CONSERVATION AND SUSTAINABILITY COMMITTEE DESCRIPTION UPDATE
RESOLUTION 2022-173: CONSERVATION AND SUSTAINABILITY COMMITTEE DESCRIPTION
UPDATE
RESOLVED that the Ulysses Town Board re-establishes the Conservation & Sustainability
Committee as follows, noting that Scope of Work and Example Topic Areas may vary from
time to time:
Ulysses Conservation and Sustainability Advisory Council
Purpose: The Ulysses Town Board hereby establishes the Ulysses Conservation and
Sustainability Advisory Council (CSAC) as a standing advisory committee to the Board, to
research and recommend policies, procedures, and practices to enable the Town to manage
and protect its natural resources, and promote environmental sustainability. The Advisory
Council will operate under the guidelines of NYS GML Article 12-F section 239-x, regulations
for Conservation Advisory Councils and focus on areas consistent with the Town’s
Comprehensive Plan and other relevant Town, County, and State planning documents, key
elements of New York State’s Cleaner Greener Communities initiatives and strategic plans,
and relevant to current and proposed Town laws.
Composition and Appointment of Members: The Council was initially established by Town
Board resolution (XXX) on April 26, 2016 through December 31, 2017, and has been continued
on an annual basis. This resolution supersedes the previous resolution and establishes the
CSAC as a standing advisory committee to the Town Board. The Chair, and 2-8 additional
members are appointed by resolution of the Town Board, with staggered terms. Up to two
additional members who are between the ages of 16 and 21 may be appointed to the council.
Scope of work: The Council will propose and is free to modify its annual work plan, and
submit it to the Town Board. The Chair will work with the Town Board to prioritize Council
projects. The Council is free to work on issues as a whole or in task groups, but any actions
being recommended to the Town Board or to other standing or special committees of the
Board, or appointed boards in the Town of Ulysses should have the endorsement by
resolution of a majority of the appointed members of the Conservation and Sustainability
Advisory Council.
Example Topic Areas (as of 2022):
• Participate with, and recommend to the Comprehensive Plan Steering Committee
any changes that would encourage conservation and/or sustainability, focusing as a
priority on incorporating sustainability elements into an updated Plan.
• Research ways to reduce greenhouse gas emissions, increase energy efficiency, and
increase climate change resilience using NYS Climate Smart Communities and Clean
Energy Communities guidelines and resources; work with Town Board and staff on
recertification as a Climate Smart Community and continued designation as a Clean
Energy Community; work on implementation of impact action items within those
programs and related grant opportunities.
• Review water resource issues as they will be influenced by climate change;

support the Source Water Protection Plan Committee and New York Rural Water
Association work towards a water resource protection plan for the Town.
• Research and advise on the feasibility of creating local energy supply options such as a
municipal solar farm, an inter-municipal local utility, or community choice aggregation.
• Assist the Town Planner and Board in creating inventories and maps of open lands
within the Town (an open space plan), and recommend to the Town Board
ecologically suitable uses for all such areas.
• Assist with public education on conservation and sustainability initiatives and
financing opportunities to assist local residents and businesses.
• Assist with habitat protection programming and designations, such as a Bee Friendly
Community or Tree City USA, the Salo Habitat Preserve, and the Tree Advisory
Committee.
• Research and recommend waste reduction and sustainable resource use actions.
Resources from the Town: The Town’s Planner has a full work plan and cannot staff the
Council, but can provide technical assistance as time permits. The Council shall keep its own
meeting notes and may schedule the conference room and use the copier at the Town Hall.
Town staff can assist with preparation of the Council annual report for submission to the NYS
commissioner of environmental conservation.
Reporting: The Council shall make monthly reports through the Town Board liaison or privilege
of the floor and may request time on the Town Board agenda for presentations when making
recommendations.

RESOLVED, that the Ulysses Town Board authorizes the Town Supervisor to sign documents to
secure general liability insurance; and be it further
RESOLVED, that the Ulysses Town Board authorizes the pre-payment of general liability
insurance coverage through Tokio Marine HCC.

