political subdivision of the County of Tompkins, State of New
York, its successors or assigns, a right of way to lay, maintain,
operate, and remove, water mains in -connection with the Forest
Home Water Distribution Project about to be constructed through
and across the properties of the parties of the first part,

located in said Town of Ithaca;ibetween the state highway, known
as the Forest Home Road on the;north and west, the Judd Falls
Road on the east and the McIntyre Road- on the south, the line of
such orate mains to run in a northerly direction from the so -call -,d
McIntyre Road, along a privatei)road located between the propertie
of M. F. Harrus and H. H. Whetzel on the west, and B. E. Sanford

and others on the east, and extending to the north of the north
end of said road into the property of R. H. Wheeler, there turn -
east near the north

This grant is made upon the condition that the'grantors
their heirs and assigns may fully use and enjoy their respective
premises except for the purpos s herein -above granted to said
Town of Ithaca and that the said Town of Ithaca will pay any dam-
ages which may arise to fences or other structures from the lay-
ing, maintaining, operating and ;;removing said water mains, and

service connections, said damages, if not mutually agreed upon,

to be ascertained and determine;) by three disinterested persons,
one to be appointed by the grantor affected, his heirs or assigns,
one by the Town of Ithaca, its sucdessors or assigns, and the
third by the two appointed as aforesaid, and the award of such
three persons shall be final and conclusive.'-
