It is my understanding that the Lake Shore Ad Hoc Committee of the
Board currently includes the following members :
Rod Hawkes, Chairman
Rebecca Schneider
Dave Kerness
Don Wilson
Darby Kiley, Town Planner
1) Ms. Schneider $ Mr. Hakes are members of the Town Planning Board and Ms. Kiley is
Town Planner(non-voting member of the Planning Board). Therefore the three members
of the Town Planning Board represent a majority on the AA Hoc Committee.
Furthermore, Darby Kiley reports as a Town Board Employee to Supervisor R. Marino
(see Organizational chart) . As a new voting member of the Ad Hoc Committee her
" independence " as a Town Employee is highly questionable.
2) Mr. Kerness as a current Town Board Member does not provide an " independent " voice
from that of the Town Board.
Due to the above referenced conflicts, the decision making process relative to matters before the
Ad Hoc Committee is highly suspect I therefore recommend a re-assessment of this committee
as to membership.

Mr. McCann voiced concerns over how the public can give input into the proposed zoning
language during the revision process . He is also concerned over the makeup of the Lakeshore
Zoning Ad Hoc committee and the appointment of Dave Kerness to fill Don Smith ' s position. He
advocates and clear and open process .

Mr. McCann presented his written statement to be included in these minutes at the 4/30/2013
meeting as follows:
I have been in attendance of every recent town meeting, from Town Board to Planning Board
and all Ad Hoc Committee meetings, (with the exception of one Town Board meeting) .
I have requested clarification from the Town Board, via email, for the rules of engagement and
have requested the same right to speak. But, I have received no response from my email of two
weeks ago. I understand Marsha George is away, but someone should be answering ,
considering the speed of change with respect to Lakeshore Zoning and the raft of resignations.
I had hoped in my attendance, of these meetings, to see effective governance entrusted to the
Town Board by the taxpayers. And, I have seen in many cases members of the Town Board
trying hard to fairly and ethically conduct themselves within the organization. I thank them for
a difficult task.
Yet, this other issue shades their volunteer efforts. What I have seen recently is bizarre :
opaque discussions that leave even the Town Board members confused. Instead of accuracy,
reasoning, adequacy of facts, good sense and ethical stances, I see a lack of clarity or veracity
in the machinations of the entire Lakeshore Zoning process . To name a specific and select few
of many cases :
I have seen in the last two Town Board meetings the Addition oft significant material
resolutions, not on the agenda, forced forward, with no Advance notice.
The sudden naming of Dave Kermes, Town Board member , to the Ad Hoc Committee falsely
because "no one else was interested. " This was done, after several others had volunteered in
multiple meetings. The Town Board had just reluctantly removed the chair of the Planning
Board, from the Ad Hoc Committee , due to a legal challenge . And in another attempt,
succeeded
in naming a new member to the Ad Hoc Committee. But this was retracted after the Town
Board found the representations to be misstatements of fact

