HomeMy WebLinkAboutZBA Minutes 2012-10-22 TOWN OF ITHACA ZONING BOARD OF APPEALS Monday October 22 , 2012 Minutes Present: Kirk Sigel , Chair; Bill King , Ron Krantz and Rob Rosen Alternate : Yvonne Fogarty Staff: Bruce Bates Director of Code Enforcement , Susan Brock , Attorney for the Town , and Lori Kofoid , Deputy Town Clerk Chairman Sigel opened the meeting at 7 : 04pm Appeal of Donald and Sue Rakow, owners , requesting variances from the requirements of Chapter 270-71 E "Yard Regulations" of the Town of Ithaca Code to be permitted to have an accessory building in side yard located at 175 King Rd E , Tax Parcel No . 45 . - 1 - 23 , Medium Density Residential . ( Note : Audio tape was not audible . Notes are from memory) Don and Sue Rakow spoke regarding their appeal . The Rakow' s explained that they had purchased and placed the shed before they found out it was out of compliance . Their intention is to landscape that the shed is not visible from the street . The lot ® narrows as it goes back . If they put the shed further to the back , it would go into the lot line or the screening vegetation which would compromise the drainage line . Ms . Brock and Mr. Rakow discussed that there was a covenant as a part of the Chase Farms development that requires their maintenance of a vegetative buffer. The covenant prevents them from moving the shed back into the vegetative buffer. Ms . Brock clarified that this does not require a SEQR because it is Type II . Mr. Sigel opened the Public Hearing at 7 : 10 . Public hearing was closed with no comment . ZBA Resolution No . 2012-053 , Area Variance , 175 King Rd E , TP# 45 . - 1 -239 October 22 , 2012 Motion made by Kirk Sigel , seconded by Rob Rosen That this Board grants the appeal of Donald and Sue Rakow, owners , requesting variances from the requirements of Chapter 270- 71 E "Yard Regulations" of the Town of Ithaca Code to be permitted to have an accessory building in side yard located at 175 King Rd E , Tax Parcel No . 45 . - 1 -23 , Medium Density Residential ( MDR ) with the following : ZBA 10/22/ 12 Page 2 of 10 Conditions ® 1 . That the shed remain approximately as placed currently and as shown on the survey submitted to this board . With the following : Findings The benefit to the applicant does outweigh any detriment to the health safety and welfare of the community , specifically : 1 . That the benefit that the applicant wishes to achieve can not be achieved by any other means feasible given the irregularly shaped and narrowing shape of the lot and the requirement that they maintain a vegetative buffer there , there would appear to be no other location on the lot that would serve their needs for their equipment shed . 2 . That there will not be an undesirable change in the neighborhood character or to nearby properties given the vegetative screen between the shed and the neighbor, 3 . That the request is substantial , being that the shed is being located in the side yard where it is not allowed but nevertheless the benefit does outweigh any detriment to the health safety and welfare to the community, and ® 4 . The request will not have adverse physical or environmental effects , and 5 . That while the alleged difficulty is self created that again , the benefit does outweigh the detriment to the health , safety and welfare of the community Vote : Ayes — Sigel , King , Krantz, Rosen and Fogarty Nays — None Motion passed unanimously . ZBA 10/22/ 12 Page 3 of 10 Appeal of Cornell University , owner, requesting a variance from the requirements of ® Chapter 270-223 A ( 1 ) " Fences and walls ; retaining walls" of the Town of Ithaca Code to be permitted to erect a 10 ' Bull Pen fence and a 40 ' Backstop fence where otherwise 6 feet or less would be allowed , located at 240 Pine Tree Rd , Tax Parcel No . 60 . - 1 -8 . 2 , Low Density Residential . ( Note : Audio tape was not audible . Notes are from memory) Tammy Aiken and Jim Catella , Clark Company were available for questions . Ms . Aiken and Mr. Catella clarified that this is 4 ft of fence with 6 ft above that equaling 10 ' in total . They explained that the fencing that was taken down was less than what they are proposing . The new netting is more aesthetically pleasing and provides as much protection to the spectators . It also adds additional safety to viewers behind the field as per NCAA regulation . The 40 ' backstop fencing is a little bit shorter than the tennis fencing that is next to the softball field . Mr. Catella presented the board with aerial pictures that showed how the netting would actually look on the field . Orientation will be staying the same . Another picture showed the existing netting that is about 45" above to protect the tennis balls from going onto the softball field and vice versa . The new netting is more visually appealing than the old which was demonstrated in this picture . ® The SEQR form was discussed and changes were suggested by Ms . Brock and approved by the Board . Mr. Sigel opened the Public hearing at 7 : 24pm . There was no one wishing to speak and the hearing was closed . ZBA Resolution No . 2012-054 , SEAR Determination , Height Variance , Cornell University Niemand - Robison Softball Field , 240 Pine Tree Rd , TP# 60 .