Call to order and Pledge of Allegiance Mr. Howe opened the meeting and lead the pledge. 2. Cornell University Update Mr. Howe introduced Joel Malina, VP University Relations who in turn introduced his team; Gary Stewart, Associate VP Community Relations; Dianne Miller, Senior Director of Federal Relations; Karen Brown, Director of Campus Marketing and Communications. Mr. Malina outlined and updated the Campus' policies, testing and protocols associated with COVID-19 and protection measures being taken for in-person classes for the Fall semester. Mr. Malina added that 94% of campus staff and faculty is fully vaccinated and will continue with testing protocols that will be being put into place. He reminded everyone that this is fluid and additional adjustments may be made in working with the County, State and Federal departments and guidelines. Questions from the Board Mr. Howe asked if move-in is being phased again and Ms. Brown responded that it is being phased. Mr. DePaolo asked if there are policies in place for social activities and Mr. Malina responded that there will be large tents for certain activities to allow for social interactions while still providing a safer option. 3. Persons to be heard and Board Comments— Mia Slotnick spoke about the Short Term Rental committee meeting just prior to the meeting and concerns about hosts not being truthful to both neighbors and Code staff and there seems to be a lack of staff to handle issues and she felt that some of the taxes collected by the County TB 2021-08-09 (Filed 9/10) Pg. 1 through the various sites should go toward funding staff for enforcement as well as monetary fines and the cost of an operating permit should be significant enough to cover some costs also. Ken Simpson—spoke about conflicts of interest and he was concerned about board members that may be hosts not recusing themselves from this topic as a matter of ethics and conflict of interests. He is requesting that any members who are conflicted should disclose the conflict and recuse themselves. Board Comments—None 4. Public Hearing Regarding Proposed acquisition of real property by accepting easements on two properties adjacent to the Forest Home Walkway to allow for the reconstruction and maintenance of the current alignment of the walkway. Approval of the acquisition of easements and of the equipping of the land with suitable structures and apparatus is subject to Permissive Referendum. Mr. Howe opened the public hearing at 5:53 p.m. Bruce Brittain spoke and asked about the third easement that was not in the packet but he was in favor of the project. Caroline Arms spoke, saying she is one of the easement grantors, and she referenced her submitted comments as they related to the SEQR form. She is excited to have the project begin. Mr. Howe closed the public hearing at 5:58 p.m. Mr. Thaete responded to the concerns expressed saying that there are two easements, and he understands what Mr. Brittain was referring to, and it is a continuous easement, not separate. Ms. Arms' concerns about drainage and an existing encroachment license with the County; we are not changing any stormwater discharge points or infrastructure and the existing encroachment remains. A change was made to the SEQR form to indicate stormwater discharge remains the same. TB Resolution 2021 — 105a: SEAR Forest Home Walkway Improvement Proiect Whereas, this action is the Forest Home Walkway Improvement Project (Town of Ithaca Tax Parcel No.66.-2-15), and Whereas, over the years, the Forest Home Walkway has fallen into disrepair and deterioration, with failed storm drainage systems, failed stabilization efforts, deteriorated handrails, and a misalignment of the path from pedestrian use, and TB 2021-08-09 (Filed 9/10) Pg. 2 Whereas, the Forest Home Walkway Improvement Project will provide the Town of Ithaca's residents with an improved and safe walkway, connecting Warren Road with Forest Home Drive, within the Forest Home Area, and Whereas, the above-described action is an Unlisted Action, pursuant to the State Environmental Quality Review Act, 6 NYCRR Part 617, and Town of Ithaca Code, Chapter 148 — Environmental Quality Review, for which the Town of Ithaca Town Board is acting as Lead Agency in an environmental review with respect to the Forest Home Walkway Improvement Project, and Whereas, the Town Board, on August 9, 2021,has reviewed and accepted as adequate the Short Environmental Assessment Form, Parts 1, 2, and 3 prepared by Town staff for this action; now, therefore, be it Resolved, that the Ithaca Town Board hereby makes a negative determination of environmental significance based on the information in the Short EAF Part 1 and for the reasons set forth in the Short EAF Parts 2 and 3 in accordance with the New York State Environmental Quality Review Act and Chapter 148 of the Town of Ithaca Code for the above referenced action as proposed and, therefore, neither a Full Environmental Assessment Form, nor an Environmental Impact Statement will be required. Moved: Rich DePaolo Seconded: Tee-Ann Hunter Vote: ayes—Bleiwas, DePaolo, Goodman, Howe, Hunter, Leary Adoption/Authorization to Accept Easements Mr. DePaolo asked if there was any transfer of funds to the easement grantors since the easements were not distributed. Mr. Goodman responded (inaudible) *there is not fee to the grantor for the easement. There were no other questions from the Board and Mr. Howe took a roll-call