Minutes Review: No changes. Privilege of the Floor: None Business: Mr. Angie began the meeting by proposing a two-stage public comment period: one before the Board’s discussion of a proposal and one after. His motion was approved unanimously. Site Plan Approval: The applicant proposes to collocate 6 antennae arrays to an existing telecommunications tower, under §212-148 B(8) of the zoning code. Additional improvements include the addition of equipment cabinets on a 10’x15’ concrete pad, a generator, and the extension of the existing chain link fence to accommodate the equipment. The property is within the Agricultural (AR) Zone. Town Of Ulysses Planning Board Resolution (#11) for Negative SEQR and Site Plan Approval 3250 Mekeel Road June 21, 2022 WHEREAS, the applicant, representing Crown Castle, owner, is seeking Site Plan Approval for the collocation of a (9 antenna) telecommunications array; and WHEREAS, the property is approximately 51.79 acres in size and is located at 3250 Mekeel Rd (tax map # 24.-2-5.2), and is within the AR – Agricultural Rural Zone; and WHEREAS, The applicant proposes to collocate 9 antennae arrays to an existing 190’ tall telecommunications tower, under §212-148 B (8) of the zoning code. Additional improvements include the addition of equipment cabinets on a 10’x15’ concrete pad, a generator, and the extension of the existing chain link fence to accommodate the equipment; and WHEREAS, the action is an Unlisted Action under SEQR 617.5(c), and WHEREAS, the Town of Ulysses Planning Board will act as Lead Agency in an uncoordinated environmental review with respect to the project; and WHEREAS, the action does not require 239 review, per the agreement made with Tompkins County 24 November 2003. WHEREAS; the Planning Board hereby accepts the following materials; Site Plan Application (4/1/2022) and materials, RF Compliance Letter (April 29, 2022), Sheets T-1,T-2, C-1.1, C-1.2, C-1.3, C-1.4, C-1.5, C-2, C-3, C4, C-5.1, C-5.2, C-6, C-7, E-1, G-1, G-2, G-3, Generator Specs, Mount Specs, (Prepared by John W. Kelly P.E., B+T GRP, revised 7/28/21), Building Permit and supporting documents dated March 16, 2022 ; and WHEREAS; the proposed collocation of a 9 antennae array utilizes an existing 190’ tall tower, will not raise the height of the existing tower and will not significantly negatively affect visual resources; and WHEREAS; the proposed generator will only run intermittently, for short durations (per applicant’s response letter dated May 24, 2022), and will produce approximately 66 dB of noise standing at 23 feet, and will not have significant negative impact on neighboring properties, WHEREAS; the project has provided RF Certification (dated April 29, 2022) stating that the facility meets or exceeds the Federal Communication Commission’s requirements and will be operated at frequencies and power levels authorized by the FCC, will comply with all current FCC guidelines for cumulative measurements of radio frequency power densities and electromagnetic fields, and will comply at all times with FCC regulations concerning interference with reception of television and radio broadcasts or any public frequency serving the town’s residents. NOW THEREFORE BE IT RESOLVED: That after careful consideration of the Short Environmental Assessment Form and evaluation of the possible environmental impacts, the Town of Ulysses Planning Board hereby determines that the proposed collocation of a 9 antennae telecommunications array on the existing cell tower located at 3250 Mekeel Road will not have a significant adverse impact on the environment or the Town of Ulysses and issues negative determination of environmental significance, in accordance with the New York State Environmental Quality Review Act, for the above referenced action as proposed, and therefore, an Environmental Impact Statement will not be required. The Planning Board of the Town of Ulysses hereby grants Site Plan Approval for the collocation of nine antennae arrays on an existing 190’ tall telecommunications tower, under §212-148 B(8) of the zoning code. Parcel “A” is 2.02 acres, Parcel “B” is 2.23 acres and Parcel “C” is 5.33 acres. The property is within the Residential (R) Zone. TOWN OF ULYSSES PLANNING BOARD Resolution (#12) For Seqr Negative Declaration Of Significance And Minor Subdivision Approval. 5076 Cold Springs Road Tax Parcel # 12.-4-18. June 21, 2022 WHEREAS, the applicant, Ravi Meel, owner, is seeking Minor Subdivision Approval for the creation of three lots; and WHEREAS, the property is approximately 9.58 acres in size and is located at 5076 Cold Springs Rd (tax map # 12.-4-18.2) and is within the R – Residential Zone; and WHEREAS, the applicant proposes to split the existing 9.58 acre parcel into three parcels; Parcel “A” is 2.02 acres, Parcel “B” is 2.23 acres and Parcel “C” is 5.33 acres.; and WHEREAS, the action is and Unlisted Action under SEQR 617.5(c), and WHEREAS, the Town of Ulysses Planning Board will act as Lead Agency in an uncoordinated environmental review with respect to the project; and WHEREAS, the action does not require 239 review, per the agreement made with Tompkins County 24 November 2003. NOW THEREFORE BE IT RESOLVED: That after careful consideration of the Short Environmental Assessment Form and evaluation of the possible environmental impacts, the Town of Ulysses Planning Board hereby determines that the proposed Minor Subdivision of 5076 Cold Springs Road will not have a significant adverse impact on the environment or the Town of Ulysses and issues negative determination of environmental significance, in accordance with the New York State Environmental Quality Review Act for the above referenced action as proposed, and therefore, an Environmental Impact Statement will not be required; and That the Planning Board of the Town of Ulysses hereby grants Minor Subdivision Approval for the subdivision of the existing 13.05 acre parcel located at 5076 Cold Springs Road (tax map # 12.-4-18.2) into three parcels; Parcel “A” is 2.02 acres, Parcel “B” is 2.23 acres and Parcel “C” is 5.33 acres, as shown on the application materials and subdivision map (prepared by Lee Dresser, 6/3/2019). Action: Public Hearing and subdivision review SEQR: This is an Unlisted Action under SEQR Town of Ulysses Planning Board Resolution #13 for SEQR Negative Declaration and Minor Subdivision Approval 2081 – 2085 Trumansburg Road June 21, 2022 WHEREAS, the applicant, JBS Management Planning LLC, is seeking Minor Subdivision Approval for the creation of two lots; and WHEREAS, the property is approximately 9.58 acres in size and is located at 2081 – 2085 Trumansburg Rd (tax map # 13.-3-2) and is within the B1 – Business Zone; and WHEREAS, the applicant proposes to split the existing 11.5 acre parcel into two parcels; Parcel “A” is 8.59 acres, Parcel “B” is 3.26 acres; and WHEREAS, the action is and Unlisted Action under SEQR 617.5(c), and WHEREAS, the Town of Ulysses Planning Board will act as Lead Agency in an uncoordinated environmental review with respect to the project; and WHEREAS, the action does not require 239 review, per the agreement made with Tompkins County 24 November 2003.
