The meeting was held via videoconference on the Zoom platform. Videoconference chat is saved in the appendix. Notice of Town Board meetings are posted on the Town’s website and Clerk’s board. CALL TO ORDER: Ms. Olson called the meeting to order at 7:01pm. Wright OTHERS: In person: (none) Via Zoom: Anne Koreman (Tompkins County Legislator), Courtney Kempski, Erick APPROVAL OF AGENDA: Motion: Mr. Boggs moved that the agenda for May 10, 2022 be approved. This was seconded by Ms. Marino and passed unanimously. PRIVILEGE OF THE FLOOR: (none) LIAISON/CHAIR REPORTS: Ms. Koreman shared the following information: • COVID updates: o Tests & masks available for distribution o 2 more deaths, some hospitalizations • 2023 budget process started (ends in November) • Podunk Rd bridge will be replaced- will take about 2 years • Airport is trying to get more low-cost carriers to increase accessibility • Redistricting (state): o Will need an extra primary o Poll-workers salary raised to a living wage • Redistricting for Tompkins County: o Will change number of legislators o This district (#5) may increase in size 2 o Public is welcome at meetings and to share input • Foreclosure sale is coming up- no properties in Ulysses on docket • The county’s Community Recovery Fund ($6.5 million) project is moving along under the leadership of a consultant EXECUTIVE SESSION: Mr. Goldman moved to go into Executive Session at 7:13pm for the purpose of discussing proposed litigation and matters related to the appointment and employment of particular persons. This was seconded by Mr. Boggs and passed unanimously. Mr. Goldman moved to end executive Session at 7:44pm. This was seconded by Ms. Marino and passed unanimously. OLD BUSINESS: PLANNER RECRUITMENT/ZONING ENFORCEMENT UPDATES Ms. Olson noted that there are a few applicants for the Planner position. The application deadline is 5/31. Ms. Marino reminded the board that they agreed to hire a zoning officer a few meetings ago. She feels that it is a prudent action since it will take a new planner a while to get up to speed and with the board working on so many other projects, this would he lp reduce the workload in the planning/building office. She suggests advertising for a part-time zoning officer for this year and next and then after that time re-evaluating whether the position is still needed. Ms. Olson expressed concern over hiring someone for just 18 months. She added that Mr. Zepko will now be attending planning board meetings so that will be helpful for that area. She stated that she thinks it would be better to hire a planner before hiring the planner’s subordinate (zoning officer). Mr. Boggs felt that they should wait longer and reassess. Ms. Marino agreed that they could wait if Mr. Zepko is going to help with meetings. She requested further discuss of the comp rehensive plan update at an upcoming meeting. RESOLUTION FOR PLANNING GRANT FOR TOWN CULVERT REPLACEMENT RESOLUTION #74 OF 2022: AUTHORIZING AN APPLICATION FOR A PLANNING GRANT FOR TOWN- OWNED CULVERTS WHEREAS, the Town is responsible for the maintenance of Town-owned culverts; and WHEREAS, a planning grant would enable the Town of undertake an assessment of two or three of the most significant Town-owned culverts through the lens of water quality, prioritized based on known degree of need and importance, to best determine how to manage, repair, or replace these important resources that are vital to the health and safety of Town residents; and WHEREAS, New York State Department of Environmental Conservation, through the Consolidated Funding Application process, has made funding available for “Stream Culvert Repair and Replacement” planning grants for up to $30,000 with a 10% local match that will enable the Town to seek funding of undertake necessary improvements; NOW, THEREFORE, BE IT 3 RESOLVED THAT the Town Board approves of MRB Group, the Town’s designated engineering firm, to submit an application on the Town’s behalf for a planning grant for up to $30,000 for “Stream Culvert Repair and Replacement;” and FURTHER RESOLVED, the Town Board approves the expenditure of up to $5000 for the completion of the grant application by MRB Group and authorizes the Town Supervisor to sign any contracts related to the execution of the grant application. Moved: Ms. Olson Seconded: Ms. Bouchard Olson aye Boggs aye Bouchard aye Goldman aye Marino aye Vote: 5-0 Date Adopted: 5/10/22 NY STRETCH CODE UPDATES AND DISCUSSION Ms. Marino updated the board, on the NY energy-saving building code (stretch code). She noted that information was shared with the public in the town’s newsletter last Friday (May 6). She shared answers to questions that board members had at the last meeting regarding the following: • June 30th deadline- the town will still get points toward