TB Resolution 2021- : Noise permit for Limbwalker Tree Care, LLC for a stump
grinding proiect
Whereas, the Town Board held a public hearing on March 8, 2021 regarding a noise permit
application for stump grinding operations received by Limbwalker Tree Care, LLC, and discussed
the request, and
Whereas, as stated in the application and detailed by the applicant, such stump griding operations
are dependent upon a third party providing the service and will be scheduled when they are
available, is estimated to take up to 5 days to complete and can be impacted by weather, now
therefore be it
Resolved that the Town Board grants a noise permit to Limbwalker Tree Care, LLC for the
purpose of completing stump grinding at their location of 1457 Trumansburg Rd, at a date to be
determined by the third -party contractor dependent upon weather and other conditions, with the
following

Grinding operations can begin no earlier than 8 am and must cease no later than 5 pm,
and
2. Grinding operations are prohibited from being conducted on a weekend or holiday, and
3. Limbwalker Tree Care LLC will notify its contiguous neighbors no later tha 48 hours prior
to the dates of operations when the third party commits to a schedule, and if canceled, will
again notify its contiguous neighbors when rescheduled, and with the following
Findings:
The waiver is the minimal intrusion needed, because the industrial equipment is
necessary to perform the stated task and strict timeframes have been made conditions to
mitigate to the extent possible any detriment to the neighborhood, and
2. On balance, the need for and benefits of the waiver outweigh the needs and rights of the
surrounding neighbors to a peaceable and quiet environment given the duration and
restrictions on hours of operation conditioned on the waiver.

TB Resolution 2021- : Approval of COVID-19 Vaccine Mcentive Program
Whereas, the Personnel and Organization Committee discussed the issue of the COVID-19 vaccine
being released to the public and whether the Town should require employees to receive the

vaccine; and
Whereas, the Personnel and Organization Committee recommended not requiring the vaccine at
this time, but wanted to strongly encourage as many employees as possible to receive the vaccine
as soon as it is available to thern; and
Whereas, the Personnel and Organization Committee discussed creating a paid time offincentive
to allow employees the time to travel to receive both doses of the vaccine and, if needed, time off
following the second dose due to any reaction to the vaccine; and
Whereas, the Personnel and Organization Committee recornn-iends approval of the COVID-19
Vaccine Incentive Program for the year 2021; now, therefore, be it

2021 COVID -19 VACCINE INCENTIVE PROGRAM
The Town of Ithaca and Bolton Point Water System (employer) strongly encourage employees to receive
the COVID-19 vaccine. As more employees receive the vaccine instances of COVID-19 transmitted at the
workplace will decrease. To encourage employees to receive the vaccine and to ease the burden of the
vaccination process, the employer is providing an incentive program. Employees will receive paid time
off to travel to and from the vaccine location and receive each dose of the vaccine. The employer
recognizes that a small number of people may experience a reaction to the second dose of the vaccine.
Therefore, to promote the safety and health of the staff, the employer will provide paid leave time to any
employee who is feeling ill on the day immediately following the receipt of the second dose. As employees
are encouraged to receive the vaccine at the earliest appointment available, time will be provided if the
vaccine is received on a non -workday. This program will be retroactive to provide this benefit for those
employees who have already begun or completed the two -dose series. This incentive program is for 2021
only but may be extended by the Town Board, if circumstance warrant it.
Program details:
• Employer provides up to three (3) hours of Other time for each of the two doses.
• Employee must request time off for the vaccine appointments under the same process as any
other request for time away from work.
• Employee must provide proof of their vaccination indicating that the vaccine was received on the
date and time specified on their timesheet.
• Employer will provide the day following the second dose as Other Time, in place of Sick Time, if
the employee is not feeling well, due to receiving the vaccine. Employee must contact their
supervisor prior to the start of their regular workday if they need to take the following day off.
Weekend credits (to provide parity):
• If the employee received the vaccine on a non -workday (i.e.: Saturday), they will be credited with
up to 3 hours of Other time per dose to use as time off. The time provided will be based on the
amount of time they would have needed to be away from work if it had been a workday.
• If the employee received the vaccine on a non -workday and is sick the day following their second
shot, they will be credited with a workday's worth of Other time.
Retro credits (to provide Parity):
• If the employee has already begun or completed the vaccine series, they will be credited with up
to 3 hours of Other time per dose to use as time off. The time provided will be based on the
amount of time they would have needed to be away from work if this program were provided at
that time.
• If the employee had used Sick time the day following their second shot, that Sick time will be
reimbursed.
• Employee must contact Human Resources Manager to request the Retro time and show proof of
their vaccination dates, times and at what vaccine clinic location.