ESTABLISHING THE “SW3-232 / SW3-884 CAPITAL RESERVE FUND” OF THE TOWN OF ULYSSES AS A
TYPE CAPITAL RESERVE FUND FOR WATER DISTRICT 3 UNDER SECTION 6-C OF THE GENERAL
MUNICIPAL LAW
RESOLUTION #175 OF 2022: ESTABLISHING THE “SW3-232 / SW3-884 CAPITAL RESERVE
FUND” OF THE TOWN OF ULYSSES AS A TYPE CAPITAL RESERVE FUND FOR WATER DISTRICT
3 UNDER SECTION 6-C OF THE GENERAL MUNICIPAL LAW
RESOLVED, that pursuant to Section 6-c of the General Municipal Law, as amended, there is
hereby established a capital reserve fund to be known as the “Reserve Fund” (hereinafter
“Reserve Fund”). The purpose of this Reserve Fund is to accumulate moneys to finance the
cost of capital expenses. The type of capital expenses to be financed from the Reserve Fund is
the construction, reconstruction, or acquisition of equipment.
The chief fiscal officer is hereby directed to deposit and secure the moneys of this Reserve
Fund in the manner provided by Section 10 of the General Municipal Law. The chief fiscal
officer may invest the moneys in the Reserve Fund in the manner provided by Section 11 of
the General Municipal Law, and consistent with the investment policy of the Town of Ulysses.
Any interest earned or capital gains realized on the moneys so deposited or invested shall
accrue to and become part of the Reserve Fund. The chief fiscal officer shall account for the
Reserve Fund in a manner which maintains the separate identity of the Reserve Fund and
shows the date and amount of each sum paid into the fund, interest earned by the fund,
capital gains or losses resulting from the sale of investments of the fund, the amount and date
of each withdrawal from the fund and the total assets of the fund, showing cash balance and a
schedule of investments, and shall, at the end of each fiscal year, render to the Board a
detailed report of the operation and condition of the Reserve Fund.
Except as otherwise provided by law, expenditures from this Reserve Fund shall be made only
for the purpose for which the Reserve Fund is established. No expenditure shall be made from
this Reserve Fund without the approval of this governing board and such additional actions or
proceedings as may be required by Section 6-c [6-g] of the General Municipal Law or any
other law, including a permissive referendum if required by subdivision 4 of Section 6-c
[subdivision 7 of Section 6-g].

RESOLUTION #176 of 2022: GATEKEEPER RESOLUTION FOR BRIDGE NY APPLICATION
FOR CURRY ROAD STRUCTURE AND MAPLEWOOD ROAD HAIRPIN CULVERT
WHEREAS, funds have been made available to municipalities for bridge projects
through the BRIDGE-NY funding stream; and
WHEREAS, the Highway Superintendent and Budget Officer have determined that the
Curry Road structure and Maplewood Road hairpin turn culvert are priority projects to
apply for funding; and
WHEREAS, New York State funds 100% of the cost for eligible project costs, not to
exceed $1.0 million, through the BRIDGE NY culvert program; and
WHEREAS, for each project, costs exceeding $1.0 million will be appropriated out of
the DA232 / DA883 Bridge Repair Reserve Fund; and
NOW, THEREFORE, BE IT
RESOLVED, that the Ulysses Town Board authorizes the two BRIDGE NY applications.
ACKNOWLEDGING THE PROFESSIONAL ENGINEER CONSULTANT SELECTED TO ASSIST WITH
THE 2023 BRIDGE NY APPLICATIONS
RESOLUTION 2022-177: ACKNOWLEDGING THE PROFESSIONAL ENGINEER
CONSULTANT SELECTED TO ASSIST WITH THE 2023 BRIDGE NY APPLICATIONS
WHEREAS, all engineering firms on the NYSDOT Local Design Services Agreement
(LDSA) list for Region 3 were contacted to solicit expressions of interest; and
WHEREAS, all firms that submitted interest were evaluated using the standard matrix
provided in Chapter 6 of the Procedures for Locally Administered Federal Aid Projects
(LAFAP);
NOW, THEREFORE, BE IT
RESOLVED, that based on the scoring procedure and evaluation process, the Ulysses
Town Board confirms that the engineering firm Barton & Loguidice, D.P.C. is selected
to assist the Town in applying for the 2023 BRIDGE-NY funding.
SUPPORT FOR ULYSSES BRIDGE NY APPLICATIONS
RESOLUTION 2022-178: SUPPORT FOR ULYSSES BRIDGE NY APPLICATIONS
WHEREAS, funding programs like BRIDGE-NY recognize that infrastructure
replacement costs exceed the ability of the local municipalities to maintain bridges and
culverts in a timely fashion, and