In the last Town Board meeting there was a 20-minute argument, unclear to everyone at the
Town Board meeting as to its purpose , and another sudden resolution , not on the agenda,
regarding Lakeshore Zoning. Again, an attempt to pass through items, without warning, clarity
or veracity.
I, and all residents of Ulysses, deserve a clear and credible accounting of these actions, which
I have seen repeated meeting after meeting. Most significant, are the Ad Hoc Committee
meetings , twice per month and on track to complete in very soon. The Ad Hoc Committee is
now
comprised of two voting members of the Town Board, with a De facto member and two or
three
voting members of the Planning Board- a complete and overwhelming majority and quorum.
Four are members of either the Planning Board or Town Board. This completely outnumbers
and renders the sole individual, with no board positions, of no consequence. A fifth attends
and acts as a member aggressively and effectively speeding this unreasoned process along.
The discussions , which deserve a clear and credible accounting of the facts, rely on false data,
incomplete and biased surveys, irrelevant comparisons and unconvincing arguments. Recently
the image of deforested Ethiopia devastated by famine, death and destruction was used to
show
what will happen to the Lakeshore if not protected in a radical, foolish and unconvincing
rhetoric filled lecture. And the Baltimore Study ' for a major metropolitan area, was used to
argue more restrictive zoning, 100 feet from impermanent streams. Statements like "wait until
they try to build" and "I'm sorry but no one should be allowed to build on that land" are
bandied about with no facts and the assurance that, don 't worry, we are all grand fathered.
I am left in the audience unable to interact or question. Yet a Town Board member can, and
two other Town Board members can, vote backed up by two Planning Board members ' votes.
So, I request that this meaningless fast-tracking of an agenda controlled by a small faction on
the Town Board and Planning Board cease all actions, until those who are represented by the
Ulysses Town Board has the opportunity to understand through a credible and clear
accounting
of why and what is being hoisted upon us. This is improper. It is ineffective and lacks good
sense, veracity and ethics. And finally, it invites distrust in the community and entails potential
legal costs to the citizens of Ulysses.
So, I am requesting the Town Board stop the deliberations and end the Board controlled Ad
Hoc Committee, until a clear and credible accounting of this misbehavior and breach of
public trust is in evidence.
I am also requesting all correspondence regarding the Lakeshore Zoning issue be posted
openly, by the Town Board, on their website, so that citizens can begin to see what is so
difficult to decipher.
The Chair of the Planning Board rudely stated that you have to be "living under a rock " not to
know what is going on with Lakeshore Zoning. Well, having attempted to understand, I would
counter that what is going on is being hidden under a rock, protected by grand fathering, for a
few individuals who stand to benefit, on the backs of many Ulysses citizens/landowners i. e.
taxpayers who lose.
What happened to the Public Hearing comments ? Why are these not being considered
carefully, while instead sudden motions to force control are added at each Town Board
meeting. Behind the resident 's backs, insiders are deciding against a backdrop of very
credible concerns by the citizenry. With the resignation of Don Smith last month, comes the
resignation of yet another Ad Hoc member, leaving only 2 Town Board voting members and 2
Planning Board voting
members and one landowner. This is improper.

Ms . Thomas reminded Mr. McCann that the Ad Hoc Committee is only an advisory committee
and all the information will come back to the Town Board for review and updating .
Mr. Riederer wants to see the resolution that made Ms . Kiley a voting member of the Ad Hoc
Committee . Ms . Thomas will forward this . Mr. Riederer commented on the minutes not being
published in a timely manner on the web site for 2013 .
Mr. Riederer asked about the newsletter. Ms . Marino said the second one will be published and
mailed in a few days .
Ms . Houghton spoke regarding the membership of the Ad Hoc Committee and feels it is does not
seem fair to be filled with Town government affiliated people when there has been residents
willing to volunteer. She questioned the information gathered by Ms . Kiley and the survey .
Mr. DelRosso said he was pleased to hear Mr. McCann ' s comments . Mr. DelRosso asked if it is
the Board ' s intention to apply for the authority to regulate the lakeshore in this cycle .
Ms . Thomas said that board members have different opinions on it and it is not resolved.
Ms . Thomas said that she has suggested to the Ad Hoc Committee to allow a three minute public
comment period at their meetings .
TOWN REPORTS
Planning Board / Zoning Officer Darby Kiley Ms . Kiley previously distributed her monthly
report and Ms . Marino reviewed it briefly. (Audio available at www. ulysses .ny . us)
Highway Superintendent James Meeker reported on the activities of the Highway Department
for the month. Mr. Meeker is still working on the sidewalk project. The Seneca Road Bridge
still does not have a definite starting date . �
Deputy Town Clerk Patricia Halloran reported the total fees collected for March were
$ 1368 . 00 and $ 1069 . 71 was turned over to the Supervisor along with the monthly report. The
collection of taxes ended on April 2, 2013 and unpaid taxes will be turned over to the County .
Code Enforcement Officer not in attendance .
Deputy Supervisor Elizabeth Thomas gave brief report and emailed full report to the Board.

