for
which the Ithaca Town Board, acting as lead agency in an environmental review with respect to
adoption of this local law,has, on April 11,2022,made a negative determination of environmental
significance after having reviewed and accepted as adequate the Full Environmental Assessment
Form Parts 1, 2 and 3, and
Whereas, the Town Board finds that the proposed local law will further the health and welfare of
the community, now, therefore, be it
Resolved, that the Town Board of the Town of Ithaca hereby adopts Local Law 5 of 2022 entitled
"A Local Law Adding and Revising Accessory Dwelling Unit Definitions in Chapter 270, Zoning,
of the Town of Ithaca Code.";

TB Resolution 2022 -049: Adoption of a Local Law Adding Swimming Pool Location
Requirements in Chapter 270, Zoning, of the Town of Ithaca Code
Whereas, swimming pools are currently allowed as a permitted accessory use in association with
one- and two-family dwellings in the town's Agricultural, Low Density Residential, Medium
Density Residential, High Density Residential, and Lakefront Residential Zones, but include no
provisions specifying where they may be located in a yard, and
Whereas,the Town Planning Committee,at meetings on August 20,2020 and September 17,2020,
upon learning of a recent swimming pool installation in the front yard of a single-family dwelling
in a residential neighborhood, discussed and recommended provisions that would prohibit the
placement of private swimming pools in the front yards of one- and two-family dwellings and
specify additional yard setbacks requirements, and
Whereas, at its meeting on March 14, 2022, the Town Board of the Town of Ithaca discussed the
proposed local law and scheduled a public hearing for April 11, 2022, at 5:30 p.m. to hear all

interested parties on the proposed local law entitled "A Local Law Adding Swimming
Pool Location Requirements in Chapter 270, Zoning, of the Town of Ithaca Code", and

Mr. Howe opened the public hearing.
Mr. Brittain spoke, saying he appreciated the Board's attention to this matter and was in favor of
the local law.
There was no one else wishing to address the board and the hearing was closed.
Mr. Howe noted that this has gone through the Public Works Committee numerous times and he
thanked Mr. Slater for his work on this.
There were no questions from the Board.
TB Resolution 2022 -050: Adoption of a local law amending Chapter 250 of the Town of
Ithaca Code, titled "Vehicles and Traffic," by revising Penalties and Exclusions in the
Vehicle Weight Limits Article
Whereas the Town's Highway Superintendent has received numerous comments and complaints
about vehicle traffic issues in the hamlet of Forest Home, and

Whereas the Town's Public Works Committee and Town Board have discussed the issue(s) and
determined the best course of action is to revise the Town of Ithaca Code Chapter 250, "Vehicles
& Traffic"to address a variety of issues, and
Whereas, the Town Board finds that the proposed local law will further the health and welfare of
the community, and
Whereas, pursuant to New York State Environmental Quality Review Act (SEQRA) and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
adoption of said local law is a Type II action because it constitutes "routine or continuing agency
administration and management, not including new programs or major reordering of priorities that
may affect the environment; and further constitutes "adoption of regulations, policies, procedures
and local legislative decisions in connection with any action on the Type 11 list, and thus, adoption
of this local law is not subject to review under SEQRA, now therefore be it
Resolved, that the Town Board adopts Local Law 7 of 2022, entitled "A LOCAL LAW
AMENDING CHAPTER 250 OF THE TOWN OF ITHACA CODE, TITLED "VEHICLES
AND TRAFFIC," BY REVISING PENALTIES AND EXCLUSIONS IN THE VEHICLE
WEIGHT LIMITS ARTICLE."