WHEREAS, for years the Town has been seeking funding for the Curry Road structure
and Maplewood hairpin culvert as they are highly prioritized for replacement and
rehabilitation, and
WHEREAS, the Town of Ulysses has demonstrated the ability to administer BRIDGE NY
and other similarly funded projects;
NOW, THEREFORE BE IT
RESOLVED that the Ulysses Town Board enthusiastically supports the BRIDGE-NY
applications for the Curry Road and Maplewood Road culverts, and
FURTHER RESOLVED that the Ulysses Town Board wishes to express appreciation to
New York State Department of Transportation for administering this funding
opportunity.

APPROVAL OF THE 2023 FIRE PROTECTION DISTRICT AGREEMENT FOR 2023
RESOLUTION #179 OF 2022: APPROVAL OF THE 2023 FIRE PROTECTION DISTRICT
AGREEMENT FOR 2023
WHEREAS, a fire protection district known as the “Fire Protection District of the Towns of
Ulysses, Hector and Covert” (hereafter referred to as “the Fire Protection District”) has been
duly established in the said towns; and
WHEREAS, the Fire Protection District encompasses the following territory in the Town of
Ulysses: All of the Town of Ulysses, excepting the area within the limits of the incorporated
Village of Trumansburg; and
WHEREAS, the Village of Trumansburg (hereafter referred to as “the Village”) maintains a
volunteer fire department, with adequate and suitable apparatus, equipment and training for
the furnishing of fire protection services within the Fire Protection District; and
WHEREAS, Town Law §184 permits a town to contract with a village which maintains
adequate and suitable apparatus and appliances for the furnishing of fire protection services
in such fire protection district; and
WHEREAS, the Town wishes to contract with the Village to provide fire protection services in
the Fire Protection District; and
WHEREAS, a public hearing as required by §184 of the Town Law was duly advertised on
December 6, 2022; and

WHEREAS, the Public Hearing was held on December 13, 2022 at 7 p.m. and all members of
the public wishing to share their opinions in person or in writing had the opportunity to do so;
NOW, THEREFORE, BE IT
RESOLVED that the Town Board of the Town of Ulysses hereby approves and authorizes
execution of the attached Agreement between the Village and the Town, whereby the Village
will provide the Town with fire protection capable of responding to fire related and health
related emergencies on an ongoing basis within the Fire Protection District, for the period
from January 1, 2023 until December 31, 2023; and be it further
RESOLVED that, pursuant to the Agreement, the Town shall pay the Village the sum of
$226,537 for such services and the bill will be paid no later than February 15, 2023; and be it
further
RESOLVED that, the Supervisor of the Town of Ulysses is hereby authorized to execute the
Agreement on behalf of the Town of Ulysses.