Ms . Thomas thanked Ms . Marino for her incredible amount of achievements in the three and half
years as Supervisor and her million different ideas of what we could be doing and half a million
were done .
Supervisor Marino reported as follows :
• Operating statements handed out to Board members . I1I
• Received scope of services and quote for audit, in response to the letter authorized by the
TB at our last meeting . Mary will review and give comments to the Board
• April 11 is the deadline for receiving a properly constituted petition for a permissive
referendum for the Ulysses Ambulance District. If one is not received, the final step in the
process is for the Clerk to send a certified notice of establishment of the district. Specific
wording needs to be included (as per person she spoke with at OSC) ; Roxanne emailed this

info and the address to send the document, to Marsha and Mariette . Marsha will be back on
the 11 `h and should send the draft of the certification to Mariette for review before sending
to the State .
Ms . Marino gave the following statement :
As you know, this is my last meeting as Supervisor. While I regret that the demands of my life
are now such that I have to step down a few months before the end of my term, I am very proud
of all that we collectively have accomplished over the past 3 years . We have increased
accessibility of information and public awareness of important issues, taken strong steps to
protect our unique and valued environment, expanded our capability to address the ever-
increasing challenges and opportunities for local governments, and maintained a solid fiscal
foundation.
Being the Supervisor has been a very enriching and rewarding experience for me . I am grateful
to have had this opportunity to serve the residents of Ulysses and to work with so many talented
and dedicated people in our town and county, most especially my fellow elected officials and our
attorney and staff here in Ulysses .
I am, as always, enthusiastic about our Town and community and look forward to continuing to
contribute to current and new initiatives , and even to returning to elected office at some time in
the future .
It has truly been an honor and a pleasure . Thank you all .
OLD BUSINESS
Chamber of Commerce Sign
The Board discussed this with Mr. Meeker who has attempted to contact Mr . Ryan at the
Chamber of Commerce . Ms . Thomas provided a copy of the proposed resolution .
Ms . Thomas moved, seconded by Ms . Marino the following :
WHEREAS the Tompkins County Chamber of Commerce initiated an effort to install
Gateway Signage at the entrance to Tompkins County on major state highways in order
to promote tourism; and
WHEREAS the Chamber of Commerce has funding to purchase the initial set of signs ;
and
WHEREAS there are currently signs marking the entrance into the Town of Ulysses and
Tompkins County on State Routes 89 and 96 where the Gateway Signage project
proposes to place the new signs .
THEREFORE BE IT RESOLVED that the Town Board of Ulysses is in support of the
Tompkins County Chamber of Commerce Gateway Signage project to install gateway
signs on Routes 89 and 96 as presented to the Town Board at the March 12 meeting of
the Board ; and
RESOLVED the Town of Ulysses will apply for the Waived Use and Occupancy Permit
for Gateway Signage and any subsequent papers which might be required for this
permit; and the Town of Ulysses Highway Superintendent is empowered to execute such
Use and Occupancy Permit ; and
RESOLVED that this approval from the Town Board of Ulysses is contingent on the
NYS DOT either removing the existing, standard issue gateway signs on Routes 96 and
89 or allowing Tompkins County or the Town of Ulysses to remove the existing signs ;
and

NEW BUSINESS
Personnel Policy Update
Ms . Thomas reported the Personnel Committee met with Public Sector Human Resources to
review the Town ' s current personnel policy. Public Sector HR will be submitting a new draft
policy for review. Ms . Thomas distributed information on benefits for retirees . The work will
continue on the policy .
Ag Land Assessment for Fire EMS
Ms . Marino moved, seconded by Ms . Thomas the following :
RESOLUTION ADOPTING AGRICULTURAL ASSESSMENTS ON AGRICULTURAL LAND
FOR PURPOSES OF CALCULATING BENEFIT ASSESSMENTS OR SPECIAL AD VALOREM
LEVIES FOR THE TOWN OF ULYSSES FIRE PROTECTION DISTRICT
WHEREAS, the Town of Ulysses is committed to preserving agricultural lands for agricultural purposes
and the State Legislature has by 1994 amendments to Section 305 , Subdivision 6, and Section 306,
Subdivision 5 of the New York Agriculture and Markets Law, authorized the governing bodies of local
municipalities which levy taxes for fire protection district purposes to adopt a resolution permitting the
use of agricultural assessments rather than full value assessments for the purposes of calculating such
levy, and
WHEREAS, the Town of Ulysses Agricultural and Farmland Protection Plan, adopted February 26, 2013
lists as a priority action item consideration of adopting an agricultural assessment for special district tax
levies in support of fire and emergency services, and the Town Board finds that such a use of agricultural
assessments would be advantageous in helping the farming community maintain its lands as agricultural
lands by reducing the cost of fire protection for those lands,
NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Ulysses as follows :
Section 1 . Use of agricultural assessment on lands within an agricultural district. The assessment
determined pursuant to subdivision 1 of Section 305 of the New York Agricultural and Markets Law shall
be used for purposes of calculating the benefit assessments or special ad valorem levies for the Town of
Ulysses Fire Protection District on agricultural lands within an agricultural district.
Section 2 . Use of agricultural assessments on lands outside of an agricultural district . The assessment
determined pursuant to subdivision l of Section 306 of the New York State Agricultural and Markets
Law shall be used for purposes of calculating the benefit assessments or special ad valorem levies for the
Town of Ulysses Fire Protection District on agricultural lands outside an agricultural district .
Section 3 . Applicability . The foregoing assessment modification shall apply only to agricultural lands that
have qualified for the agricultural assessment in accordance with the applicable procedures set forth in
Subdivision 1 . of Section 305 and Subdivision 1 of Section 306 of the Agricultural and Markets Law.
Section 4 . Effective Date . This resolution shall take effect as of April 10, 2013 and shall be applicable to
all assessment rolls prepared for levying of taxes in the Town on and after said date .

