The proposal involves subdividing 2.18 +/- acres from 221 Dubois Road to consolidate with 227 Dubois Road, Town of Ithaca Tax Parcel No. 22.-2-1.4. The project will not create any new lots. Timothy P. Dietrich, Owner; Richard Cacciotti, Applicant/Agent. Overview Mr. Cacciotti said that it is essentially a land swap with us getting 2.5 acres from my father-in-law's property that borders ours and consolidate it with our 1.6 acre parcel. Mr. Wilcox asked why there were two separate maps and Ms. Balestra responded that one of the properties is more than 10 acres in size and it is not unusual to have the surveyor not do the entire parcel due to costs. Mr. Wilcox asked if one of the maps then does not show the proposed subdivision, correct? Ms. Balestra shared her screen and showed the survey maps; one map shows a small portion of the larger lot and the other shows the proposed subdivision. Discussion followed on which map should be considered under consideration and being voted on. Ms. Balestra noted that there is no blue writing and highlighting on the plats for filing, those were added for this meeting to show the action. Mr. Wilcox said that the question is whether the map is legally sufficient. Discussion followed and it was determined that a note would be added to the survey map that a notation be made that indicates the subdivided parcel will be consolidated with the adjacent property. PB 2020-09-15 (Filed 2020-11-23) Pg. 1 Mr. Wilcox stated that he had a few issues with the survey map being that it doesn't have any surveyor's certification on it, which we have come to expect and more importantly, pins are now set to indicate boundaries and we now have software to produce more accurate surveys. Hand drawn surveys are difficult to read and check for consistencies. He thinks technology has come a long way and if requiring computer generated surveys is reasonable. Ms. Brock stated that this Board has accepted many hand -drawn survey maps and she can't say that a digital drawn map is any more accurate because the information going in controls the output. Mr. Wilcox asked if we can require the certification language. Ms. Brock said the Board can ask that the map be made more legible and that the certification language is added along with the raised seal, the location of the stream setback and that the parcel being subdivided will be consolidated with the other parcel. Mr. Wilcox asked when we can get away from hand drawn maps in this day and age and Ms. Meier Swain agreed, asking when we can make that change. Discussion followed on how to follow through on detennining how or if computer generated maps can be required. Mr. Lindquist asked if requiring computer drawn surveys would be a Planning Board action or a Town Board action. Ms. Brock responded that we would have to change our Code in the Subdivision section and that would be a Town Board action. Ms. Balestra responded that she was uncomfortable with this because there are very few surveyors left that do the hand drawn surveys and they tend to be the ones that are older and close to retirement. If someone has a piece of property that they have had in their family for a long time and a surveyor like Mr. Russler has always done their surveys, it might cost them a little less money because the survey is already on file for them to use the same surveyor. If they need to then take all those to a new surveyor who has never seen their property, they would have to spend a lot more money. Ms. Vanucchi said she agrees, saying that she worked for her father-in-law who is a surveyor for several years and we used to hand -draw our maps and an older surveyor is never going to take on AutoCAD and learn it and so we would be saying that they weren't able to be hired. She said the difference that she does agree with is between a stamped and a certified map; there is a clarification there that is important. Certification is a good additional requirement to a stamp. Ms. Fogarty asked about the location map, saying it looks as though there is another piece of property owned by the Cacciotti's (yes) and it looks like this subdivision is going to give you access to that additional acreage. Mr. Cacciotti responded that yes, that is another 10 -acre parcel of land. Ms. Fogarty said this subdivision and consolidation will then give you access to that other 1- acre parcel then? PB 2020-09-15 (Filed 2020-11-23) Pg. 2 Mr. Cacciotti responded that that is true and is another reason for the current request. That other 10 - acre parcel will be left as it is and not be consolidated. Mr. Thaete asked when the legal description comes into play? The map is great, but the legal description is what really counts for an engineer. Ms. Balestra responded that we do not require that. SEQR Determination Ms. Meier Swain asked about the EAF Mapper and it not showing all the parcels. Ms. Balestra responded that the State's database is not up to date and doesn't show a subdivision that has happened. Ms. Fogarty asked about the Black Diamond Trail not being listed Ms. Meier Swain responded that that is about 2 miles down from this property and she wouldn't consider that "close." PB Resolution 2020-017 SEQR Preliminary and Final Subdivision Approval Dubois Road Subdivision/Consolidation 221 & 227 Dubois Road Tax Parcel No.'s 22.-2-1.2 and 22.-2-1.4 Town of Ithaca Planning Board, September 15, 2020 Whereas: 1. This is consideration of Preliminary and Final Subdivision Approval for the proposed subdivision of 221 Dubois Road, Town of Ithaca Tax Parcel No. 22.-2-1.2, Low Density Residential Zone. The proposal involves subdividing 2.18 +/- acres from 221 Dubois Road to consolidate with 227 Dubois Road, Town of Ithaca Tax Parcel No. 22.