Local Law #XYZ of 2018:
A Local Law to Amend Commercial “C” Zoning
in the Town of Danby, New York
Be it enacted by the Town Board of the Town of Danby in the County of
Tompkins, as follows:
Section 1. Authority
This Local Law is adopted pursuant to §261 of the Town Law of the State of
New York, which authorizes the Town to adopt zoning provisions that advance
and protect the health, safety, and welfare of the community.
Section 2. Statement of Purpose
This Local Law enables the adaptive reuse of an existing 8,800 sq. ft. warehouse
once used as part of an automobile dismantling operation. No new construction
is required to facilitate the private capital investment to renovate and reuse the
existing building within this area, which is in close proximity to the Central
Hamlet, which supports the Town’s Comprehensive Plan goals of allowing
flexibility for contemporary trends in business while ensuring compatibility with
neighborhood character and the environment.
Section 3. Amendments to the Zoning Ordinance
Repeal:
Said zones are bounded as shown on a map entitled "Zoning Map Town of
Danby," adopted October 16, 2017, and signed by the Town Clerk.
Replace with:
Said zones are bounded as shown on a map entitled "Zoning Map Town of
Danby," adopted June 18, 2018, and signed by the Town Clerk.
Section 4. Amendments to the Zoning Map
A. The Town of Danby Zoning Ordinance, Article IV: entitled ‘Establishment of
Zones,’ Section 401 - Map is hereby amended to change the zoning designation
of a 2.237-acre portion of the following parcel as depicted in a survey map
entitled “A Portion of Lands of Petricola-Bartholf Partnership,” prepared by T.G.
Miller, P.C., dated 11/15/2017 as shown on the official map from Low Density
Residential to Commercial “C”:
10-1-82.2
Section 5. Enforcement
Any violation of this Local Law must be subject to the same civil and criminal
penalties provided for in the Town of Danby Local Law 4 of 2016 Providing for
the Administration and Enforcement of the New York State Uniform Fire
Prevention and Building Code.
Section 6. Severability
The invalidity or unenforceability of any section, subsection, paragraph,
sentence, clause, provision or phrase of the aforementioned sections as
declared by the valid judgment of any court of competent jurisdiction to be
unconstitutional must not affect the validity or enforceability of any other
section, subsection, paragraph, sentence, clause, provision or phrase, which
must remain in full force and effect.
Section 7. Effective Date
This local law shall take effect immediately upon its filing with the New York
Secretary of State.
