The meeting was held via videoconference on the Zoom platform. Videoconference chat is saved in the appendix. Notice of Town Board meetings are posted on the Town’s website and Clerk’s board. CALL TO ORDER: Ms. Olson called the meeting to order at 7:08pm. ATTENDANCE: TOWN OFFICIALS PRESENT: Supervisor- Katelin Olson Board members- Michael Boggs, Rich Goldman, Roxanne Marino, Mary Bouchard Town Clerk- Carissa Parlato Second Deputy Supervisor- Michelle E. Wright Bookkeeper- Blixy Taetszch IT & Broadband Committee member- Linda Liddle OTHERS: Lou Vogel & Gina Cassidy- NY Stretch Code presenters APPROVAL OF AGENDA: Mr. Boggs moved that the agenda for March 22, 2022 be approved with the additions of discussion of rescheduling the emergency preparedness meeting and a zoning deficiency. This was seconded by Ms. Bouchard and passed unanimously. PRIVILEGE OF THE FLOOR: (none) PRESENTATION: Financial Review of 2021 Ms. Wright and Taetszch shared an overview of the 2021 financial year, including areas of over/under spending and actual vs. budgeted amounts spent or earned, and were excused following the presentation. NY Stretch Code Mr. Vogel and Ms. Cassidy shared a presentation on NY Stretch Code, which makes some changes to the NY State Energy Code to increase energy efficiency in commercial and residential building. It is not mandatory for municipalities to adopt a Local Energy Code, NYSERDA and NYS are working on changes to bring the state code into alignment with NYS energy and greenhouse gas reduction goals. Municipalities who opt in by June 30 will receive grant funds toward energy updates. The board asked questions and expressed concern over increased costs for building in this way as well as having enough time to let property owners know about changes to the code should the town adopt it. 2 OLD BUSINESS: Camp Barton Update No additional meetings have taken place but both Town of Covert & Village of Trumansburg have both signed the agreement to manage the property together with Ulysses. The next step is formation of a management plan. NYS will share a draft with us. RESCHEDULING ALL-STAFF EMERGENCY PREPAREDNESS MEETING RESOLUTION #64 OF 2022: RESCHEDULING ALL-STAFF EMERGENCY PREPAREDNESS MEETING WHEREAS Resolution 2022-57 scheduled the All-Staff Emergency Preparedness Meeting for April 19th, 2022, and WHEREAS the Safety Committee is recommending expanding the scope of the training to include other topics, and WHEREAS it there is a facility use conflict on April 19th, therefore be it RESOLVED that the Ulysses Town Board schedules a training meeting with all Town elected officials and staff for a date in May. Moved: Mr. Goldman Seconded: Ms. Olson Olson aye Goldman aye Marino abstain due to misunderstanding on remote participation Boggs aye Bouchard aye Vote: 4-0 Date Adopted: 3/11/22 NEW BUSINESS: CWIO 5-yr MOU Mr. Boggs noted that he was concerned that the contract stipulated that it would be automatically renewed in 5 years. He also noted that the board should consider its community contract funding amount as a whole. Ms. Marino shared that the organization is planning to work on issues that are important to Ulysses and believes that what they are doing is worthy of the amount that the town pays. RESOLUTION #65 OF 2022: AUTHORIZATION TO ENTER INTO AN AGREEMENT WITH THE CAYUGA LAKE WATERSHED INTERMUNICIPAL ORGANIZATION FOR 2022-2026 WHEREAS, the Town of Ulysses is a long-time, dues paying member of the Cayuga Lake Watershed Intermunicipal Organization (CWIO), and WHEREAS, CWIO’s purpose is to bring the local governments within the entire Cayuga Lake watershed together to work collectively and collaboratively on monitoring, protecting, and restoring the health of the watershed, and 3 WHEREAS, the CWIO agreement may be renewed for an additional five years by written agreement on or before December 31, 2026, and WHEREAS, any municipality may terminate its participation with the CWIO agreement upon 90 days written notice of the termination, now therefore be it RESOLVED, that the Town Board authorizes the Town Supervisor to sign the five-year Cayuga Lake Watershed Intermunicipal Organization Agreement, expiring December 31, 2026 on the condition that the automatic renewal clause is removed. Moved: Ms. Olson Seconded: Mr. Goldman Olson aye Boggs aye Bouchard aye Goldman aye Marino abstain due to misunderstanding on remote participation Vote: 5-0 Date Adopted: 3/22/22 SPECIAL EVENTS ORDINANCE Ms. Olson gave shared some information on this topic, noting that it has been difficult for the town in the past to approve big events in the 5 day timeline. She noted that this improves the law but does not address all of the associated issues. RESOLUTION #66 OF 2022: SCHEDULING A PUBLIC HEARING ON ALTERATIONS TO THE SPECIAL EVENTS LAW WHEREAS, on the recommendation of the Planning and Building Codes department in 2021, the Town Board considered amending the Special Events law to insure the appropriate management of applications for special events and the safety of the public attending those special events, and WHEREAS, the draft of the alteration to the Special Events law was provided by the Town Attorney, and WHEREAS, the Town Board has reviewed and discussed the draft of alterations to the Special Events law at the regularly scheduled meeting on March 22, 2022, and WHEREAS, Municipal Home Rule Law §20(5) requires that a public hearing be held before a local law is adopted by the Town Board, and the public must be informed of the public hearing with at least ten days’ notice in the Town’s official newspaper, NOW, THEREFORE BE IT RESOLVED, that the attached draft local law, the full text of which