HomeMy WebLinkAbout2013-09-10-PIMTOWN OF ULYSSES PUBLIC INFORMATION MEETING SEPTEMBER 10, 2013 Audio available at http://www.ulysses.ny.us/council/tbmeetings/ Present: Supervisor Elizabeth Thomas; Councilpersons Lucia Tyler, Nancy Zahler, David Kemess, Kevin Romer; Environmental Planner Darby Kiley; Town Clerk Marsha Georgia. Others Present: Doug Dahl, Cheryl Fletcher, Margaret Burlew, Nancy Cool, Nicholas Szabo, Louise Terry, Larry and Jan Avery, Tim Fallon, George Brauhaus, Rod Hawkes, Joel Podkaminer, Gail Flannery, Lawrence McCann, Diane Hillman and Free Press reporter Louis DiPietro. Ms. Thomas opened the Public Informational meeting at 6:45 PM and introduced Ms. Kiley the Town of Ulysses' Environmental Planner. Ms. Kiley announced that she has provided copies of the presentation, a hand out on frequently asked questions and also provided a blank sheet of paper for anyone who wished to write out comments or questions. There will be a public hearing on this at another date after the language is finalized. Ms. Kiley presented the proposed changes to Zoning Law Article XX — Non -Conformance. This presentation is on the Town's website at: http://www.ulysses.ny.us under Current Issues. Questions asked (no name given). What is lot coverage 5% mean? Is there a front yard and a rear yard or is there two front yards? Why are bearing walls exempted, because they are the most important walls in a house? Ms. Kiley answered questions. Tim Fallon questioned 20.1 B about declaring a building/structure unsafe by any official does that mean if a property owner has a concern they cannot go ahead and make a repair before it becomes an issue. Louise Terry In 20.2 g where there is a one year time limit- why is that? In 20.5 al asked about new owner building a garage. Georgia Brauhaus said that all slides show set back requirements for yard setbacks but there are no discussions for stream buffers setbacks. This could be a huge issue along the lake with the Public Informational Meeting 2 September 10, 2013 definition that the Town now has. The request that he has is that all property owners currently non -conforming be notified that their property is non -conforming prior to the public hearing to make certain that they attend. Ms. Thomas addressed this request. Tim Fallon is concerned about something being declared unsafe. Questioned 20.2 it says and or building structures; 20.5 on restorations, who keeps track of the time limits; 20.2 what is a structure — is there a definition of structure? Under misconceptions; if your old house needs a new foundation you may need to have site plan approval; questioned this. Joel Podkaminer asked if it would be helpful to start the Non -Conforming section with definitions? Louise Terry asked if the concern about foundations could be added to 20.1 c? Tim Fallon asked which copy of the Non -Conforming is the official copy? Hearing no further questions or statements Ms. Thomas closed the Public Informational meeting at 6:45 PM.
