 Local Law No. 3 of 2017
 A Local Law to Amend Planned Development Zones in the Town of Danby, New York
 Adopted by Danby Town Board on 16-October-2017 Be it enacted by the Town Board of the Town of Danby as follows: Section 1. Authority This Local Law is adopted pursuant to § 261 of the Town Law of the State of New York, which authorizes the Town to adopt zoning provisions that advance and protect the health, safety, and welfare of the community. Section 2. Statement of Purpose Planned Development Zone regulations are intended to provide for residential, commercial, industrial or other land uses, or a mix thereof, in which economies of scale, creative archi- tectural or planning concepts and open space preservation may be achieved by a developer in furtherance of the Town’s Comprehensive Plan and zoning ordinance. Section 3. Amendments to the Zoning Ordinance Repeal:
 Said zones, except for the Commercial Target Area and Mobile Home Park Zones, are bounded as shown on a map entitled "Zoning Map Town of Danby," adopted December 11, 1991, and signed by the Town Clerk. Replace with:
 Said zones are bounded as shown on a map entitled "Zoning Map Town of Danby," adopted October 16, 2017, and signed by the Town Clerk. Section 4: Amendments to the Zoning Map A. The Town of Danby Zoning Ordinance, Article IV: entitled ‘Establishment of Zones,’ Sec- tion 401 - Map is hereby amended to change the zoning designation of the following parcels as shown on the attached map entitled “Town of Danby Planned Development Zone Rezon- ing 2017” to Low Density Residential: 10.-1-41.122; 10.-1-41.123; 10.-1-79.2; 10.-1-81; 10.-1-82.1;10.-1-82.3; 7.-1- 97.13; 10.-1-82.2; 10.-1-82.6;
 14.-1-12.2;
 9.-1-9.12; 9.-1-9.13; 9.-1-9.14;
 4.-1-20.4; 4.-1-20.31; 4.-1-20.32; 29.-1-8.4;
 2.-1-43.6;
 13.-1-8.1; 14.-14.2; 8.-1-12.15; and 20.-1-4.5. ! B. The Town of Danby Zoning Ordinance, Article IV: entitled ‘Establishment of Zones,’ Sec- tion 401 - Map is hereby amended to change the zoning designation of the following parcel as shown on the attached map entitled “Town of Danby Planned Development Zone Rezon- ing 2017” to Commercial A: 14.-1-10.2. ! C. The Town of Danby Zoning Ordinance, Article IV: entitled ‘Establishment of Zones,’ Sec- tion 401 - Map is hereby amended to change the zoning designation of the following parcels TownBoard_LL #3 of 2017; Planned Development Zone Amendments • Wednesday, October 4, 2017 Page ! of ! 1 2 as shown on the attached map entitled “Town of Danby Planned Development Zone Rezon- ing 2017” to High Density Residential: 10.-1-5; and 10.-1-21.14. ! The Town of Danby Zoning Ordinance, Article IV: entitled ‘Establishment of Zones,’ Section 401 - Map is hereby amended to change the zoning designation of the following parcel as shown on the attached map entitled “Town of Danby Planned Development Zone Rezoning 2017” to Mobile Home Park: 20.-1-4.2. ! Section 5: Enforcement Any violation of this Solar Energy Law is subject to the same civil and criminal penalties pro- vided for in the Town of Danby Local Law 4 of 2016 Providing for the Administration and En- forcement of the New York State Uniform Fire Prevention and Building Code. Section 6: Severability The invalidity or unenforceability of any section, subsection, paragraph, sentence, clause, provision, or phrase of the aforementioned sections as declared by the valid judgment of any court of competent jurisdiction to be unconstitutional must not affect the validity or en- forceability of any other section, subsection, paragraph, sentence, clause, provision, or phrase, which must remain in full force and effect. Section 7: Effective Date This local law shall take effect on the date it is filed in the Office of the Secretary of State of the State of New York.
