The Zoning Board of Appeals has resumed in-person meetings. The Public Hearing meeting for the
Zoning Board of Appeals will be held in-person and will also be streamed live. The public will have the
option of attending the meeting in-person or by video conferencing through the Zoom App. The public
will have an opportunity to see and hear the meeting live and provide comments.

Mr. Rosen opened the meeting at 6:03p.m. and read the public hearing notice on the one appeal.
0012-2021 Appeal of Susie and Eric Schneider, owners, 869 Taughannock Blvd., LF, TP 25.-2-
25, seeking relief from Town of Ithaca Code Chapter 270 Sections 270-45 Height Limitations, -
46 B&C Yard Regulations, -46 H Garages and -47 Building Area for a proposed new
construction single family residence with detached garage.
Town Code section 270-45 requires detached garages not exceed 15’ feet in height where just
under 33’ feet is proposed; 270-46B requires a rear yard setback adjacent to the shoreline be not
less than 25’ feet from ordinary highwater line where proposed is approximately 18.5’ feet; 270-
46C requires side yard setback be no less than 20’ feet where 16.75’ is proposed; 270-46 H
requires front yard setback no less than 30’ feet, side yard no less than 20’ feet and that all
detached garages not exceed 600 square ft where proposed is just under 12’ feet front yard, just
over 16’ feet side yard, and 820 sq ft; -47 requires no more than 10% of lot coverage where
proposed is lot coverage is just under 24%.
Both the Schneiders were available for questions and their architect, Emily Petrina, gave a brief
overview and presented slides.
Ms. Petrina noted that the lot is restricted by a NYSEG easement and a NYS appropriation of
land back in the early 1930’s as well as the slope and a creek.
Currently, the property has a main house and a smaller accessory dwelling unit that is rented, and
a parking area that was built in 2015 with geo-mass and batted wall.
The proposal is to demolish both existing structures and build a detached garage and single-
family home for the owners to transition to year-round residency and age in place.
Ms. Petrina showed slides of some of the drawings supplied in the packet and additional photos
of neighboring garages and their view from the road.
The Board had a number of questions about the proposed placement of both the garage and the
residence and options to explore for limiting the encroachments suggested some plantings might
help with visual effects.

0012-2021 Appeal Susie and Eric Schneider, owner of 869 Taughannock Blvd., Tax Parcel No. 25.-2-25, is
seeking relief from Town of Ithaca Code sections 270-45 (Height limitations), 270-46 B. (Yard regulations),
270-46 C. (Yard regulations), 270-46 H. (Garages), and 270-47 (Building area) for a proposal to build a new
single-family dwelling /house and a detached garage.
Town of Ithaca Code section 270-45 requires that detached garages not exceed 15’ in height, where a height of
approximately 32’-10.5” is proposed for the detached garage. Town of Ithaca Code section 270-46 B. requires
that the rear yard adjacent to the shoreline be not less than 25’ in depth from the ordinary highwater line, where
the rear yard of the dwelling/house (east side) is proposed to be approximately 18’-5.375” measured from the
ordinary high-water line to a proposed deck. Town of Ithaca Code section 270-46 C. requires a 20’ side yard
setback, where the side yard setback is proposed to be approximately 16’-9” measured from the north side
property boundary lot line to a proposed deck. Town of Ithaca Code section 270-46 H. requires a garage to be
not less than 30’ from the front property boundary lot line, not less than 20’ from a side yard property boundary
lot line, and that all detached garages not exceed 600 square feet in area (in aggregate); where the detached
garage is proposed to have an approximate 11’-8.25” front yard setback (measured to the west property
boundary lot line), an approximate 16’-2” side yard setback (measured to the north side property boundary lot
line, and the total size of the detached garage is proposed to be approximately 820 square feet. Town of Ithaca
Code 270-47 allows for a building area of no more than 10%, where the proposed singe family dwelling/house
and detached garage is proposed to have a building area lot coverage of approximately 23.7%.
The current property is located in the Lakefront Residential District.