establishment of the Town of Ulysses Ambulance district as adopted by the Ulysses Town Board on
March 12 , 2013 and subject to permissive referendum as set forth in Town Law Article 7 and Town Law
section 209-e(3 ) . This resolution shall be applicable to all assessment rolls prepared for levying of taxes
in the Town on and after said date .

Establishing an Ag Committee
Ms . Marino presented a draft resolution with the format to establish the Ag Committee for the
Board ' s review. Ms . Marino reviewed the procedure that could be followed.
Other
Highway Superintendent Jim Meeker said that the County Highway Superintendent sent him
a letter requesting information on the infrastructure that the Town would like to see worked on.
Mr. Meeker has written a letter requesting that work be done on Perry City Rd . (from Rt. 96 to
Rt. 89) , Willow Creek Road (from Willow Creek Rd . to Kraft Rd . to Agard Rd .) , and Swamp
College Rd. (from Rt. 96 to Halseyville Rd . ) . Mr. Meeker said that these are the roads in the
worst of shape . Mr. Meeker requested a resolution from the Board in support of his letter. Mr .
Meeker read the letter into the record .

Ms . Thomas moved, seconded by Mr. Kerness the following :
BE IY RESOLVED that the Town Board of the Town of Ulysses supports the letter to
the Tompkins County Highway Director, Jeff Smith, written by Highway Superintendent
James Meeker, urging the repair of the County Roads listed in the letter.
FURTHER RESOLVED that a copy of the letter be forwarded to the County Legislator.

Mr. Meeker said that he is still looking for a backhoe and an auction is coming up in May. He is
requesting a resolution from the Board authorizing him to purchase a backhoe, if he finds one at
the auction. Also the 1972 Brockway Dump Truck is scheduled to go to the auction and would
need a resolution declaring that surplus . Mr. Meeker will supply more detail .
PRILEDGE OF FLOOR
Mr. McCann reiterated his frustration with the revision of the zoning along the lake shore and
wants to have a voice in the process . His asked the Town Board lawyer "Is it allowed and is it
proper to have Town Board, Planning Board and an employee populating the Ad Hoc Committee
to advise the Town Board; voting and making resolutions, working so these things will affect
residents who have little or no input. Isn ' t this too great of a conflict of interest. "
Ms. Geldenhuys said that the Ad Hoc Committee is not a committee that a mandatory part of the
process or revising zoning at all . This is the committee that the Town Board created completely
voluntarily as part of their process ; so there are no statutory or case law or other prescriptions as
to how such a committee is constituted and who the membership is . The committee is entirely
voluntary and advisory. The Town Board is the body that has the decision making authority to
adopt any amendment to the Zoning Law. Therefore the creation of the committee and as well
as the constitution of the membership is entirely within the Town Board ' s discretion.
Mr. McCann asked "What are the rules in interacting with the Ad Hoc Committee?"
Ms . Geldenhuys said that the Ad Hoc Committee is a committee established by the Town Board
in its discretion. There are no specific rules ; it is not a Town Board, it is not a Planning Board or
the Zoning Board or any other decision-making Board or Committee . It is an advisory
committee only. The Town Board can provide some guidance as to how it is to operate or the
committee itself can determine their own procedures . But there are no specific legal
prescriptions for an advisory body . It is not a legal conflict of interest.
The Supervisor and the Town Board expressed that they do listen to the input given by the
residents and welcome hearing from them .
Executive Session
Ms . Marino moved, seconded by Mr. Romer the following :
BE IT RESOLVED that the Town Board of the Town of Ulysses moves to go into
executive session to discuss matters related to the appointment, promotion, demotion,
discipline, or removal of particular personnel .