vote. TB Resolution 2021 -105b: Approval of Forest Home Walkway Improvement Project and Authorization to Acquire Associated Easements, Subject to Permissive Referendum. Whereas, over the years, the Forest Home Walkway has fallen into disrepair and deterioration, with failed storm drainage systems, failed stabilization efforts, deteriorated handrails, and a misalignment of the path from pedestrian use, and Whereas, the Forest Home Walkway Improvement Project will provide the Town of Ithaca's residents with an improved and safe walkway, connecting Warren Road with Forest Home Drive, within the Forest Home Area, and Whereas, the Walkway has deviated from the town-owned parcel onto lands of Cornell University and of William and Caroline Arms, and TB 2021-08-09 (Filed 9/10) Pg. 3 Whereas, input from the public has suggested, and town staff have determined, that maintaining the current alignment will result in the least environmental impact and the most cost-effective solution, requiring easement acquisitions from Cornell University and William and Caroline Arms, and Whereas, the Ithaca Town Board has made a negative determination of environmental significance based on the information in the Short EAF Part 1 and for the reasons set forth in the Short EAF Parts 2 and 3 in accordance with the New York State Environmental Quality Review Act and Chapter 148 of the Town of Ithaca Code for the above-referenced action as proposed and, Whereas, Town Law §220(3)requires that the Town's acquisition of land for public parks and playgrounds, and the equipping of the land with suitable buildings, structures, and apparatus, be subject to a permissive referendum under Town Law §90 and §91, when such acquisition and equipping is paid for by taxes levied for the fiscal year in which such expenditure is to be made; and Whereas, the project's $240,000 estimated cost shall be paid for by taxes levied for the fiscal year in which such expenditure is to be made; and Whereas, pursuant to NY General Municipal Law §247, on August 9, 2021, the Town Board held a duly noticed public hearing on the proposed Forest Home Walkway easement acquisitions, during which the Town Board heard all persons interested in the Walkway easement acquisitions who appeared at such time and through the designated means, and Whereas, the Town Board has reviewed a Permanent Trail Easement and Right-of-Way with Cornell University, and a Permanent Trail Easement and Right-of-Way with William and Caroline Arms (collectively, the "Permanent Trail Easements"),both of which provide the Town of Ithaca with permanent easements for the purposes of the Town reconstructing and maintaining a pedestrian trail and related appurtenances for the public's use, now therefore be it Resolved, that the Town Board hereby authorizes and approves the Forest Home Walkway Improvement Project, including the Permanent Trail Easements and Rights-of-Way, and authorizes the Supervisor to execute said Permanent Easements and Rights-of-Way, subject to approval by the Attorney for the Town, and subject to a permissive referendum pursuant to the provisions of Town Law §220(3); and be it further Resolved, that pursuant to Town Law §90 and §91, within ten (10) days from the date of this resolution, the Town Clerk, in the same manner as provided for notice of a special election, shall post and publish a notice which shall set forth the date of adoption of this resolution, shall contain such resolution or an abstract of such resolution concisely setting forth the purpose and effect thereof, shall specify that this resolution was adopted subject to a permissive referendum; and shall publish such notice in the Ithaca Journal, a newspaper published in Tompkins County having general circulation in the Town, and in addition thereto that the Town Clerk shall post or cause to be posted on the sign-board of the Town, a copy of such notice within ten (10) days after the date of adoption of this resolution TB 2021-08-09 (Filed 9/10) Pg.4 Moved: Bill Goodman Seconded: Tee-Ann Hunter Vote: ayes - Bleiwas, Goodman, Howe, Hunter, Leary, and DePaolo 5. Discuss Capital Improvements Project(CIP) and Fleet Replacement Schedule Mr. Howe opened the topic, saying that it has been discussed at the Public Works Committee and the Budget Committee, so many members have seen this already, but now is another opportunity to ask questions. Mr. DePaolo asked what"red" type indicated and Mr. Thaete responded that those are additions and in discussions with Ms. Shaw, some items that were usually in the narrative, are now on the spreadsheet to be clearer. There were no other questions. 