future energy grants even if they don’t adopt the code by then • Enforcement- the board could pass the law in late august (but with filing and meeting dates for the meeting code council review), not begin enforcing until January. This would allow for more time to educate property owners and builders on the new rules. Ms. Olson suggested coordinating a public education session along with the Village of Trumansburg as they are considering adoption as well. RURAL WATER STUDY UPDATES AND DISCUSSION RESOLUTION #76 of 2022: TO PARTICIPATE IN THE NEW YORK RURAL WATER ASSOCIATION (NYRWA) SOURCE WATER PROTECTION PROGRAM 4 WHEREAS, the NYRWA’s federally-funded Source Water Protection Program provides technical assistance at no charge to rural and small communities for the development and implementation of local source water projection plans designed to prevent the deterioration of water resources used for drinking water; and WHEREAS, NYRWA’s Source Water Protection Specialist is qualified and available to assist the Town of Ulysses with developing a source water protection plan that involves the following elements: defining the water supply resources to be protected; identifying current and potential threats to the quality and quantity of drinking water resources; recommending and implementing measures to reduce threats to drinking water resources; and planning for the future, including water supply emergency events; and WHEREAS, the Town of Ulysses seeks to further develop its water resources planning and management strategies as listed above, and to coordinate development of a source water protection plan with a review and revision of the Town’s 2009 Comprehensive Plan; therefore BE IT RESOLVED, that the Town of Ulysses will take the following steps to develop and implement a source water protection plan: • Form an advisory planning team/committee of 7 people to include one or more Town board members, representatives from other Town of Ulysses boards and standing committees or staff, private citizens with expertise or a strong interest in water issues and /or public health, and members of applicable community groups. • With the help of NYRWA, the planning team will hold a source water protection workshop with invited representatives from governmental entities that have the authority (or potential authority) to protect source water in the planning area; • Work with the NYRWA Source Water Protection Specialist to identify water supply resources and potential threats using information from resources including a town-wide survey of drinking water issues, to be undertaken as an update to the Ulysses Water Needs survey and report completed in 2009; • Recommend and implement management strategies to protect identified water sources; • Review and approve a source water protection plan; and • Periodically review and update the source water protection plan as necessary. BE IT FURTHER RESOLVED, that the Town of Ulysses designates Town Board member Roxanne Marino as the liaison to coordinate work with the NYRWA on this project. Moved: Ms. Bouchard Seconded: Mr. Boggs Olson aye Boggs aye Bouchard aye Goldman aye Marino aye Vote: 5-0 Date Adopted: 5/10/22 NEW BUSINESS: APPOINTMENT TO YOUTH COMMISSION 5 RESOLUTION #77 of 2022: APPOINTMENT TO THE YOUTH COMMISSION WHEREAS, the Town of Ulysses is fortunate to have gifted and dedicated individuals willing to serve on our boards and committees; and WHEREAS, Elizabeth Weatherby is a very well-qualified applicant with a diverse range of professional and personal skills, is currently active in many youth programs throughout the Town, and has demonstrated her commitment to public service through volunteering and leadership in Ulysses; NOW THEREFORE BE IT RESOLVED that the Town Board appoints Elizabeth Weatherby to serve as an at-large representative on the Youth Commission for a term ending on December 31, 2022. In Ulysses, the Town Clerk has this task and is supportive of the change. STAFF REPORTS & ANNOUNCEMENTS: Ms. Marino shared the following: • CWIO is working on a priority list for land use/water resources and would like municipalities who agree to pass a resolution in support. Ms. Marino will send draft resolution. • Community Choice Aggregation- she has received updated information and will share with the board. Mr. Boggs shared that he is working with Ms. Marino on the Special Events Permit update. When they have completed a draft, it will come back to the town board for discussion. A few notable items this month:  Sales tax payments – During April, we received sales tax payments for January, February, and March, 2022. This puts sales tax revenue through March at about 28% of the annual budget.  Mortgage Tax – We received the first of two Mortgage Tax payments from the County for 2022. The amount of this payment was $78,557.34 – approximately 74% of the annual budget.  