Change to Supervisor Compensation
Ms . Marino moved, seconded by Mr. Romer the following :
RESOLUTION OF THE ULYSSES TOWN BOARD TO SEPARATELY COMPENSATE THE
SUPERVISOR ACTING AS BUDGET OFFICE
WHEREAS , the annual salary of the Supervisor is currently $ 15 , 608 , pursuant to the notice of
hearing for the preliminary budget for 2013 ; and
WHEREAS , the annual salary for the Deputy Supervisor is currently $25 , 557 ; and
WHEREAS , the Supervisor resigned effective April 15 , 2013 ; and
WHEREAS , the Town Board needs to fill the vacancy in the position of Supervisor; and
WHEREAS , the Town Board has determined that it is in the best interest of the Town to move
funds appropriated for the salary line of the Deputy Supervisor for 2013 to increase compensation
to the Supervisor for 2013 , in order to fill the vacancy in the position of Supervisor; and
WHEREAS, Town Law § 27(4) provides that, notwithstanding the provisions of Town Law
§27( 1 ), the Supervisor may receive, in addition to any other compensation, a salary as budget
officer to be fixed by the Town Board ; and
WHEREAS , § 27(4) of the Town Law was interpreted by the Office of the State Comptroller
Opinion no . 38 of 1987 to provide that a town may, without adopting a local law, provide an
additional salary to the supervisor for services performed as budget officer, even if this additional
compensation will cause the total compensation paid to the supervisor to exceed the amount set
forth as the supervisor' s salary in the notice of hearing on the preliminary budget; and
WHEREAS, pursuant to Town Law § 103 (2), the Supervisor is the budget officer unless the
supervisor appoints another person as budget officer; and
WHEREAS , the increase in the salary of the Supervisor by transferring funds from the line
allocated to the salary of the Deputy Supervisor will not result in the expenditure of funds in
excess of what was appropriated for 2013 for salaries in the Office of the Supervisor (General
Fund budget appropriation section A 1220) ;
NOW, THEREFORE, IT IS HEREBY
RESOLVED that the Town Board of the Town of Ulysses hereby appropriates an additional
salary to the supervisor for 2013 in the annual amount of $ 14,392 for services performed as

RESOLUTION OF THE ULYSSES TOWN BOARD TO MODIFY THE 2013
TOWN BUDGET TO SEPARATELY COMPENSATE THE SUPERVISOR WHO ACTS
AS BUDGET OFFICER

WHEREAS , the Town Board of the Town of Ulysses adopted "Resolution of the Ulysses Town
Board to separately compensate the Supervisor who acting as budget officer" on April 9, 2013 ;
and
WHEREAS , said resolution specifies that additional salary appropriated to the Supervisor for
2013 for services performed as Budget Officer will not require an expenditure of funds in excess
of what was appropriated for 2013 for salaries in the Office of the Supervisor (General Fund
budget appropriation section A 1220) , and as such that any increase in the compensation of the
Supervisor will be accompanied by a concomitant decrease in the salary appropriated for the
Deputy Supervisor,
BE IT HEREBY RESOLVED that the Ulysses Town Board makes the following modification to
the 2013 Budget :
Appropriation line A1220 . 13 Budget Officer is added at $ 14, 392
Appropriation line A1220 . 12 Deputy Supervisor is decreased by $ 14, 392
These budget modifications are to take effect upon the appointment of the new Supervisor after
April 15 , 2013 .