WHEREAS, an ambulance district has been duly established in the Ulysses town; and
WHEREAS, the ambulance district the following territory in the Town of Ulysses: All of the
Town of Ulysses, excepting the area within the limits of the incorporated Village of
Trumansburg; and
WHEREAS, the Village of Trumansburg (hereafter referred to as “the Village”) maintains an
ambulance department, with adequate and suitable apparatus, equipment and training for
the furnishing emergency medical services within ambulance district; and
WHEREAS, Town Law §184 permits a town to contract with a village which maintains
adequate and suitable apparatus and appliances for the emergency medical services in such
ambulance district; and
WHEREAS, the Town wishes to contract with the Village to provide ambulance services in the
ambulance district; and
NOW, THEREFORE, BE IT

RESOLVED that the Town Board of the Town of Ulysses hereby approves and authorizes
execution of the attached Agreement between the Village and the Town, whereby the Village
will provide the Town with ambulance service capable of responding to medical emergencies
on an ongoing basis within the ambulance district, for the period from January 1, 2023 until
December 31, 2023; and be it further
RESOLVED that, pursuant to the Agreement, the Town shall pay the Village the sum of
$449,771 for such services and the bill will be paid no later than February 15, 2023; and be it
further
RESOLVED that, the Supervisor of the Town of Ulysses is hereby authorized to execute the
Agreement on behalf of the Town of Ulysses.

Ms. Olson and Mr. VanWhy explained this, noting that a cheaper bid isn’t always cheaper in the long
run, so municipalities can choose to select a higher bid based on best value. For example, the
warranty may be better or a bidder may be located closer making it more efficient to access…
RESOLUTION # 181 OF 2022: SETTING A PUBLIC HEARING ON THE BEST VALUE LOCAL LAW
RESOLVED, that the Town Board of the Town of Ulysses will hold a public hearing in person at
10 Elm Street, Trumansburg, NY and via ZOOM on Tuesday, January 10, 2022 at 7:00 p.m. for
the purpose of receiving comments on the proposed Best Value Local Law; and further
RESOLVED, that in addition to participation in the public hearing, all members of the public
wishing to submit written comments on the proposed agreement may do so in writing

addressed to the Town Clerk at 10 Elm Street, Trumansburg, NY 14886 or by email to
clerk@townofulyssesny.gov, and be it further
RESOLVED, that the Town Clerk is directed to publish notice of said hearing the in Ithaca
Journal as required by law and the Town Board authorizes payment of expenses associated
with said publication.

SAFETY CONCERNS REGARDING ROUTE 227/CURRY ROAD INTERSECTION WITH NYDOT
RESOLUTION #184 OF 2022: SAFETY CONCERNS REGARDING ROUTE 227/CURRY ROAD
INTERSECTION WITH NYDOT
WHEREAS, the residents from the Town of Ulysses have approved the Ulysses Town
Supervisor and the Ulysses Highway Superintendent with concerns about the safety at the
intersection at Route 227 and Curry Road; and
WHEREAS, the intersection has a history of traffic accidents;
WHEREAS, the intersection is controlled by the New York State Department of Transportation
(NYDOT) and the Town of Ulysses is not authorized to make any changes to the intersection
signage without approval by NYDOT; and
WHEREAS, the Ulysses Town Board requested a speed study for Curry Road from the NYDOT
on June 23, 2021, with results that remain pending; and
NOW, THEREFORE, BE IT RESOLVED that the Ulysses Town Board requests that the NYDOT
conduct a safety assessment of the Curry Road/Route 227 intersection, including a review of
its accident history; and
BE IT FURTHER RESOLVED that the Town Clerk is directed to submit a certified copy of this
resolution to the NYDOT.

WHEREAS, Whereas the Town Board seeks to form a Comprehensive Plan Steering Committee
that will be composed of broadly representative members of the community, and include
representatives of the Town boards and standing committees, as specified in the
Comprehensive Plan Update Project outline adopted on 9-27-22; and
WHEREAS the Town Board indicated at the November 8, 2022 meeting that it would begin
making appointments at this (Dec 13, 2022) meeting;
BE IT RESOLVED that the Board appoints the following with an appointment term to run
through completion of the project:

UNIFORM BUILDING CODE UPDATE:
Ms. Olson and Mr. VanWhy shared that NYS has a new uniform building code. Municipalities are
required to repeal old codes and adopt the new one but could also opt to amend certain aspects. The
item will appear on a future agenda.