This month saw normal cash outlays for operating expenses, plus our annual debt service payment of $153,000 to the Environmental Facilities Corporation for Water District #3. Other than cash and interfund transactions (due to/due from other funds), there are no significant assets or liabilities in the Town’s operational financial statements, with the exception of funds due from the State and County for the Cemetery Bridge capital project (82,190.57). Income Statement Revenues through April 2022 are as expected, with the exception of the first Mortgage Tax payment that is much higher than anticipated. Expenditures through April 2022 are also as expected, with some spending being front loaded (such as payments for Fire and Ambulance services, and some insurance costs). I will include a more detailed summary and analysis of revenues and expenditures on a quarterly basis – as I did through March 31 in my April report. Bookkeeper Activities This month, I thought I would give a brief overview of what I have been working on in addition to recording and reporting financial transactions.  Audit: The independent auditors were on site in March, and have continued to make progress remotely since then. I continue to communicate, provide documents, and answer questions as needed. Not having an audit every year makes the process more challenging and time consuming as they essentially must perform audit procedures on two years’ data. I expect that they should be complete with the process fairly soon.  Personnel: I continue to provide support to staff with needs/questions around hiring, pay and benefits. Soon I will be assisting Will with hiring for the recreation summer camp program and Ethan with the youth employment program. I will also be providing information to staff about employee benefit programs as a part of our annual training on May 12th.  NYS Retirement System: As some of you may be aware, I have been working since I started with the Town of Ulysses to make corrections with the NYS Retirement system. I am almost complete with that process, which includes a detailed review of amounts reported for all active employees who are retirement system members. Once that is complete, I plan to transition Ulysses to a new enhanced reporting system which, sooner or later, will be a requirement.  Finance Committee: I continue to work with the Finance Committee, providing data and support as needed, depending on the task at hand. However, I did not get an ETA. But, the good news is that it is going to the assembly line. May 4, 2022 Town of Ulysses Recreation Department Brief Created by: Will Glennon, Recreation Director Spring Programs: ●Baseball program: 130 total participants. (129 participants in 2021) ○Tee-Ball: 46 participants; 6 volunteer coaches; Program is running on Tue/Thurs from 6:15-7:15 pm at the high school. ○Coach Pitch: 31 participants; 3 volunteer head coaches; Program runs on Thursday (practices) and Saturday morning (games) in the Kiwanis baseball league at Cass Park. ○Hybrid Pitch: 25 participants; 2 volunteer head coaches; Program runs twice a week, Wednesday (practices) and Saturday morning (games) in the Kiwanis baseball league at Cass Park. ○Kid Pitch: 28 participants; 4 volunteer coaches (2 head coaches and 2 assistant coaches); Program runs twice per week with practice and scheduled games. Each team is scheduled for 10 total games competing against: Newfield, Groton, Lansing, S. Seneca, and Watkins Glen. ●Spring Track program: 86 total participants (47 participants in 2021). ○The Program began on Tuesday, May 3rd. ○The program will be assisted by 26 volunteers from the HS track team and directed once again by Andrew Burton (10+ years). ●Spring tennis mini-clinic: 7 total participants (15 participants in 2021). ○The clinic runs Saturday mornings at the HS for two sessions, separated by age groups. ○The program is run by two SUNY Cortland Tennis Players. Summer Programs ●Summer Camp ○All six sessions of summer camp are full with waitlists. Approval has been provided to expand the summer camp from 60 campers to 72 campers to attempt to meet the increased demand. The increase of campers will be in conjunction with a slight increase in staffing to meet the necessary camper to counselor ratios. ○Summer basketball clinics and summer volleyball clinics are also open for registration. ●Summer Camp Staffing/Planning May 4, 2022 ○The summer camp is still accepting applications for recreation assistant positions for the summer through April 30th. The camp will be returning 9 staff from the previous summer including the Camp Director (Ryan Holmes) and one Assistant Director (Will Marrin). ○Summer camp safety plan and permit application has been submitted to