Drainage Easement
Property Owners: Clive M. Mc Cay and Jeannette B. Mc Cay
Property Location: From southeast corner of tank site near Sapsucker
Woods Road southerly 400 feet more or less to
small stream bed.
THIS AGREEMENT, made this 4fic day of May, 19$9,
by and between CLIVE M. MC CAY and JEANNETTE B. MC CAY, hereinaft r
designated as Owners, and the TOWN OF ITHACA, a municipal corporation
and political subdivision of the County of Tompkins in the State of Neuf York,
acting for and on behalf of the Northeast Water District, hereinafter designated
as the Town,
WITNESSETH: Whereas the said town is about to construct a water
distribution system in and for the Northeast Water District and the owners
have this day conveyed to the town a site for a standpipe located in the
northeast corner of the owners' lands on Military Lot No. 91 with access
to Sapsucker Woods Road and the town has requested a drainage easeipent
frovisaid tank site southerly across the owners' property to a small stream
in accordance with the plans and specifications for said water systemwhich
have been approved by the Town Board and filed with the Town Clerk.;'
NOW THEREFORE, in consideration of One Dollar ($1.40)
lawful money of the United States and other good and valuable considetation,

paid by the Town to the Owners, the undersigned owners do hereby grant
and convey to the Town of Ithaca, its successors and assigns, the rigot,
privilege and authority to construct, reconstruct, operate, inspect, r�aintai

and at its pleasure, remove a drainage pipe with the necessary fixtures and
appurtenances for drainage of the overflow from said standpipe upon 4nd
through the following described portion of the owners' property, to w*:
A strip of land 20 feet wide running southerly from the
south boundary of the standpipe site this day conveyed by the Owners
to the Town 400 feet more or less to the center line of a small
stream which runs through the owners' property, the east line of
CHARI ES N.NEWMAN said strip of land being an extension southerly of the east boundary

�? RESERVING, nevertheless, to the owners the use and enjoyment
of the said premises, provided that such use shall not interfere with oro struc
the rights herein granted, and the privilege of connecting drainage from a buttin
properties with the drainage pipe constructed hereunder.
The Town hereby agrees that the owners shall retain the fee
title to the said strip of land subject to this easement; that the said drainage
pipe shall be underground and properly covered, and that the town will restore
the surface of the ground and landscaping to the reasonable satisfaction o
the owner.
This agreement shall be binding upon the heirs, executors
administrators and assigns of the owners and upon the successors and assigns
of the town.
IN WITNESS WHEREOF, this agreement has been execute
and sealed by or on behalf of the parties hereto on the day and year above
stated.