Ms. Marino gave an update on the Source Water Protection Plan Committee:
• WRC facilitator Steve Winkley offered a model project plan for creation of a water protection
plan, including protection & implementation strategies and maintenance plans
• She shared the committee’s draft mission statement and goals
Ms. Bouchard shared that:
• other communities are also interested in forming Bee Committees
• her goal is to hold an information meeting for the Ag Committee in January
Ms. Olson shared the following:

• Highway Superintendent has filled the open position
• 6 applicants for the Proj. Asst position
• Property on Rabbit Run is in the process of getting cleaned up
• NYS has finished the appraisal process for Camp Barton and will reportedly submit a purchase
offer soon
• The Town and Village will participate in interviews for the new Cornell Coop. Ext. Youth
Program Manager

WHEREAS, the Town of Ulysses is a Participant in the Greater Tompkins County Municipal
Health Insurance Consortium (the "Consortium"), a municipal cooperative organized under
Article 47 of the New York Insurance Law, and
WHEREAS, the municipal participants in the Consortium have approved and executed a
certain Municipal Cooperation Agreement (the "Agreement"; effective date of October 1,
2010) and the 2023 Amendment that provides for the operation and governance of the
Consortium, and
WHEREAS, the Consortium's Board of Directors has recommended approval of the 2023
amended agreement, and
WHEREAS, the Municipal Cooperative Agreement requires that amendments to the
agreement be presented to each participant for review and adopted by each municipal board,
RESOLVED, that the Town of Ulysses approves and authorizes the Chief Executive Officer to
sign the 2023 Amendment to the Municipal Cooperative Agreement of the Greater Tompkins
County Municipal Health Insurance Consortium,
RESOLVED, further, that the Clerk of the Town of Ulysses is hereby authorized to execute this
Resolution to indicate its approval, transmit a copy thereof to the Board of Directors of the
Greater Tompkins County Municipal Health Insurance Consortium, and take any other such
actions as may be required by law.

Recreation Department Report

Winter Youth Programming
●Youth basketball clinic began Saturday, December 3rd.
○44 grade 1-3 participants and 8 grade 4-6 participants.
○Program is run by Erick Whelpley (boys JV basketball coach, with assistance
from Paul Pennock, and Tburg basketball players).
●Youth team basketball programs began last week. Teams in 5 divisions; boys 3/4, 5th,
6th, and girls 4th-6th. Total of 55 participants. The team based program will have a
short season beginning in January, with a tournament at the end of the season.
●Tournament will be hosted by Candor.
●Surrounding communities are discussing forming a basketball league for future years.
Winter Adult Recreation Programming
●Registration has opened for January - June adult sport recreation programming. The
program offerings will be the same as in the fall, with volleyball, basketball, indoor
soccer, and pickleball.
○Programs will begin the first week of January.
Future programming
●Exploration of offering a youth wrestling program in Trumansburg/Ulysses again.
Surrounding communities have offered programs with dual meets for youth programs
and the community has a history of a program. Possibly a program that could be
added for December 2023 to begin in January 2024
●Exploration of offering a youth volleyball program. A few surrounding communities
have also started youth volleyball. Possibly a program that could begin in December
2023 to begin in January 2024.
●Meeting with the Cornell Women’s Club soccer team to offer spring soccer clinics to
players in grades k-6.
●Meeting with SUNY Cortland Women’s Club softball team to offer softball clinics to
interested girls in grades 3-6.
●Meeting with the Trumansburg school system to take over additional youth and adult
programming.
●Meeting with Paddle n More about offering the finger lakes adventure camp on this
side of Cayuga Lake in 2024 depending upon the status of Camp Barton. The
program will be similar to the program offered out of Myers Park. This is an initial
meeting to talk about scope of the program and specific
needs/responsibilities/requirements of the program and the recreation department.
○The basics of the program - This is a water sport based summer program that
offers campers opportunities to paddleboard, kayak, canoe, sail, etc. the camp is
essentially based "on the water" and not "in the water". The outline of the
opportunity will be for the camp to run from the end of June through to the end of
August.