TB Resolution 2021- : Approval of the Town of Ithaca Public Employer Health
Emereency Plan
Whereas, on September 7, 2020 the Governor of New York State passed legislation requiring
public employers to adopt a Public Employer Health Emergency Plan (Plan) for operations in the
event of a declared public health emergency involving a communicable disease, and
Whereas said legislation requires that the Plan must be reviewed by labor unions and the public
employer's governing body and adopted by April 1, 2021; and
Whereas, the Teamsters Local 317 has reviewed the Plan and had no recommended changes; and
Whereas, the Employee Relations Committee and the Personnel and Organization Committee
have reviewed the Plan and had no recommended changes; and
Whereas, the Personnel and Organization Committee recommends approval of the Public
Employer Health Emergency Plan by the Town Board, now, therefore, be it
Resolved, that the Town Board of the Town of Ithaca does hereby approve and adopt the Town
of Ithaca Public Employer Health Emergency Plan and authorizes the Town Supervisor to attest
that the Plan has been developed, approved, and placed into effect as required by New York
State.

TB Resolution 2021- : Approval and authorization for the Supervisor to sign an amendment
to the existing contract with Barton & Loguidice for the Forest Home Walkway
Improvement Project
Whereas, on September 28, 2020 the Town Board approved the Award of the Contract for Final
Design and Bid Phase Services for the Forest Home Walkway Improvement Project (TB 2020-
127) to Barton & Loguidice (B&L), and
Whereas, the Town has requested additional services related to preparing a series of easement
maps and restoration specifications for Cornell review and approval, and
Whereas, the scope of work has been expanded to by including said additional services and
outlined in Amendment 1, at an additional cost not to exceed $4,500.00; now therefore be it
Resolved, that the Town Board hereby authorizes the expansion of the scope and authorizes the
Town Supervisor to execute the amendment to the existing contract as detailed above.

Dear Supervisor Howe and Town Board Members:
As requested, Barton & Loguidice, D.P.C. (B&L) is submitting this Amendment No. I for supplemental
services for engineering and easement mapping for the Forest Home Walkway project inthe Town of
Ithaca.
To date, B&L has advanced the design and engineering pursuant to the Scope of Service outlined in our
original Agreement dated September 2g,2O2lMost recently, the Town has requested additional
services related to preparing a series of easement maps for each landowner from which access will be
necessary in order to access, construct, and maintain the improved Forest Home Walkway. In addition,
we have been asked to update the current set of plans and specifications for the inclusion of restorative
native planting design and specifications per Cornell University's (CU) approved plant lists for its land
assets as a result of a portion of the construction work being completed on CU property. To accomplish
the mapping work, B&L proposes to retain the subcontracted services of T.G. Miller Engineers and
Surveyors, P.C,further detailed below.
ADDITIONAL SCOPE OFSERVICES
1) Easement Mapping
a) B&L will assist T.G. Miller with preparing take maps, coordinating reviews with the Town,
providing T.G. Miller with the requisite design files in Awg format, and administering and
managing the deliverables to the Town for its use ineasement negotiations with Cornell
University and adjacent private property owners. A total of two (2) maps will be provided.
b) T.G. Miller will prepare an individual easement map for the section of the trail along the lands of
Cornell University adjacent to Warren Road.
d T.G. Miller will prepare an individual easement map for the section of the trail along the lands of
Arms located at 200 Pleasant Grove Road.
d) Both easement maps will include awritten metes and bounds description.

