Approval of Minutes b. Town of Ithaca Abstract Meeting of the Ithaca Town Board January 24, 2022 Due to Gov. Hotchel's executive order suspending certain aspects of the Open Meetings Law due to the COVID 19 pandemic,this meeting was held virtually and broadcast via the Town's YouTubeLive and Zoom accounts. Minutes Board Members Present: Rod Howe, Supervisor; Members Rich DePaolo, Pamela Bleiwas, Eric Levine, Margaret Johnson, and Rob Rosen Absent: Bill Goodman Staff Present: Judy Drake, Marty Moseley, Susan Ritter, Paulette Rosa, Becky Jordan, Joe Slater, Donna Shaw, Dan Thaete, and Nick Goldsmith. Mr. Howe called the meeting to order at 4:30 p.m. 1. Presentation and discussion—Community Choice Aggregation (CCA) —Paul Fenn Mr. Fenn went through a presentation giving an overview of what a CCA is and the Town/City partnership plan for advancing a CCA in our community. (Attachment 1) The Town would be involved in the governance and public outreach of CCA and an additional role of financing and investment to achieve the Green New Deal goals. Mr. Howe stated that this was meant as preparation of discussions that will be coming to decide what the Town wants to do. Think of it as a grid where the city may have many elements of the CCA options where the Town or another municipality may offer less of the list of options. He said he just got the draft this week and he will be meeting with Mr. Goldsmith and Mr. DePaolo and again with Mr. Fenn. Mr. Fenn added that this is moving in a different direction for NYS, looking for growth in the ability to meet the 2030 goals and reservations against using certificates to meet those goals by encouraging and supporting investment in carbon-reducing assets and facilities, on a macro level; investing in solar farms vs regulating/banning gas burning utilities. There is no more time to wait for the market to adjust if the 2030 goals are to be met. Mr. Howe closed, saying that he will reach out to Mr. Fenn and discuss the options the Town might be interested in pursuing. 2. Update—Green New Deal—Nick Goldsmith Mr. Goldsmith went through the accomplishments of 2021 and goals for 2022. (Attachment 2) TBS 2022-01-24 (Filed 2/10) Pg. 1 Ithaca Energy Code Supplement is still in the NYS filing process, but he has minor changes going through the Codes and Ordinances Committee now, and there may be more significant changes needed before 2023. 3. Consider revised Board Protocol and Procedures Manual Mr. Howe noted that he, Ms. Drake, Mr. DePaolo and Ms. Rosa met to discuss some of the questions that came up at the last meeting and then it was discussed at Personnel and Organization Committee. There were no questions from the Board. TB Resolution 2022 - 16: Approval of revised Board Protocol and Procedures Manual Whereas the Board Protocol and Procedures Manual (Manual) was reviewed, discussed, and revised at multiple meetings of the Personnel& Organization Committee throughout 2021, with the final draft being recommended to the Town Board for approval, and Whereas the Town Board has reviewed the Manual and made any suggested changes, now therefore be it Resolved that the revised Board Protocol and Procedures Manual is hereby approved and will be reviewed annually for minor edits as previously done. Consider adoption of the Town's Mission and Vision Statements Mr. Howe gave an overview of the process so far, noting that it has gone through the Personnel and Organization Committee and the Town Board previously. Mr. DePaolo stated that these are very overarching goals and asked if they match up with policies; why are we doing this. Mr. Howe responded that this came up at the Management Retreat where department heads were asked what they felt their roles were and how they feel they can accomplish these statements. Mr. DePaolo said they seem like actions that he would assume we have always been striving towards, and why would we need this as a sort of plaque. Mr. Johnson responded that it can be a reality check on Comprehensive Planning and on day-to- day work and some interesting things came out in the discussions while drafting this, so that in itself was useful. Ms. Drake added that it is a check and balance where department heads are taking their TBS 2022-01-24 (Filed 2/10) Pg. 2 departments and how it aligns with these statements. The Comprehensive Plan as a guiding document is one piece of what we do, not everything that we do, and these address the town as a whole and helps tie employees and town board members to what we think our guiding principles are. Mr. Rosen said he was in favor of it and it is standard in organizations. Ms. Bleiwas moved to accept the Mission and Vision Statements, seconded by Mr. Levine; unanimous. 5. Consider approval of revised Town of Ithaca Zoning Map Mr. Howe noted that this is a legal requirement whenever a new zone is added and we neglected to when we established the Chainworks and Amabel planned development zone and a few other minor changes. Moving forward, the Board will approve the revised map as they happen. TB Resolution 2022 - 017: Approval and Acceptance of a Revised Zoning Mau (Effective April 1,2004,Revised December 11,2006,August 13, 2012,January 13, 2014,December 11, 2017, and January 24, 2022) to Reflect Previously Approved Rezoning's Whereas, the Chain Works District Planned Development Zone and the zoning modification for the Amabel subdivision(LDR to MDR)have been enacted through local laws by the Town Board since the current official Zoning Map was adopted, and Whereas, a revised Town of Ithaca Zoning Map, Effective April 1, 2004, Revised December 11, 2006, August 13, 2012, January 13, 2014, December 11, 2017, and January 24, 2022, has been prepared and presented to the Town Board