- 1 -8 .21 October 22 , 2012 Motion was made by Kirk Sigel , seconded by Yvonne Fogarty Resolved , that in regard to the appeal of Cornell University, requesting a variance for the fencing at 240 Pine Tree Rd , known as the Niemand - Robison Softball Field , that this Board makes a negative determination of environmental significance based on the information in Part I and for the reasons stated in Part II of the environmental assessment form . Vote : Ayes — Sigel , King , Krantz, Rosen and Fogarty Nayes — none Motion passed unanimously ZBA 10/22/ 12 Page 4 of 10 ZBA Resolution No . 2012-055 , Height Variance , Cornell University Neimand- ® Robison Softball Field , 240 Pine Tree Rd , TP# 60 . - 1 -8 . 2 , October 22 , 2012 Motion made by Kirk Sigel , seconded by Rob Rosen That this Board grants the appeal of Cornell University, owners , requesting a variance from the requirements of Chapter 270-223 A ( 1 ) " Fences and walls ; retaining walls" of the Town of Ithaca Code to be permitted to erect a 10 ' Bull Pen fence and a 40 ' Backstop fence where otherwise 6 feet or less would be allowed , located at 240 Pine Tree Rd , Tax Parcel No . 60 . - 1 -8 . 2 , Low Density Residential ( LDR) with the following : Conditions 1 . That the bullpen fence be no higher than 10 . 5 ft and the backstop fence be no higher than 41 ft . 2 . That both of these fences are located approximately as indicated in the plans submitted by the applicant to this board . 3 . Planning Board conditions from PB Resolution No 2012 -069 are included in this variance as conditions . They are : a . Submission of one original set of the final site plan drawings , revised to show protection or the large trees on the western side of the project , signed and sealed by the registered land surveyor( s ) , architect( s ) , or ® landscape architect( s ) who prepared the site plan materials , to be retained by the Town of Ithaca , prior to the application for any building permits , and b . Submission of record of application for and proof of receipt of all necessary permits from county, state , and/or federal agencies , prior to the issuance of any certificates of occupancy. With the following : Findings That the benefit to the applicant does outweigh any detriment to the health , safety and welfare of the community, specifically: 1 . That the benefit that the applicant wishes to achieve , which is that of creating an NCAA compliant softball field can not be achieved by any other means feasible and , 2 . That there will not be an undesirable change in the neighborhood character or to nearby properties given the location of this field in regards to any public rights of way , the field not being visible from the road or any nearby properties . The proposed fencing is a replacement for similar fencing that has existed for a number of years , and ZBA 10/22/ 12 Page 5 of 10 ® 3 . That the request is substantial being as high as 40 ft proposed where only 6 ft is allowed , but nevertheless the benefit to the applicant does outweigh any detriment to the health , safety and welfare of the community , and 4 . That the request will not have any adverse physical or environmental effects for the reasons stated in the environmental assessment form and , 5 . That the alleged difficulty is self created , but the benefit to the applicant does outweigh any detriment to the health , safety and welfare of the community. Vote : Ayes — Sigel , King , Krantz, Rosen and Fogarty Nays — None Motion passed unanimously. Appeal of Ralph Varn , agent for Eknath and Eglantina Belbase , owners , requesting a variance from the requirements of Chapter 270-71 "yard regulations" of the Town of Ithaca Code , to be permitted to place a shed in an area other than rear yard located at 1020 Hanshaw Rd , Tax Parcel No . 71 . - 1 -66 . 2 , Medium Density Residential . Ralph Varn and Eknath Belbase were available to answer questions . A description of the lot was given by Mr. Varn , explaining how the lot is steeply sloped from the front and the drive way comes in from the side . It would be very difficult to get things like supplies down to the backyard area . The proposed placement is within the area that is allowed ® by the town code . It is difficult to tell the side from the front yard . It was determined by Mr. Bates based on the flag lot set up that had been determined in the past . Mr. Bates and the applicants discussed the dimensions and will add the distance into the measurements in the resolution . Ms . Brock confirmed that a SEQR is not required . Public hearing opened at 7 : 35pm . ( Note : Ms . Cowen was inaudible . Section drafted from memory) Deborah Cowen , neighbor to the applicants residing at 1022 Hanshaw Rd spoke against the granting of the variance . She explained the past decision by the Zoning Board of appeals that separated the lots on Hanshaw Rd . She had concerns that the shed size was larger than a " normal " shed and that the deer fencing that the applicant stated would block her view from the fence but it is rather an open fence that would not block the view. It is Ms . Cowen ' s opinion that the proposal does not meet the variance criteria 1 -3 . The garden did not have to be placed where it was placed and it does not shield the shed from the house . Mr. King asked how far the shed was from her property line would be 62 . 