6. Consider authorization for the Supervisor to sign a contract with B&A Planning Group—Charrette/Regulating Plan for the Danby/King Roads area Mr. Howe stated that three consultant groups were interviewed, and the consensus was B&A Planning Group should be retained. Mr. DePaolo asked if the $65K is coming from an existing fund and Mr. Howe responded that it was. Mr. Howe added that we are hoping to start by early October. Ms. Hunter asked why the interview committee chose this group. Ms. Ritter responded that they have Jeff Byer, who we have worked with before, and he has assembled a team of people who have worked on similar projects and they have a ton of experience, as well as being recommended by Rod Stuedeville, who we have worked with before. She is very excited to work with them. TB Resolution 2021 -106: Authorization to enter into contract with B&A Planning Group for professional services associated with conducting a charrette and developing a regulating plan for the Danby/Kind Roads area of South Hill. Whereas, the Town Board adopted the New Neighborhood Code on November 9, 2020, for the purpose of enabling and guiding the planning, zoning, platting and building of new neighborhoods in the form of traditional neighborhood developments (TND) in the Town of Ithaca; and Whereas, the Town of Ithaca Comprehensive Plan (2014) recommended compact, mixed-use neighborhoods in the form of a TND in specific emerging growth areas of the town and the TB 2021-08-09 (Filed 9/10) Pg. 5 Plan's Future Land Use Map identified an area on South Hill, in the Danby and King Roads vicinity, for the "TND High" and "TND Medium" land use categories; and Whereas, at a meeting on April 15, 2021, the Town Planning Committee reviewed a TND concept proposal submitted by Noah Demarest (STREAM Collaborative Architecture and Landscape Architecture DPC) on behalf of South Hill landowners August Monkmeyer and David Auble; and Whereas, at a meeting on May 24, 2021, the Town Board discussed and expressed support for the Town's active involvement in the TND design process for South Hill as a means of enabling inclusion of other key properties and property owners in the King and Danby Roads vicinity, so as to ensure the creation of a unified and cohesive neighborhood plan; and Whereas, a Request for Proposals was prepared by Town Planning Department staff and sent to three consulting planning/design firms who were recommended as being experienced in conducting charrettes, designing TNDs, and developing regulating (zoning) plans; and Whereas, a subcommittee composed of two members of the Town Planning Committee, the Town Supervisor, and the Director of Planning reviewed the three proposals and conducted interviews with individuals representing two of the firms; and Whereas, the subcommittee determined that B&A Planning Group, led by Geoff Dyer, in association with CityBuilding Partnership and AVRP Studios, is highly qualified and capable of undertaking the South Hill TND project, now therefore be it Resolved, that the Ithaca Town Board authorizes the Town Supervisor to execute a contract with B&A Planning Group, in an amount not to exceed $65,000 (allocated from B8020.403), said contract being subject to the approval from the Attorney for the Town, Moved: Rich DePaolo Seconded: Pamela Bleiwas Vote: ayes—Goodman, DePaolo, Bleiwas, Hunter, Leary and Howe 7. Consider setting a public hearing regarding a local law to amend Chapter 270 and 271 of the Town of Ithaca Code, to provide a Planned Development Zone for the Chain Works District Ms. Ritter reported that she attended the public hearing by DEC and there were very few people there and very few questions. We are waiting for the final official Record of Decision,but it should be soon and the next step is for this public hearing and adopting the Finding Statement. TB Resolution 2021-107: Set a public hearing regarding a proposed Local Law to amend Chapters 270 and 271 of the Town of Ithaca Code, to provide a Planned Development Zone for the Chain Works District TB 2021-08-09 (Filed 9/10) Pg. 6 Resolved, the Ithaca Town Board will hold a public hearing at Town Hall, 215 N. Tioga St. on the 13th day of September 2021 at 5:30 p.m. for the purpose of considering a proposed Local Law to amend Chapters 270 and 271 of the Town of Ithaca Code, to provide a Planned Development Zone for the Chain Works District. Consider Approval of Wage Scale for Office and Field Employees There were no questions from the Board. TB Resolution 2021 - 108: Approval of 2022 Office and Field Classification Wage Scales Whereas,the Town Board established a Wage Scale,which sets the Hiring Minimum and Job Rate for each j ob classification,which may be increased each year based on a Cost of Living Adjustment (COLA); and Whereas, the collective bargaining agreement with the Public Works unit represented by Teamsters Local 317 established a 2.5% cost of living adjustment for 2022; and Whereas, after evaluating the Consumer Price Index (CPI-W) as well as other factors, the Town Supervisor and Human Resources Manager in preparation for the 2022 tentative budget recommended to the Personnel and Budget Committees a 2.5% Cost of Living Adjustment (COLA) to the Job Rate for all classifications when establishing the 2022 Office and Field Wage Scales; and Whereas, the Personnel Committee and Budget Committee reviewed and discussed the recommendation and recommends for the 2022 Wage Scales a 2.5%COLA on the Job Rate for all classifications in the Office and Field Wage Scales; now, therefore, be it Resolved, the Town Board of the Town of Ithaca does hereby approve a 2.5% Cost of Living Adjustment on the Job Rate for all classifications for the 2022 Office and Field Wage Scales (see attached sheet). Report of Town Officials Mr. Howe reported that we received a request from the City of Ithaca to be Lead Agency associated with the Farmers' Market expansion. Mr. DePaolo noted that he is hesitant whenever the City is the lead for something we are involved with, but we are still an "involved agency" so he would go along with it. Mr. Howe reported that the broadband survey came back and Mr. DePaolo said he was surprised with the low number and now the County will be looking at other avenues.
