Excused: Ted Melchen, Ray Van de Bogart Others Present: Carol Sczepanski - Secretary Sue Beeners - Code Enforcement Officer George Blanchard-Alternate Planning Board Member Joel Gagnon-Alternate Planning Board Member Members of the Public Ronda Roaring, Esther Dotson, Walt Sczepanski, Dee Specker, Allan Laller, Nancy Metzker and others. Chairperson Roe called the regular meeting of the Planning Board to Order at 7:30 p.m. Further Consideration of the Lamson Public Hearing Matter Chairperson Roe reported that there are two(2) proposed resolutions to consider. RESOLUTION NO. 5 OF 2008 SEQRA DETERMINATION, LAMSON SUBDIVISION, DANBY ROAD By Dave Mastroberti: Seconded by Olivia Vent WHEREAS, this action is to consider Preliminary and Final Subdivision Approval for the proposed subdivision of Town of Danby Tax Parcel 7.-1-19, 11.9 +/- acres total, located at 1621 Danby Road, into three lots of 2.1, 2.1 and 7.7 acres each, Joel and Cindy Lamson, owners/applicants, and WHEREAS, this is an Unlisted action for which the Town of Danby Planning Board is legislatively determined to act as Lead Agency, and WHEREAS, the Planning Board on May 15, 2008 has reviewed the Short Environmental Assessment Form and the recommendation of the Code Enforcement Officer that a negative determination of environmental significance be made for this action, NOW, THEREFORE IT IS RESOLVED, that the Town of Danby Planning Board acting as Lead Agency in environmental review of this Unlisted Action, makes a negative determination of environmental significance. 2 Planning Board Minutes May 15, 2008 Discussion: Naomi Strichartz said that she would like the Planning Board to look into whether this subdivision qualifies for a longer form SEQRA. Anne Klingensmith asked if some consideration to should be given to whether some of this land is part of the aquifer. Chairperson Roe said that there is nothing in the application that triggers a long form SEQRA A roll call vote on the resolution resulted as follows: (Melchen and VandeBogart absent) Klingensmith Aye Mastroberti Aye Strichartz Aye Vent Aye Roe Aye Carried RESOLUTION NO. 6 OF 2008 PRELIMINARY AND FINAL SUBDIVISION APPROVAL, LAMSON SUBDIVISION, DANBY ROAD By Olivia Vent: Seconded by Anne Klingensmith WHEREAS, this action is to consider Preliminary and Final Subd ivision Approval for the proposed subdivision of Town of Danby Tax Parcel 7.-1-19, 11.9 +/- acres total, located at 1621 Danby Road, into three lots of 2.1, 2.1, and 7.7 acres each, Joel and Cindy Lamson, owners/applicants; and WHEREAS. this is an Unlisted action for which the Town of Danby Planning Board, acting as Lead Agency in environmental review, has on May 15, 2008 made a negative determination of environmental significance; and WHEREAS, the Planning Board on May 15, 2008 has held a public hearing on the matter; NOW, THEREFORE IT IS RESOLVED, that the Town of Danby Planning Board, grants Preliminary and Final Subdivision Approval for the proposed subdivision of Town of Danby Tax Parcel 7.-1-19, 11.9 +/- acres total, located at 1621 Danby Road, into three lots of 2.1, 2.1, and 7.7 acres each, Joel and Cindy Lamson, owners/applicants. The Planning Board reviewed the photos and construction plans including the materials to be used in the proposed pavilion. .Esther Dotson reported that the pavilion can be constructed easily and possibly some of the construction by youth workers. The pavilion can be used by the general public. Susan Beeners said that this project needs a building permit but not necessarily Planning Board approval RESOLUTION NO. 7 OF 2008 APPROVAL OF PAVILION,DANBY COMMUNITY PARK By Naomi Strichartz: Seconded by Ann Klingensmith WHEREAS, the Danby Community Park Association proposes to construct a 20' by 20' pavilion on the Danby Community Park Property, Tax Parcel 10.-1-78; and WHEREAS, the size and nature of the pavilion exempt it from the formal provisions related to modifications to site plans in Section 802 of the Zoning Ordinance; now, therefore , it is RESOLVED, that the Planning Board of the Town of Danby approves the construction of the pavilion as proposed, with the condition that no use of the pavilion shall cause loud or unusual noise, in accordance with Section 701 of the Zoning Ordinance. A roll call vote on the resolution resulted as follows: (Melchen and VandeBogart absent) Klingensmith Aye Mastroberti Aye Strichartz Aye Vent Aye Roe Aye Carried Hamlet Planning Project Susan Beeners explained to the Planning Board that the Town of Danby submitted an application to the Office for Small Cities NYS Housing Trust Fund Corporation for the 2007 Planning Technical Assistance Program. The Town has received funding through that grant application. Requests for Qualifications-based for professional community development planning services 4 Planning Board Minutes May 15, 2008 for the development of a Strategic Community Development Plan for the Central and West Danby Hamlets was sent out and the Town has received two(2)proposals. The Planning Board reviewed the proposal from Bergmann Associates and the Laberge Group. Sue recommended looking at the two proposals and explained both proposals to the board. Tentative dates for consultation with Bergmann Associates was discussed for possibly Thursday, May 29 at 6:30 or 7:00 p.m. or Thursday, June 5th or 12th as possible dates. Motion to Set a Meeting Date A motion was made by Anne Klingensmith and seconded by Olivia Vent that the Planning Board set a date to meet with Bergmann Associates so that our Hamlet Planning can move foreward.