TCHD. ○Camp staff training set for June 18th. part-time temporary Planner. Codes is successfully serving as a conduit for the public on zoning needs on a temporary basis • Expanded the recruitment of the planner position. Coordinated with HR/County to increase promotion of the position, and we have received a few applications already. Current application cycle closes on 5/31/22. • Investigated options for having code issues that create a conflict of interest reviewed by a 3rd party consultant. • Held meetings with all of Town staff members. • Reviewed and accepted time cards. • Reviewed and accepted monthly reports. Town Board preparation and follow up • Prepared and reviewed materials for the 4/12 and 4/26 regular and special meetings. • Collected and provided answers to Town Board members on a variety of topics, and held in- person, phone and/or email conversations with all Town Board members. • Worked with legal on exotic animal ordinance. • Worked with legal counsel on updating special event permitting. • Worked with legal counsel on MOU for Camp Barton negotiating. • Worked with legal counsel on conflict-of-interest issues. • Worked with legal counsel on zoning issues. Budget • Worked with Michelle E. Wright to on pre-budget planning and ARPA funding, including the preparation of materials related to presentation/discussion by the Town Board on April 26. • Reviewed the financial documents related to closing out April. • Reviewed and approved vouchers for 5/10/2022 meeting. • Signed MOU for Recreation Partnership and CIOW, per board authorization. Recreation/Camp Barton • Met/spoke/emailed numerous times with representatives of Town of Covert, Village of Trumansburg, and NYS Parks to discuss approaches of the municipalities managing the park on behalf of NYS. • Worked on developing language for new MOU and accompanying resolutions, and discussed this process with legal counsel concerning the development of a third-party entity to manage the property on behalf of the municipalities. Comptroller/Audit/IT • Ongoing participation on standing IT/Cyber responses internally. • Attended IT meetings, including the development of priorities and policy objectives. • Attended meeting with web designer to discuss website/hosting needs and related options. Highway/Water • Worked with Highway Superintendent to discuss budgetary needs. • Reviewed updated 284 agreement based on increased funding provided through the CHIPs program. • Reviewed water reports submitted by Bolton Point and Water Operator. • Attended a meeting to continue discussion of management plan. • Had several follow-up meetings with staff to discuss water district needs. COVID • Open Meetings extension allowing for fully remote meetings is scheduled to end on May 15th. Unclear if it will be extended. • NYS Courts still require masking; mask requirements for Town Hall remain in effect. Land Use • Continued to support through the allocation of legal resources Planning Board meetings until a permanent planner can attend and staff the board. • Continuing to explore legal options for addressing zoning insufficiency related to recreation fields. MISC • Worked with staff and legal counsel concerning newsletter criteria and reviewed submission regulations/criteria. • Researched IT policies in effect in towns/villages in NYS. • Reviewed the Tompkins County Environmental Health findings related to health violations. • Held multiple HR-related meetings to address current and future staffing issues. • Met with representatives of Covert and Interlaken regarding expansion of summer camp program. Liaison • Attended to Town Supervisors of Tompkins County monthly meeting. • Attended the TCCOG meeting. • Attended the Shared Services panel. • Attended Tompkins County monthly call. • Hosted a community partners call with other local leaders • Attended Youth Commission meeting, focusing on the development of a DEI policy. • Attended meeting between Town, Village, and Town of Covert to discuss organizing to license Camp Barton. • Attended one IT/Cyber committee meetings. I Marked out 3 Properties for contractors for DSNY this month. I Flushed the last Hydrant on Cold Springs Rd 3 times this month to keep fresh water out there. On April 25 we had a water break at 3952 Colegrove Rd. Once we were able to get down to the break we discovered a small leak around the service connection going to 3951 Colegrove rd. The repair was made in approx 30 minutes with a saddle clamp and new corp. We filled the Excavation site back in with new material and the job was completed. The Job was started at 6:00 am and completed by 10:00 at a cost around $2,000 and estimated water loss of around 7 to 8,000 gallons.I also met with Greg Weatherby (Bolton Point) about the injection quill at the tank for replacement.