d) Amending Chapter 144,Energy Code Supplement—Pulled
Mr. Howe noted that the public hearing has to be rescheduled due to a publication deadline and
will be on the next agenda.
Mr. Goodman explained that this is to get the Energy Code Supplement (ECS) in alignment with
the NYS Energy Code as they related to each other as the State continues its review of our ECS.
4. Consider authorization for the Supervisor to sign the North Campus Residential
Expansion (NCRE)Water Agreement
Mr. Howe noted that this has been in the works for quite a while and discussed at various levels
many times.
There were no questions from the Board.
TB Resolution 2022 - 051: Authorization for Supervisor to Sign an Agreement with Cornell
University Regarding Water Supply through the Town of Ithaca Pleasant Grove Road
Interconnect.
Whereas, Cornell is constructing a real estate development project on its campus, known as the
North Campus Residential Expansion ("NCRE"), for five new undergraduate student residence

halls and related facilities on tax parcels 30.-1-1.2 (City of Ithaca) and 67.-1-1.1 (Town), and
Whereas, there is an interconnect between Cornell's potable water system and a Town of Ithaca
connection off the Pleasant Grove Road water transmission main owned and operated by the
Southern Cayuga Lake Intermunicipal Water Commission ("SCLIWC") located near the
intersection of Pleasant Grove Road and Hasbrouck Circle (the "Interconnect"), and
Whereas, the Town Planning Board's June 18, 2019 PB Resolution 2019-018 granting final site
plan approval for NCRE requires, prior to the issuance of building permits for structures located
within the Town, completion, at Cornell's expense, of the Pleasant Grove Water Interconnect
upgrades to the satisfaction of the Town of Ithaca Public Works Department, Bolton Point, and
the Tompkins County Health Department (installation of a master meter and Reduced Pressure
Zone (RPZ) device)", and further requires, prior to the issuance of certificates of occupancy for
NCRE buildings located in the Town, execution of the Pleasant Grove Water Interconnect
agreement between the Town and Cornell, and
Whereas, Cornell completed the installation of two master meters and an RPZ backflow device in
June 2019, and the Town and Tompkins County Health Department have inspected and approved
the installation, and
Whereas, this Agreement is intended to satisfy these Planning Board conditions, and this
Agreement further details the parties' respective rights and responsibilities regarding water supply
and infrastructure, and
Whereas, the City of Ithaca Planning and Development Board, acting a lead agency in a
coordinated environmental review, issued a negative determination of environmental significance
at its meeting on December 20, 2018, in accordance with Article 8 of the Environmental
Conservation Law(also known as the New York State Environmental Quality Review Act)for the
NCRE project, which included this Agreement, now, therefore,be it
Resolved, that the Ithaca Town Board authorizes the Town Supervisor to sign the Water Supply
Connection Agreement with Cornell University, subject to approval of the Attorney for the Town.

5. Discuss the draft Utility Refund Policy and consider setting a public bearing for the
associated local law
Mr. Howe explained that there has been an informal process for handling refund requests for years
with the Supervisor, Finance Officer and Bolton Point gathering information and determining
whether or not to refund smaller requests. Most of the time they do not meet the criteria. After
getting some larger requests recently,this policy was drafted through the Public Works Committee
and will formalize the process,the criteria used in making a decision and establish monetary levels
for minor and more substantive requests.

TB Resolution 2022 -052: Setting public hearings regarding amendments to the Town of
Ithaca Code, 210, Sewer Rents, and Chapter 261 Water Rates
Resolved, that the Town Board will hold a public hearing at their meeting beginning at 5:30 p.m.
on Monday, May 9, 2022,regarding proposed local laws:
• Amending Provisions Related to Billing Errors and Refunds in Chapter 210, Sewer
Rents, of the Town of Ithaca Code
• Adding Provisions Related to Billing Errors and Refunds to Chapter 261, Water Rates,
of the Town of Ithaca Code"
All persons wishing to address the Town Board on the proposed local laws will be heard.