11/15 ITCTC Meeting
o Review of the Carbon Reduction Program
The Bipartisan Infrastructure Law (BIL) includes funding for the Carbon Reduction Program (CRP)
focused on reducing emissions from the transportation sector. Under this program funds are
allocated to MPOs to distribute within their jurisdictions. The purpose of the CRP is to reduce
transportation emissions through the development of State carbon reduction strategies and by
funding projects designed to reduce transportation emissions. The ITCTC has the responsibility
to distribute $92,771 in funds, with funding available immediately (FFY 22) and through FFY
2026 (Fund totals from FFY 23 through 26 may vary). Funds from 2022 and 2023 may be
combined to approximately $185,000. In collaboration with NYSDOT, ITCTC staff proposes to
follow a process similar to that used in TIP development to program CRP funds. In summary:
1. have a call for projects using an Initial Project Proposal (IPP) form
2. evaluation of proposals with review by applicants and Planning Committee members
3. selection of project(s) for funding approval by Planning and Policy committees
4. Staff has prepared a draft CRP Initial Project Proposal form and a CRP guideline
summary document. These two documents were sent accompanying the agenda. Please
provide questions and comments to staff or at the meeting Nov.15. During the meeting
we will also consider a timeline for implementation of this effort.
Action Requested: Planning Committee review and agreement on CRP fund programming
strategy.
Discussion at the meeting included considerations and feedback from NYSDOT about combining
multiple years funding so larger projects can be considered.

Balance Sheet
As detailed in the Supervisor’s Report, total cash balances as of 11/30/2022 were $1,885,521.23 a decrease of $97,163.65
from last month. Although we did have an influx in cash as noted below, we also made a couple of large annual payments:
the new truck in the Highway Department and the NYS Retirement System. Notable details of cash flow this month:
Sale Tax – We have received the August and September sales tax payments from Tompkins County.
Mortgage Tax – We have received the final mortgage tax payment from Tompkins County for 2022.
EMS Payments – We have received the October payment for EMS services from the Village.
We made two large annual payments in November – installment purchase payment for the new truck anticipated
to be received in early 2023 ($84.921.78) and the retirement system payment ($72,344).
As we approach year-end, you will begin to see amounts showing as prepaid expenses in account #480 on the balance
sheet in several funds. This is due to payments made now, but relating to next year or future years. For example, we have
made the installment purchase payment for the new Highway Department truck, however since we don’t yet have the
truck, it is recorded as a prepaid expense. You will see more of this as we pay invoices in December that are due by the
first of the year for 2023.
Income Statement
For the most part, revenues and expenditures are as anticipated. As noted above, we have one quarter of the year
remaining in sales tax payments to be received and two months EMS payments yet to be received. We are also still
waiting to receive the CHIPS funds for highway improvements, which we expect in December. Justice Court revenues
are recorded through September. There are no significant expenses that are expected to hit the 2022 budget for the
remainder of the year other than normal operational activity – larger anticipated cash outlays in December will be for
annual payments related to the 2023 budget.
Bookkeeper Activities
Below is a brief overview of my activities for the month:
Finance Committee: This month the Finance Committee completed its review of policy updates for this year,
which were then forwarded for legal review. Policies reviewed were: Purchasing, Investments, Capital Assets,
and Personnel (only certain sections).
Personnel: I have completed communication with employees and retirees to prepare for benefit administration in
2023. Our transition to the Platinum plan seems to be going smoothly with the help of consortium staff. I have
been supporting the search and hiring for new staff – notably a highway department MEO and a Project Assistant.
Year-End: In addition to normal operational activities, I have been working to prepare for year-end. This includes
communication with vendors and prepping for the issuance of 1099’s.
