Members of the Public Present: Hilary Elmore Agenda Review: None Minutes Review: Minutes from the June 21st meeting were passed unanimously. Privilege of the Floor: None Business Special Permit and Site Plan Review - Applicant Hillary F. Elmore is requesting to use an existing building as preschool education space. The building is located at 1966 Trumansburg Rd, Tax Parcel # 20.-3-9.21; formerly known as Lakshmi Yoga, the property is an ~18.2-acre parcel within the Agricultural Rural (AR) Zone. This is a Type II action under SEQR, 6 NYCRR Part 617.5 (c)(18). Hilary Elmore told the Board she currently owns Smart Start and recently approached Lakshmi about the building at 1996 Trumansburg Road. She said she plans to use the new space for preschool children, which will allow her to offer more infant care in her home building (at 1956 Trumansburg Road). Mr. Angie opened a public hearing; there was no discussion. Board members asked about the property’s waste disposal – it has a septic system. All members expressed their support and congratulated Ms. Elmore on her presentation. Mr. Angie asked Mr. Tygensen if he had any comments. Mr. Tygensen did comment that going forward he would expect answers to findings requested for a special permit. Ms. Thomas suggested the Board go through the items for Ms. Elmore’s application right then, and Board members did. Mr. Angie then read the following draft into the minutes: TOWN OF ULYSSES PLANNING BOARD RESOLUTION Special Permit and SITE PLAN APPROVAL 1966 Trumansburg Rd, Tax Parcel # 20.-3-9.21 FOR CONSIDERATION 6 Sept 2022 Whereas, The applicant, Hillary Elmore, is seeking Special Permit and Site Plan Approval to utilize the existing building located at 1966 Trumansburg Rd, Tax Parcel # 20.-3-9.21, as a preschool and nursery. The property, formerly known as Lakshmi Yoga, is an ~18.2 acre parcel within the AR – Agricultural Rural Zone. Whereas: SEQR: This is an Type II action under SEQR , 6 NYCRR Part 617.5 (c)(18) the reuse of a residential or commercial structure, or of a structure containing mixed residential and commercial uses, where the residential or commercial use is a permitted use under the applicable zoning law or ordinance, including permitted by special use permit. Whereas: The proposed project meets all criteria in section 212-18, section E, 1-12, of the Town of Ulysses Code. NOW THEREFORE BE IT RESOLVED AS FOLLOWS, The Town of Ulysses Planning Board hereby grants Special Permit and Site Plan Approval for the project as described above, and as shown on the application materials.