6. Consider approval of a speed limit request to the NYS DOT regarding Route 96/
Trumansburg Rd
Mr. Slater explained that we had previously submitted a request that was denied, and this is a
follow-up request that is revised to clearly delineate the length of the road we are requesting the
reduction on.
Ms. Ritter added that it is also a strategic request in that a reduction, or the act of asking for one,
will help with grant applications if we decide to go for a sidewalk in that area.
Mr. Slater added that the State has their own criteria they use and they may determine a certain
section could or should be reduced, or none at all, but there has been an active petition for this
and we are doing our part in supporting it.
TB Resolution 2022 - 053: Request for a Speed Limit Reduction on New York State Route
96, also known as Trumansburg Road,in the Town of Ithaca from the City of Ithaca Line to
Hayts Road in the Town of Ithaca
Whereas, in 2016 the Town of Ithaca received federal aid/grant funding through NYS DOT to
conduct a pedestrian corridor study for NYS Route 96/Trumansburg Road (from the City/Town
municipal line to Hayts Road) due to the high volume and speeds along this section of road, no
pedestrian facilities (large number of pedestrians use road shoulder), and multiple residential,
medical, and other businesses/attractions along the road, and
Whereas, in April 2020, the Town received the final report for the NYS Route 96/Trumansburg
Road Pedestrian Corridor Study Project, prepared by Barton& Loguidice, D.P.C., and

Whereas, the report determined that "Each intersection exhibits a higher accident rate than the
statewide average for similar facilities. Since it is anticipated that no sight distance issues are
present within the corridor, additional factors could be contributing to accidents in excess of the
statewide average.", and
Whereas, the report included a recommendation which stated"Accident data and public input
have indicated that a safety benefit would be realized from lowering the current 45mph speed
limit though the project area. Currently the speed is reduced to 30mph while entering the City of
Ithaca. Based on the analysis presented within this study, as well as from comments received via
public feedback, it is recommended that the Town request a Speed Limit Study from the
NYSDOT for this corridor." (5.2.5.2 Speed Limit Reduction), and
Whereas, the Ithaca Public Works Department and Planning Department is requesting a review
of the speed limits on Trumansburg Road based on the report prepared for the Town and the
number of pedestrians that cross and walk along the shoulder of NYS Route 96, and
Whereas, the request was discussed at the Public Works Committee at the March 15th, 2022,
meeting and recommended to the Town Board for action, now therefore be it
Resolved,that the Ithaca Town Board requests that Tompkins County forward to NYS
Department of Transportation Traffic Safety Division the Town's request to reduce the speed
limit on New York State Route 96, from the Town of Ithaca/ City of Ithaca municipal boundary
to Hayts Road, in its entirety, from 45 mph to 30 mph.

7. Report from Public Works Committee—American Rescue Plan Act (ARPA) Funds
Mr. Howe stated that this is an update and report regarding our plan to use the $1.65M on the
Ridgecrest Road Water Improvement and Forest Home Pump Station Capital Projects.
Discussions have been at both the Budget and Public Works Committees to prioritize projects
and these are the recommended projects and they will use up that amount and meet the
timeframe in which we need to spend it.
There were no questions from the Board.
8. Consider referral of an Open Development request to the Planning Board
Mr. Thaete explained that the owners came in for a building permit for this parcel which was
subdivided in the 1950's, resulting in a land locked parcel. To meet 280a requirements, the only
option is to establish an Open Development area and the process is to ask the Planning Board for

any comments they may have and then it comes back to the Town Board to establish.
Ms. Brock added that the open development only addresses the 280a issue and the Board could
set any conditions they deemed necessary on the approval.
The Board requested a bigger map depicting the area at the next meeting that action is being
taken on the topic.
TB Resolution 2022 -054: Refer Open Development Request for Elm St Ext property to the
Planning Board for comment
Resolved that the Town Board refers the request for an Open Development area for the parcel
behind 536 Elm St Ext., submitted by Denise Costich to the Planning Board for review and
comment.