-2-1.4. The proj ect will not create any new lots. Determination Ms. Meier Swain reiterated the changes discussed above regarding the survey and Ms. Brock drafted the language. PB Resolution 2020-018 Preliminary and Final Subdivision Approval Dubois Road Subdivision/Consolidation 221 & 227 Dubois Road Tax Parcel No.'s 22.-2-1.2 and 22.-2-1.4 Town of Ithaca Planning Board, September 15, 2020 Whereas: This is consideration of Preliminary and Final Subdivision Approval for the proposed subdivision of 221 Dubois Road, Town of Ithaca Tax Parcel No. 22.-2-1.2, Low Density Residential Zone. The proposal involves subdividing 2.18 +/- acres from 221 Dubois Road to consolidate with 227 Dubois Road, Town of Ithaca Tax Parcel No. 22.-2-1.4. The project will not create any new lots. Revision of the survey plat as follows: 1. to show the approximate 35 -foot stream setback, measured from the centerline of the stream that runs through both properties (south property boundary at 227 Dubois and northern portion of property at 221 Dubois); 2. to show the parcel will be conveyed with TP 22.-2-1.4; 3. to add a surveyor's certification as required by Town Code, Section 234-37; 4. to make all information legible b. Submission for signing by the Chairperson of the Planning Board of an original and three dark lined prints of the approved final subdivision plats, revised per condition "a" above, prior to filing with the Tompkins County Clerk Office, and submission of a copy of the receipt of filing to the Town of Ithaca Planning Department; and c. Moved: Yvonne Fogarty Seconded: Chris Biehn Vote: ayes — Biehn, Wilcox, Meier Swain, Lindquist, Kaufman, Fogarty and Vanucchi Agenda Item 2 Consideration of a recommendation to the Town of Ithaca Town Board regarding proposed changes to the Official Map of the Town of Ithaca. Overview Mr. Thaete stated that there is a list of the changes being suggested. About once a year, the Public Works Departments looks at the map to add any roads that have been constructed and review any anomalies or issues that have come up. PB 2020-09-15 (Filed 2020-11-23) Pg. 5 With having a GIS person now, one of the first tasks for him was to take an indepth look at the map as a whole and work with the Planning and Codes Departments to put together a list of items to change. Mr. Thaete went through the list of changes by category: Town Roads mostly naming and spelling errors and the abandonment/discontinuance of certain roads that became private roads. Private roads - which are essentially driveways, was done to satisfy 280a requirements that require road frontage to get a building permit. Ms. Brock explained the process for discontinuing a road and most commonly they are road termis' as in the Winston Court recent sale. The town has questioned for a while why some of these were listed as roads but acted like a driveway or a dead end turn around. Cornell and Ithaca College roads were added; we looked at the original town map which showed some and not others, and so we looked at them all and if there is a structure on the road, the road was added and indicated as private roads. Mr. Wilcox asked about Pigeon PI and Mr. Thaete explained that the Town has an easement on the driveway to access the landlocked parcel where we have a water tank. The road was named to satisfy 280a requirements as a private road. Ms. Brock suggested that the road not be added until the completion of the easement paperwork for access to the road. She said she would push them for that paperwork. Mr. Thaete responded that this is a slightly difficult one, because we want to name the road to satisfy 280a and it meets our criteria as having a structure on it, but it is Cornell land with an easement to the Town to access it and a revision of an easement to get to it through another property. Mr. Thaete will discuss with counsel and address the issue. Other roads which are roads that may have City addresses but look like they are in the Town; some parcels cross municipal boundaries so an address is on a City road but is shown on the Town Map. An example is Hudson St which has a parcel with that City road address, but a piece of the parcel is in the town and to show that parcel, it seemed to make sense to show its legal road address name. Same with a parcel on a boundary which may have a structure on the frontage of a City street but another side on a road within the Town. Ms. Brock suggested adding a statement that the dashed line is the Town of Ithaca boundary. Agreed. Parks, preserves and trails were added Mr. Thaete explained that there were two emails with suggested changes under this category; one from Ms. Brock and one from Mr. B Brittain. PB 2020-09-15 (Filed 2020-11-23) PC' 6 Mr. Thaete said they worked with the Planning Department and one of the biggest changes is to the Culver Rd preserves being renamed as the whole preserve being the Culver Road Preserve with the individual named areas having their own signs, but the map indicating just the larger named preserve. Mr. Brittain's comments were regarding a portion of Bluegrass Ln which was removed because it didn't meet our criteria of having a structure on it. The Brittains are concerned that it shows up on another map that identifies it as a prioritized future pedestrian corridor and they didn't want this change to affect any legitimacy of that designation. Mr. Thaete responded that the Official Town Map is notused for that type or purpose and the possible pedestrian corridor is not on the horizon. The next comment was regarding a portion of Comstock Knoll Dr which has the entrance to the Nevins Center on it now and made that loop non-active and blocked so it doesn't really exist anymore. Mr. Coakley explained that there is an address on Hosta Dr which is part of the loop and the Nevins Center so both meet our criteria as having a building on them and therefore being shown. Some discussion followed