The property is described as 890 McLean Road (Tax ID 95.12-01-16.000) within the Town of Cortlandville. It is zoned I-2 (General Industrial), is within the Aquifer Protection District (Area I: Primary Aquifer Area), is within the Wellhead Protection Zone (Zones la & lb) and is within an Area of Special Flood Hazard in accordance with the Code ofthe Town ofCortlandville, hereafter the Code. The conditional permit, aquifer protection special permit, and floodplain development permit review is being referred to the Cortland County Planning Board because the property is located within 500 ft. of NYS Route 281, NYS Route 13, County Route 120 (McLean Road). ANALYSIS - The applicant is requesting a site plan review, conditional permit, aquifer protection special permit, & Floodplain Development Permit so they may add a 2,500+/- square foot pre-engineered metal building to the northwest side of an existing sorter building. Manufacturing, assembly, and processing facilities are permitted in I-2 (General Industrial) districts subject to site plan review and conditional permit. Therefore, the applicant has applied for a site plan review and conditional permit. As this development exceeds $150,000 in development cost, the applicant has also applied for an Aquifer Protection Special Permit. As the applicant is developing in an area of special flood hazard, the applicant has also applied for a floodplain development permit. Sections 178-72, -75, -76, & -77 of the Code outlines the requirements that must be met in order to approve this conditional permit and site plan review. This development meets these requirements as it does not alter the site conditions, is compatible with the surrounding community's character, and does not involve any prohibited activities in industrial facilities. § 178-45 of the Code lists the restrictions and requirements for uses and activities in the aquifer protection district. As this development does not involve any of the prohibited / regulated uses and activities listed, it meets these requirements. This development meets all the requirements of Article IA "Wellhead Protection Area District" as it does not involve any of the prohibited uses and activities outlined in §178-2.3 D and does not increase the parcel's impervious surface. This development does not increase this parcel's impervious surface due to the proposed building being built on land that is currently paved. §178-81 C of the Code outlines the information required for approval of a floodplain development permit. As these documents have not been provided to the planning staff, it is recommended that the applicant provide this documentation to the Town if they have not already done SO. Finally, the proposed use is considered an Unlisted Action under SEQR. The applicant will need to complete Part I of the Short Environmental Assessment Form. Parts II & III should then be completed by the Town to determine if there may be any significant adverse environmental impacts as a result of the proposed use. RECOMMENDATION - The staff recommends approval of this application for a site plan review, conditional permit, aquifer protection special permit, & floodplain development permit to add a 2,500+/- square foot pre- engineered metal building to the northwest side of an existing sorter building only if the following contineencies are satisfied: that the applicant provide the documentation outlined in §178-81 C of the Code of the Torun of Cortlandville to the Town if they have not already done so. 2. compliance with SEQR requirements. Director of Planning ON THE MOTION OF Chuck Feiszli RESOLUTION NO.22-09 Amy Bertim GML# 95.12-01-16.000 Town of Cortlandville Site Plan Review, Conditional Permit, Aquifer Protection Special Permit, & Floodplain Development Permit Gutchess Lumber Co, Inc WHEREAS, on February 11, 2022 the Zoning Officer, Town of Cortlandville, pursuant to General Municipal Law 239 M submitted an application for Site Plan Review, Conditional Permit, Aquifer Protection Special Permit, & Floodplain Development Permit because the property is located within 500 feet ofNYS Route 281, NYS Route 13, & County Route 120 (McLean Road), AND WHEREAS, the Cortland County Planning Department has reviewed this request and submitted a written report dated March 11, 2022, which is on file, AND WHEREAS, the Cortland County Planning Board on March 16, 2022, held a regular meeting with a quorum and did consider this request, AND WHEREAS, the Cortland County Planning Board did thoroughly consider the material submitted by the petitioner, Department comments, and all other relevant reports on file, NOW THEREFORE BE IT RESOLVED, that only upon adherence to the following contingencies does the Board recommend approval of this application for site plan review, conditional permit, aquifer protection special permit, & floodplain development permit for the purpose of adding a 2,500+/- square foot pre- engineered metal building to the northwest side of an existing sorter building: 1. that the applicant provide the documentation outlined in §178-81 C of the Code of the Town of Cortlandville to the Town if they have not already done so. 2. compliance with SEQR requirements., AND BE IT FURTHER RESOLVED, that the Board reminds the Town of Cortlandville the requirements of General Municipal Law Section 239 M that a supermajority vote is to be attained by the Town in order to approve this application unless every contingency documented in this resolution is followed, AND BE IT FURTHER RESOLVED, that the Planning Department is hereby authorized to convey this action to the Zoning Officer, Town of Cortlandville.