for review, including zoning boundary changes that the Town Board previously approved through adoption of local law numbers 12 of 2021 and 4 of 2018 that rezoned the Chain Works District Planned Development Zone and the Amabel subdivision and amended the official zoning map accordingly, and Whereas, at the regular meeting on January 10, 2022, the Town Board of the Town of Ithaca has reviewed the revised Town of Ithaca Zoning Map referenced above, and Whereas, this action is a Type 11 action pursuant to Part 617.5 (c) (26) of the New York State Environmental Quality Review Act (SEQR), and Chapter 148 of the Code of the Town of Ithaca titled"Environmental Quality Review",thereby not being subject to further environmental review, now, therefore,be it Resolved, that the Town Board of the Town of Ithaca hereby determines that the revised Zoning Map, Effective April 1, 2004, Revised December 11, 2006, August 13, 2012, January 13, 2014, December 11, 2017, and January 24, 2022, correctly incorporates changes made to the official Town of Ithaca Zoning Map, including zoning boundary changes that the Town Board previously approved through adoption of local law numbers 12 of 2021 and 4 of 2018 that rezoned the Chain Works District Planned Development Zone and the Amabel subdivision and amended the official TBS 2022-01-24 (Filed 2/10) Pg. 3 zoning map accordingly, and be it further Resolved, that the Town Board of the Town of Ithaca hereby approves and accepts the revised Town of Ithaca Zoning Map, Effective April 1, 2004, Revised December 11, 2006, August 13, 2012, January 13, 2014, December 11, 2017, and January 24, 2022, and determines that such map shall be used as the official Town of Ithaca Zoning Map until superseded by further action of the Town Board, or until further modified by local law. Consider sewer exemption for Cornell's Hoy Field project Mr. Howe noted that Cornell presented at the Public Works Committee who recommended this waiver to the Town Board and Cornell representatives are present for any questions. There were no questions from the Board. TB Resolution 2022 - 15: Authorization for the Town Engineer to issue a Sewer Exemption for TMP's 62.-2-3 & 62.-2-4; New Cornell Baseball Field (previously Hoy Field) Whereas the Town Engineer received a request for a Sewer Exemption from the owner(s) of TP 62.-2-3 & 62.-2-4; Cornell University, stating the financial difficulty to connect to municipal sewer due to the nearest sewer main(s)being approximately 2000+/- feet away and the need for upgrades of the downstream receiving sewer system. Estimated minimum cost: $2 million, and Whereas the Public Works Committee discussed the request at its January 18, 2022 meeting and recommended the exemption be brought to the Town Board for review and authorization, now therefore be it Resolved, that pursuant to Town Code Section 214-6, the Town Board hereby finds that the applicant has shown unusual and extreme practical difficulties in connecting its Baseball Field Project with the public sewers for the reasons detailed in Cornell University's request to the Town dated January 10, 2022, and be it further Resolved, that the Town Board authorizes the Town Engineer to issue an exemption from the Town Code Section 214-5 public sewer connection requirement for TP's 62.-2-3 & 62.-2-4 for the installation of a new, onsite wastewater treatment system associated with new baseball field project to be constructed on the properties, subject to the consent of the Tompkins County Health Department to this exemption. TB Resolution 2022 - 18: Setting a public hearing regarding "A Local Law Adding Provisions Regarding Barns on Non-Farm Lots.Agritourism, and Seasonal Farm Lodging Facilities in the Agricultural Zone to Chapter 270.Zoning. of the Town of Ithaca Code" Resolved that the Town Board will hold a public hearing at their meeting on February 14, 2022 at 5:30 p.m. to hear all interested parties on the proposed local law entitled "A Local Law Adding Provisions Regarding Barns on Non-Farm Lots, Agritourism, and Seasonal Farm Lodging Facilities in the Agricultural Zone to Chapter 270, Zoning, of the Town of Ithaca Code" Moved: Rich DePaolo Seconded: Rob Rosen Vote: ayes - Howe, Bleiwas, Johnson, Levine, DePaolo, and Rosen 8. Committee Reports • Budget—Mr. Levine reported that the Budget committee met to begin planning out the priorities for the year. • Codes & Ordinances - Ms. Ritter reported that the committee met and reviewed the changes Mr. Goldsmith noted regarding the Energy Code Supplement and gave the opportunity for public comment on 5G. Next month will continue both of those topics. • Personnel and Organization/ERC - Ms. Bleiwas reported they discussed the Board Protocol Manual and policies on weather related time off, appearance and health insurance buy back and retiree guidelines. Heard from Ms. Drake regarding a webinar she attended on COVID related time off. • Planning - Mr. DePaolo reported that they learned that Maplewood 2 has been moved to the backburner and there is a parcel up near Sapsucker Woods that Cornell is looking to sell, and developers may try to fast track a change in zone to multiple residence. He said they spent the majority of the meeting beginning a conversation on how to prioritize pedestrian corridors and bikeways for any funds that may become available and look at what the County has planned to work in conjunction with them. Also heard about a possible large-scale marijuana operation and we need to ramp up thinking about how we are going to handle those types of inquiries. • Public Works - Mr. Howe reported they discussed the sewer exemption the board just passed and some possible land acquisition for a town turn around on Crest Ln.