the Town Clerk is hereby directed to reproduce in full in the minutes hereof, is adopted as the draft upon which a public hearing shall be held to consider whether or not to adopt the proposed local law, and FURTHER RESOLVED, that the Town Board hereby schedules a public hearing on said draft local law for Tuesday, April 12 at 7pm. Moved: Ms. Bouchard Seconded: Mr. Boggs Olson aye Boggs aye 4 Bouchard aye Goldman aye Marino abstain due to misunderstanding on remote participation Vote: 4-0 Date Adopted: 3/22/22 Recreation Partnership Contract Update: Ms. Bouchard noted that this multi-year contract is being updated and invited the board to suggest changes. The cost to the town is $7800/year. This enables Ulysses youth to access additional recreational programs in Ithaca at a discounted rate. Zoning Deficiency: Ms. Olson noted that it has been discovered that there is no place in our zoning law that allows recreational areas. UPCOMING EVENTS: April 3 – MLK Celebration @ Trumansburg Conservatory of Fine Arts April 12 – Regular Town Board Meeting April 26 – Regular Town Board Meeting NOTIFICATION TO THE BOARD: Ms. Olson noted that the Water District Operator intends to purchase an AquaLogics Remote Alarm System for the Van Dorn Corners Tank (Water District 3). The Town of Ulysses Procurement Policy requires notification to the Town Board because of the cost ($2644). As this item was not budgeted for (although funds are available), Mr. Boggs requests more foresight in the future for items like this. APPROVAL OF MINUTES: RESOLUTION #67 of 2022: APPROVAL OF MINUTES RESOLVED, that the Ulysses Town Board approves the meeting minutes from the 3/8/22 Regular Town Board meeting and 3/11/22 Special Town Board meeting as presented or amended. Respectfully submitted by Carissa Parlato, Town Clerk 4/6/22 6 APPENDIX: Draft Town of Ulysses Amendment to Special Events Law – For Discussion Purposes Only LOCAL LAW NO. ___ OF THE YEAR 2022 A LOCAL LAW TO AMEND CHAPTER 142 OF THE CODE OF THE TOWN OF ULYSSES, ENTITLED “SPECIAL EVENTS” Be it enacted by the Town Board of the Town of Ulysses as follows: Section 1.Purpose. The purpose of this local law is to enact amend Chapter 142 of the Code of the Town of Ulysses, entitled “Special Events.” Section 2.Amendment Sections 142-2 and 142-3 of Chapter 142 of the Town of Ulysses Code shall be amended as to read as follows: §142-2 Special event permit required. A. Remains the same B. The special event permit shall be obtained at least thirty days before the commencement of the special event. §142-3 Requirements. A. Remains the same. B. No more than one special event permit per calendar year shall be issued to the same operator or for the same property. Any applications for special event permits in excess of this limit must be made to the Town Board of the Town of Ulysses. C. Remains the same. D. Remains the same. E. Remains the same. Section 3.Remainder. Except as hereinabove amended, the remainder of the Town Code of the Town of Ulysses shall remain in full force and effect. Section 4.Separability The provisions of this Local Law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words, or parts of this local law or their application to other persons or circumstances. It is hereby declared to be the legislative intent that this local law would have been adopted if such illegal, invalid, or unconstitutional provision, clause, sentence, subsection, word or part had not been included therein, and as if such person or circumstance, to which the local law or part thereof is held inapplicable, had been specifically exempt therefrom. 7 Section 5.Effective Date This Local Law shall take effect immediately upon filing with the New York State Secretary of State in accordance with Section 27 of the Municipal Home Rule Law. 8 APPENDIX I: MEMORANDUM OF UNDERSTANDING THIS MEMORANDUM OF UNDERSTANDING (“MOU”) is made effective the ___ day of ____________ 2022 by and among the Town(s) of______________________________________ and the Village of Trumansburg, each being a municipal corporation under the laws of the State of New York, each being a “Participating Municipality” and collectively the “Municipalities”. This MOU formally states the intention of the Municipalities herein named to negotiate a license to operate Camp Barton/Frontenac Point State Park, which property is proposed to be acquired by the New York State Office of Parks, Recreation, and Historic Preservation (OPRHP) from the Baden/Powell Boy Scouts Council, such license to be negotiated in advance of such proposed acquisition and effective only upon the successful closing of the proposed acquisition. The Municipalities further agree as follows: Camp Barton consists of approximately 129 acres of largely undeveloped land, including extensive waterfront on Cayuga Lake, at Frontenac Point. Barton is considered critical to providing public access to Cayuga Lake, particularly to youth organizations, and to the environment and watershed of Cayuga Lake. Accordingly, the Municipalities agree as follows: 1. Each of the Municipalities shall name no more than two but not less than one responsible person(s) to negotiate with OPRHP on behalf of their respective municipality. 2. All communications by and among members of the working group shall be reduced to writing and shall be made available to each of the Municipalities. 3. Any Municipality choosing not to join in this MOU may be later included only upon unanimous agreement of the Participating Municipalities. 4. This Memo is executed by the persons signing below, each of whom has been authorized to do so by the governing body of the Municipality joining in this Memo.