2) Additional Restorative Planting Design and Specifications
n) B&L will update the current construction documents to clearly convey the areas to be restored
with native plant and seed mixes per approved species lists provided by CU. This will include
discussions with Todd Bittner at CU, review of Cornell Cooperative Extension's requirements,
and updates to the plan sheets, general notes, and construction details.
b) Update the 1O8%Construction Cost Estimate toinclude additional restorative measures during
and post construction.
c> Prepare a spec for the restoration areas that clearly defines the required or approved seed

B&L proposes to complete the above described Additional Scope of Service for a lump sum fee of Four
Thousand Five Hundred Dollars ($4,500). The fee breakdown is as follows:

STANDARD TERMS AND CONDITIONS
for
PROFESSIONAL ENGINEERING SERVICES
provided by
BARTON & LOGUIDICE, D.P.C. ("ENGINEER")
The OWNER and the ENGINEER, for themselves, their successors and
assigns, have mutually agreed and do agree with each other as follows:
1.0 Basic Agreement
Engineer shall provide, or cause to be provided, the services set forth in the
proposal to which these terms and conditions are attached (PROPOSAL).
and Owner shall pay Engineer for such Services as set forth in PROPOSAL.
The PROPOSAL, in conjunction with these terms and conditions, is referred
to herein as "Agmatem".
2.0 Payment Procedures
Engineer will prepare a monthly invoice in accordance with Engineer's
standard invoicing practices and submit the invoice to Owner. Invoices are
due and payable within 30 days of the date of the invoice. If Owner fails to
make any payment due Engineer for services and expenses within 30 days
after the date of Engineer's invoice, the amounts due Engineer will be
increased at the tate of 1.0% per month (or the maximum rate of interest
permitted by law, if less) from said thirtieth day. In addition, Engineer
may, without liability, after giving seven days written notice to Owner,
suspend services under this Agreement until Engineer has been paid in full
all amounts due for services, expenses, and other related charges.
3.0 Additional Services
If mutually agreed by Owner and Engineer, or if required because of
changes in the Project, Engineer shall furnish services in addition to those
set forth in the PROPOSAL if requested by the Owner. Owner shall pay
Engineer for such additional services as follows: (1) as mutually agreed by
Owner and Engineer, or (2) an amount equal to the cumulative hours
charged to the Project by each class of Engineer's employees times standard
hourly rates for each applicable billing class; plus reimbursable expenses and
Engineer's consultants' charges, if any.
4.0 Termination
If Engineer's services related to the project are terminated for any reason,
Engineer shall be compensated for time plus reasonable expenses associated
with demobilizing personnel and equipment, and, if requested in writing by
the OWNER, for completion of tasks whose value would otherwise be lost,
to prepare notes as to the status of completed and uncompleted tasks, and to
assemble Project materials in orderly files.
5.0 Controlling Law
This Agreement is to be governed by the law of the state in which the
Project is located.
6.0 Successors, Assigns, and Beneficiaries
Owner and Engineer each is hereby bound and the partners, successors,
executors, administrators, and legal representatives of Owner and Engineer
(and to the extent permitted herein the assigns of Owner and Engineer) are
hereby bound to the other parry to this Agreement and to the partners,
successors, executors, administrators, and legal representatives (and said
assigns) of such other party, in respect of all covenants, agreements, and
obligations of this Agreement. Neither Owner nor Engineer may assign,
sublet, or transfer any rights under or interest (including, but without
limitation, moneys that are due or may become due) in this Agreement
without the written consent of the other, except to the extent that any
assignment, subletting, or transfer is mandated or restricted by law. Unless
specifically stated to the contrary in any written consent to an assignment, no
assignment will release or discharge the assignor from any duty or
responsibility under this Agreement.
7.0 General Considerations
A. The standard of care for all professional engineering and related
services performed or furnished by Engineer under this Agreement will be
the care and skill ordinarily used by members of the subject profession
practicing under similar circumstances at the same time and in the same
locality. Engineer makes no warranties, express or implied, under this
Agreement or otherwise, in connection with Engineer's services. Engineer
and its consultants may use or rely upon the design services of others,
including, but not limited to, contractors, manufacturers, and suppliers.
B. Engineer shall not at any time supervise, direct, or have control over
any contractor's work, nor shall Engineer have authority over or
responsibility for the means, methods, techniques, sequences, or procedures
of construction selected or used by any contractor, for safety precautions and
programs incident to a contractor's work progress, nor for any failure of any