4' . The shed would be on the far side and would be lined up with the garden . ZBA 10/22/ 12 Page 6 of 10 ® The board asked questions regarding the purpose of the shed , which Mr. Belbase explained will be used to store a snow blower, which would be difficult to push up the embankment if it were in the backyard . Mr. Sigel explained that the applicants would be able to put a shed 3ft from Ms . Cowen ' s property line so it is not be out of the ordinary to have a shed that close to her property. Ms . Fogarty asked about vegetative barriers between houses . Ms . Cowen does not believe a tree barrier would be feasible due to the years it would take to grow large enough to shield the shed from view. Public hearing was closed at 7 : 48pm The board discussed the public comments . Mr. Rosen agreed with Mr. Sigel that the normal shed distance from a property line in the town is a measure and that 62 ' is a significant distance and not uncharacteristic of other sheds in the town . Mr. Bates enquired about why it was 33 ft behind the view. The shed is appx 11 ft high and normal size shed , not larger than a regular shed as Ms . Cowen believes . It would be within the code for the owner to extend the garage another 40 ft in the same direction and it would not require variance . ZBA Resolution No . 2012-056 , Area Variance , 1020 Hanshaw Rd , TP# 71 .- 1 -66 . 2 , October 22 , 2012 Motion made by Kirk Sigel , seconded by Bill King ® That this Board grants the appeal of Ralph Varn , agent for Eknath and Eglantina Belbase , owners , from the requirements of Chapter 270-71 "yard regulations" of the Town of Ithaca Code , to be permitted to place a shed in an area other than rear yard located at 1020 Hanshaw Rd , Tax Parcel No . 71 . - 1 -66 . 2 , Medium Density Residential ( MDR) with the following : Conditions 1 . That the shed be no closer to the front property line than the garage is , which is 62 . 4 ft approximately and , 2 . that the shed be placed approximately on the lot as indicated by the plans submitted by the applicants and , 3 , that the shed be no larger than 10 . 5 x 12 . 5 ft and no higher than 12 ft . With the following : Findings The benefit to the applicant does outweigh any detriment to the health safety and welfare of the community, specifically : ZBA 10/22/ 12 Page 7 of 10 ® 1 . The benefit that the applicant wishes to achieve , which is to add additional storage to his property (the upper portion of the property outside of the sloped area ) , cannot be achieved by any other means feasible 2 . There will not be an undesirable change to the neighborhood character or the nearby properties given the distance of over 60 ft from this shed to the nearest neighbor that can see it . 3 . That while the request is substantial , allowing the shed on the side yard where it should be required in the rear yard , nevertheless that substantialness is mitigated by the fact that it is over 60 ft from the property line 4 . That the request will not have adverse physical or environmental effects given it' s location on a portion of the lot that is level . This should minimize the effects as opposed to trying to place the shed in an area of the lot that is more steeply sloped and , 5 . That the alleged difficulty is self created by the applicant' s desire to place the shed in this location but nevertheless the benefit to the applicant does outweigh any detriment to the health , safety and welfare of the community . Vote : Ayes — Sigel , King , Krantz, Rosen and Fogarty Nays — None ® Motion passed unanimously. Appeal of James Marshall , agent for E & V Energy Corp , owners , requesting a variance from the requirements of Chapter 270- 146 "permitted accessory use" of the Town of Ithaca Code , to be permitted to operate a propane filling station located at 614 Hanshaw Rd , Tax Parcel No . 33 . -3-2 . 42 , Light Industrial Zone . Kirk Sigel moved to adjourn the appeal meeting due to the notice defect to the next available meeting of ZBA . Seconded by Bill King . Motion passed . ZBA Resolution No . 2012-057 , Use Variance , 614 Elmira Rd , TP# 33 . -3-2.42 , October 22 , 2012 Motion made by Kirk Sigel , seconded by Bill King Resolved , that this Board adjourns the appeal of E and V Energy , until such time as the Town of Ithaca Zoning Board of Appeals can give adequate public hearing notice . Vote — Ayes — Sigel , Krantz, King , Rosen and Fogarty Nays- None ® Motion passed unanimously ZBA 10/22/ 12 Page 8 of 10 ® Appeal of Glove House , owners , requesting a variance from the requirements of Chapter 270- 100 " permitted principal use " and amend previous variance of January 30 , 1979 , to allow a Chinese Cultural House/Group Home and to be allowed to add additions and other structures to the site , at 572 Warren Rd , Tax Parcel No . 72 . - 1 -2 . 