and Mr. Thaete said they will do another site visit with the concern in mind and make a determination. The key is that the map reflect what is currently inexistence on the ground. Mr. Wilcox added that it is his understanding that the colleges worked with Mr. Bates to name private roads and access driveways to facilitate emergency response. Mr. Thaete turned to Ms. Brock's email which raised a concern about roads that function as driveways being labeled as driveways. Mr. Thaete said they are not labeling anything a driveway and these are internal circulation drives that service different buildings and function as roads and we have them labeled as private roads. Ms. Brock said her question is that if they function as driveways, they shouldn't be labeled or shown. Mr. Moseley said the word "driveway" to him seems to indicate that it is less than a road and in this circumstance, they are constructed to the standard of a private road and meet the minimum standards of the Fire Code for access roads. Ms. Brock asked if they have names and Mr. Moseley thought they haven't changed as far as he is aware. Mr. Thaete added that Cornell has actually added curbing and drainage in some of those areas. Ms. Brock was satisfied with the answer. Mr. Thaete turned to the last comment from Ms. Brock which was about the colors and a request to make them more distinctly different and Mr. Coakley said he will look at differentiating colors of the roads and names and boundaries. Ms. Brock asked if the trails will be labeled as well as shown. PB 2020-09-15 (Filed 2020-11-23) Pg. 7 Ms. Ritter responded that it could go either way but her concern was clutter. This is a road(s) map, not a recreation map, and if everything is labeled, it may be too cluttered and distract from the town roads, especially in the Northeast where there are a lot of walkways. Some discussion followed and it was noted that there is another Parks and Trails Map that shows all of them. Ms. Brock had an additional comment; asking how Farview Dr. come about because if it was done during a subdivision, it is supposed to be shown. NYS Town Law Section 279 actually says that any road identified during the subdivision approval process are to be shown on the Town Map. Mr. Thaete responded that there are many roads that went through subdivision approval and never been built, think Holochuck, so the distinction we made was that it goes on the map once it is built. Same with the Westview subdivision and Larisa Ln; there is a Phase 4, but that is 14 years old and not shown because it isn't built yet. Ms. Brock said she will review NYS Law regarding subdivision and roads and discuss this with Mr. Thaete. Mr. Moseley said that they had a big discussion on this and what are commonly termed "paper roads" and that can cause issues with someone wanting a building permit when a road isn't built. Ms. Ritter added that the Town has a right-of-way at the end of Bundy Rd granted during subdivision, that maybe should be shown. Discussion followed and staff and counsel will research what other municipalities do in subdivision instances regarding "paper roads" and ROWS and their depiction on maps. Public Hearing The resolution was moved, seconded and voted on and then it was noted that the public hearing wasn't opened and closed. Motion to rescind the resolution was made by Mr. Biehn, seconded by Ms. Fogarty; unanimous. Ms. Meier Swain opened the public hearing at 8:22 p.m.; there was no one present on the Zoom and the Town Clerk reported no contact by the public during the meeting, and the hearing was closed. Motion to reinstate the resolution; moved by Ms. Fogarty, seconded by Mr. Biehn, unanimous. Determination PB Resolution 2020 - 019: Recommendation to Town Board Regarding Proposed Modifications to Official Map Town of Ithaca Planning Board September 15, 2020 PB 2020-09-15 (Filed 2020-11-23) Pg. 8 Whereas, Section 270 of NYS Town Law authorizes the Town Board to establish an official map of that part of the town outside the limits of any incorporated city or village showing the streets, highways and parks theretofore laid out, and may also show drainage systems; and 2. the current Official Map of the Town of Ithaca was last updated in 2019; and Section 273 of NYS Town Law authorizes the Town Board to change or add to the official map of the town so as to lay out new streets, highways, drainage systems or parks, and any such change or addition to the Official Map must be referred to the Planning Board for a report thereon; and 4. the Director of Engineering has prepared a draft proposed revised Official Map for 2020; and the Town of Ithaca Public Works Committee of the Town Board discussed the draft revised Official Map, as described above, at its meeting on August 18, 2020, and referred the proposed changes to the Official Map to the Planning Board for a report and recommendation; and 6. the Town of Ithaca Planning Board reviewed the draft Official Map and held a public hearing on the draft Official Map at its meeting on September 15, 2020; Now, Therefore, Be It Resolved, that the Town of Ithaca Planning Board hereby recommends that the Town Board adopt the proposed revised Official Map with the changes shown on the draft and with the additional changes as reflected in the minutes of the September 15, 2020 Planning Board meeting. Ms. Meier Swain stated that it looks like a round -a -bout driveway just happened over time. Mr. Wilcox noted that minor lot line adjustments are within the purview of the Town Engineer and Mr. Thaete added that he always consults with the Planning Department. Resignation — Chris Biehn announced that he is moving to Rochester next week and has submitted his resignation effective after this meeting. He said he really enjoyed working with everyone and the town of Ithaca.