contractor to comply with laws and regulations applicable to contractor's
work.
C. Engineer neither guarantees the performance of any contractor nor
assumes responsibility for any contractor's failure to famish and perform its
work in accordance with the contract between Owner and such contractor.
D. Engineer shall not be responsible for the acts or omissions of any
Contractor, Subcontractor, or Supplier, or of any of their agents or
employees or of any other persons (except Engineer's own agents,
employees, and Consultants) at the Site or otherwise furnishing or
performing any Work; or for any decision made regarding the Contract
Documents, or any application, interpretation, or clarification, of the
Contract Documents, other than those made by Engineer.
E. All design documents prepared or furnished by Engineer are
instruments of service, and Engineer retains an ownership and property
interest (including the copyright and the right of reuse) in such documents,
whether or not the Project is completed.
F. To the fullest extent permitted by law. Owner and Engineer (1) waive
against each other, and the other's employees, officers, directors, agents,
insurers, partners, and consultants, any and all claims for or entitlement to
special, incidental, indirect, or consequential damages arising out of,
resulting from, or in any way related to the Project, and (2) agree that
Engineer's total liability to Owner under this Agreement shall be limited to
$50,000 or the total amount of compensation received by Engineer pursuant
to the PROPOSAL, whichever is greater.
G. The parties acknowledge that Engineer's scope of services does not
include any services related to a Hazardous Environmental Condition (the
presence of asbestos, PCBs, petroleum, hazardous substances or waste, and
radioactive materials) except as may be specifically defined in the Scope of
Services. If Engineer or any other party encounters a Hazardous
Environmental Condition, Engineer may, at its option and without liability
for consequential or any other damages, suspend performance of services on
the portion of the Project affected thereby until Owner: (i) retains
appropriate specialist consultants or contractors to identify and, as
appropriate, abate, remediate, or remove the Hazardous Environmental
Condition; and (ii) warrants that the Site is in full compliance with
applicable Laws and Regulations.
H. The services to be provided by Barton & Loguidice under this
Agreement DO NOT INCLUDE advice or recommendations with respect to
the issuance, structure, timing, terms or any other aspect of municipal
securities, municipal derivatives, guaranteed investment contracts or
investment strategies. Any opinions, advice, information or
recommendations provided by Barton & Loguidice are understood by the
parties to this Agreement to be strictly engineering opinions, advice,
information or recommendations. Barton & Loguidice is not a "municipal
advisor" as defined by 15 U.S.C. 78x4 or the related rules of the Securities
and Exchange Commission. The other parties to this Agreement should
determine independently whether they require the services of a municipal
advisor.
8.0 Dispute Resolution
Owner and Engineer agree to negotiate all disputes between them in good
faith for a period of 30 days from the date of notice by either party of the
existence of the dispute. If the parties fail to resolve a dispute through
negotiation then Owner and Engineer agree that they shall first submit any
and all unsettled claims, counterclaims, disputes, and other matters in
question between them arising out of or relating to this Agreement or the
breach thereof ("Disputes") to mediation by a mutually acceptable mediator.
Owner and Engineer agree to participate in the mediation process in good
faith and to share the cost of the mediation equally. The process shall be
conducted on a confidential basis, and shall be completed within 120 days.
If such mediation is unsuccessful in resolving a Dispute, then (1) the parties
may mutually agree to a dispute resolution of their choice, or (2) either party
may seek to have the Dispute resolved by a court of competent jurisdiction.
9.0 Accrual of Claims
All causes of action between the parties to this Agreement including those
pertaining to acts, failures to act, failures to perform in accordance with the
obligations of the Agreement or failures to perform in accordance with the
standard of care shall be deemed to have accrued and the applicable statutes
of limitations shall commence to run not later than either the date of
Substantial Completion for acts, failures to act or failures to perform
occurring prior to Substantial Completion, or the date of issuance of the
Notice of Acceptability of Work for acts, failures to act or failures to
perform occurring after Substantial Completion.
10.0 Total Agreement
This Agreement constitutes the entire agreement between Owner and
Engineer and supersedes all prior written or oral understandings. In the
event of a conflict with contractual provisions in a Purchase Order
authorization related to this Agreement, the provisions of this Agreement
shall control. This Agreement may only be amended, supplemented,
modified, or canceled by a duly executed written instrument.