12 , Multiple Residence Zone . ( Note : Audio tape was not audible . Notes are from memory) Pat Murphy , CFO of Glove House and Ann Yuyan Wang of the Chinese Culture house were present to answer questions and provide information to the board . Mr. Murphy explained the mission of the Glove house is to be a residential facility for children that have been placed outside of their home . Counties are not placing children in residential facilities due to the poor economic conditions and the Glove House can 't continue to maintain this property , running approximately $ 30 , 000 in monthly deficits . They were forced to close down but have been continued to own the property. This property would have to be replaced by a similar group home . They have lost other purchase opportunities because of the current zoning . It has been for sale since March of 2010 . Mr. Rosen gave a personal example of being shown the home while he was looking for a new home . One issue with the property is that you are living in the backyard of an apartment complex . It also has the middle school on the other side . Mr. Bates also ® stated that there was a problem with the 280 A issue . The town has addressed that and it has been resolved . The property doesn 't have any owned road frontage . There is an easement to get to Warren road but they don 't own it which they would have to . This was part of the hardship in the past for failed attempts to sell the property . The property was granted open development status so that building permits can be issued . The board reviewed the prior variance from Tuesday January 30 , 1979 that has conditions that would not be carried over to the conditions of today' s variance . A SEQR was done for the property ZBA Resolution No . 2012-058 , SEAR Determination , Use Variance , Glove House , 572 Warren Rd , TP# 72 . - 1 -2 . 12 , October 22 , 2012 Motion made by Kirk Sigel , seconded by Rob Rosen Resolved , that in regard to the appeal of Glove House , requesting a variance for the use of the property at 572 Warren Rd , known as Glove House , that this Board makes a negative determination of environmental significance based on the information in Part I and for the reasons stated in Part 11 of the environmental assessment form . ZBA Resolution No . 2012-059 , Use Variance , 572 Warren Rd . , TP# 72 .- 1 -2 . 12 , October 22 , 2012 Motion made by Kirk Sigel , seconded by Ron Krantz That this Board grants the appeal of Glove House , owners , requesting a variance from the requirements of Chapter 270- 100 " permitted principal uses" and amends the previous variance of January 30 , 1979 , to allow a Chinese Cultural House/Group Home at 572 Warren Rd , Tax Parcel No . 72 . - 1 -2 . 12 , Multiple Residence Zone ( MR ) with the following : Conditions 1 . That all of the findings and conditions and allowances of the variance from January 30 , 1979 are rescinded . 2 . That the proposed use as a Chinese Cultural House/Group Home will be allowed as described in the information provided by the applicant to this board , specifically that the proposal will allow the use for up to 13 residents plus additional visitors that may be attending classes or other programs provided by ® the Chinese Cultural House . With the following : Findings 1 . That the applicant has demonstrated unnecessary hardship , specifically that the applicant can not realize a reasonable return as evidenced by the applicant' s having the property for sale for approximately 2 . 5 years and having gotten no offers by anyone interested in using it as a single or two- family home or for the previous allowed use as a youth home . The only offer received by the applicant is for the present proposed use as the Chinese Cultural House and , 2 . This board finds that the alleged hardship is unique and does not apply to a substantial portion of the district or neighborhood having found that this is an unusual property being that it is a relatively small lot for a multiple residence zone and containing only one single family home on this lot which is not usual for a multiple residence zone and , 3 . That the use variance will not alter the essential character of the neighborhood given that the neighborhood is comprised of a number of uses including an apartment building , middle school , Vocational High School , and daycare facility and that the proposed use is similar to the previous use which ® was allowed by variance from 1979 , and ZBA 10/22/ 12 Page 10 of 10 ® 4 . That the alleged difficulty has not been self created in part because of budget cuts at the county level , the previous allowed use as a youth group home is no longer viable because the county is not sending as many kids to such a facility in sufficient numbers so as to maintain full capacity. And additionally because of the length of time that this has not been used as a single or two family home those uses are no longer desirable use's for this property. Vote — Ayes — Sigel , Krantz , King , Rosen and Fogarty Nays- None Motion passed unanimously New business David Mountin and Andrew Dixon will not be continuing past the end of their term on 12/31 / 12 . Yvonne Fogarty is interested in filling one of those positions and will go through the application process . November may need to know chairman elect if the December meeting is cancelled . There will be a November 8 training seminar in Hyde Park that board members are invited to attend .