9. Consider setting public hearings regarding noise permit applications for Ithaca Beer's
Summer Series weekly music; Summer Events; and daily outdoor seating area music
Mr. Howe noted that there are two parts to this item; setting a public hearing for three
applications and considering a permit for two events scheduled prior to the next meeting, noting
that the applications were submitted within the time required,but, due to the holidays, the next
Board meeting is after two events.
Mr. DePaolo asked about the application, noting that no mitigation efforts are listed for the for
the daily music and in the description, it seems that if the music is played just for guests outside
and he wondered how that require a noise permit, unless the request is to play it loud enough to
be a nuisance, and if so, music 5 days a week is a big ask.
Ms. Rosa responded that when he submitted the application, she told him it would be three
separate applications as they are distinct types of requests and he had said he was just being
careful by applying for the daily canned music; it is something he has done for the past few years
and not had any issues until a complaint recently.
Mr. Moseley reported on the complaint, saying that he and another Code Officer went out after
getting a complaint from a resident of Peachtree Ln and the speakers have a digital readout of the
speaker level and the officer went to Peachtree Ln and we communicated and determined a level
the music should be played at and he was advised that he could apply for a permit also. He did
want to have it higher than what we determined was a good level.
Mr. Howe suggested members go on a site visit to see what the level is in their opinion.

Whereas, Ithaca Beer submitted three noise permit applications for their summer series, events

Whereas, although Ithaca Beer met the submission deadline timeframe, due to the scheduling of
the Town Board meeting in May falling on May 9th, two events are prior to the scheduled public
hearings, and
Whereas, the Town of Ithaca Code, Chapter 187, Noise, permits the Town Board, in its sole
discretion, to waive the holding of a public hearing upon good cause shown or for other unique,
special or extenuating circumstances, now, therefore, be it
Resolved, that the Town Board waives the need for a public hearing for the following two events
based upon the conflict in scheduling and the recurring nature of these two events, and be it

Resolved, that the Town Board grants a noise permit to Ithaca Beer for:
Saturday, April 23rd' from 6pm— 8:30 p.m., Special Events—Lawnch - first occurrence, and

Granting of the permits is based upon the history of decreased complaints from the neighbors
due to the efforts of Ithaca Beer and the Neighborhood working together to address concerns for

Stretch to Zero Pilot Program

NYSERDA Stretch to Zero Pilot Program, and commitment of Town Board Support
Whereas,New York State Energy Research and Development Authority (NYSERDA) has
launched a Stretch to Zero pilot program; and
Whereas, the Town Board unanimously adopted the Town's Green New Deal on March 23,
2020, which sets forth a goal to achieve an equitable transition to carbon-neutrality community-
wide by 2030; and
Whereas, as a major milestone in its Green New Deal efforts, the Town of Ithaca on June 14,
2021, adopted Local Law 5 of 2021, adding Chapter 144 to the Town of Ithaca Code, Titled
"Energy Code Supplement;" and
Whereas, the Energy Code Supplement had an effective date of September 13, 2021, and since
then has been enforced by the Town; and
Whereas, the ECS currently requires that new construction, certain additions, and major
renovations be constructed to produce 40% fewer GHG emissions than those built to NYS code,
and starting in 2023 the ECS will require an 80%reduction in emissions, and starting in 2026,
the ECS will require net-zero GHG emissions buildings that do not use fossil fuels, with
exceptions for cooking and process energy; and
Whereas, the NYSERDA Stretch to Zero pilot program, under category two, aims to make
awards for municipalities that have already taken a local legislative action to adopt a zero on-site
greenhouse gas emissions code, and who are interested in sharing information with NYSERDA
and learning from the other participating municipalities; and
Whereas, municipalities can apply to receive up to $25,000 per quarter over the two-year Stretch
to Zero Pilot Program for a maximum award of$200,000; and
Whereas, Stretch to Zero pilot program funding will support ongoing implementation and
enforcement of the Energy Code Supplement; and
Whereas, participation in the Stretch to Zero program represents a valuable opportunity to show

Town of Ithaca leadership and inspire other governments to take legislative action to reduce
GHG emissions, in support of the climate goals of New York State and other national and