TB Resolution 2021- Authorization for the Town Engineer to issue a Sewer Exemption
for 161 King Rd East
Whereas the Town Engineer received a request for a Sewer Exemption from the owner(s) of 161
King Rd. East stating the financial difficulty to connect to municipal sewer due to the nearest
sewer main being approximately 1,000 +/- feet away and requiring pumps and/or a long gravity
sewer lateral and a main extension at an estimated minimum cost of $804100K, and
Whereas the owners are constructing a single-family home on the property and the Tompkins
County Health Department has designed and approved a septic system for the property, and

Subject: Municipal Sewer Connection for a New Home on East King Road - Patel
Dan,
A new home is to be built between 153 and 165 East King Road on the South side of the road.
The Town has requested that the new home be connected to the municipal sewer system. The
costs for that connection are detailed below.
Please reference the attached map of the municipal water and sewer lines in the immediate
area of the project. There are multiple options for connecting to this system, as shown by the
red lines, but none of them are cost effective.
The proposed home is to be located -525' South of the road.
One municipal sewer line is located across the road and approximately 1350' to the West from
the Northwest corner of the property, resulting in -1650" of trench and pipe required for
connection. This could be a gravity system, requiring no pumps.
Alternately, across the road and -310' uphill to the East is another connection point, in front of
Hospicare. This would be a combination of gravity to the road and then pumped up to
Hospicare. We'd need 550' of gravity line to the road, and then an additional -310' of 2" line to
the manhole in front of Hospicare, totaling -860' of trench for this system.
Assuming a cost of $35/LF for a 4" sewer lateral, the cost to extend sewer service to the
proposed new home location would be -$58,000 for a gravity system or -$30,000 for a pumped
system, not including the cost to cross the road and install manholes, grinder pumps, etc. that
would also be required. This figure also does not include restoration of any lawns that would be
crossed along the way.
Additionally, larger services would likely be required by the Town in order to serve other homes
along the route and any future extensions of the system, further increasing installation costs.
Another option would be to obtain an easement from the neighbors to the East, in order to pump
across their property to a manhole on their property. Discussions with the neighbors indicate
that they are not willing to grant that easement, and are in the process of preparing to sell the
house, so they don't want the yard torn up.
Considering that the cost of the sewer connections would exceed the estimated cost of
-$10,000 for a traditional septic system by a factor of 3 or more, it is desired to get a waiver
from the Town from your requirements to connect to municipal sewer as these connection
requirements make the project financially infeasible.

TB Resolution 2021 — g: Authorization for the Town Supervisor to sign revised lease
agreement with Greater Tompkins County Intermunicipal Health Insurance Consortium
Whereas, the Greater Tompkins County Intermunicipal Health Insurance Consortium
(Consortium) has a current lease with the Town of Ithaca that is renewable annually on March 31S`;
and
Whereas, the revised lease agreement includes an additional area to be leased at the total lease cost
of $800 per month; now, therefore, be it
Resolved, that the Town Board authorizes the Town Supervisor to execute the revised lease
agreement as described.
