Monday, October 19, 2020 at 5:30 p.m.
Due to the extension(s) of NYS Executive Orders associated with the COVID-19 Pandemic and

Board Members Present: Rod Howe, Supervisor; Members Eric Levine, Rich DePaolo, Bill
Goodman, Tee -Ann Hunter, Pat Leary and Pamela Bleiwas

1. Call to order and Pledge of Allegiance
Mr. Howe opened the meeting at 5:30 p.m.
2. Persons to be heard and board comments
Several people read prepared statements and spoke against 5G coming to the Town and urged the
Board to do everything it could to stop it. Main concerns were health related and the unknown
and known effects of the technology.
Mr. Molinar read a lengthy statement which subsequent speakers echoed and agreed with.

Danny Fox addressed the Board saying that he has been very sick and after much research, he
discovered that it is due to exposure to radiation waves and he uses a meter to detect the strength
and levels to monitor his exposure and health. He has found 200X's higher than what is
considered safe at small cell transmitter locations. He described his symptoms and the effects of
exposure. He stated that he sent a summary to the Board and a research paper.
Sheila Out spoke, saying that she agreed with everything Mr. Molinar said and she would like to
comment on Verizon's motive. She said if they were out to serve people, they would put up
towers where there is no service, but what they are doing is trying to promote 5G with deals on
new phones and saying that users will be able to download videos at "lightning speed" which we
don't need, but they try to convince us we do and we need new phones.

Neil Golder spoke, saying that he didn't have a lot to add; they covered it quite well. We have
alternatives such as fiber optic or cable which is much safer and doesn't have the health
detriments of 5G.
Rebecca Holland spoke, saying she is also concerned with 5G and especially for her kids. The
WHO labels it as a Class 2A cancer risk and the American Society of Pediatrics recommends
that the government limit exposure. She would like to see limitations on their locations and
require distances from elderly and the young and require proof of necessity, remove redundant
towers, limit times they run, and minimum strength needed.
Jerome Galiano spoke saying he is an engineer focused on green building and he is concerned
with the proliferation that the City is facing right now and it seems like it will come to the Town
next. From an energy point of view, it will increase the gas emissions in the City by 16% and the
Town by 20% and it is unclear how it is going to benefit us residents. It will not provide
internet, and that is where the focus should be.
He said, we have to be careful and make sure we protect ourselves and keep them away from
public schools and residential areas. Right now, it can be 8' feet away from my house and my
son's bedroom window. That is ridiculous. He would like any possible agreements that might
have to go into place to have no restrictions on liability.
Mr. Galiano said appreciates the Town listening.
Mr. Howe and Ms. Rosa attempted to invite two other phone-in callers to speak but could not get
an answer.
Ms. Rosa read an email she received during the meeting from Irina Perez who expressed the
same concerns as previously stated. She wanted the Town to stop the installation of 5G cell
towers and referenced the same concerns as above.
Mr. Howe thanked everyone for speaking and said we are talking with the City regarding the
attorney, Mr. Campagnelli, and our Codes and Ordinances Committee continues to work on this
and what we can do by law.

3. Public hearings regarding:
a. A proposed increase to the Town of Ithaca Water Rates and Sewer Rents Effective
January 1, 2021
Mr. Howe opened the public hearing at 5:53 p.m.; there was no one wishing to speak on the topic
and the Town Clerk noted for the record that she had not received any comments prior to or
during the public hearing period via phone or email. The hearing was closed.

Mr. DePaolo asked that the increase be spelled out in the resolution. Agreed.
TB Resolution 2020 - 136: Increasing Sewer Rents in all of the Town of Ithaca Sewer
Improvement Areas Effective January 1, 2021
Whereas, the Town Board of the Town of Ithaca wishes to revise the sewer rent schedules for all
of the Town of Ithaca Sewer Improvement Areas; and
Whereas, a public hearing, duly advertised and posted as required by law, was held at 215 North
Tioga Street, Ithaca, New York on the 19th day of October 2020, and the public was permitted an
opportunity to be heard on the proposed increase; and
Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
adoption of the proposed resolution is a Type II action because it constitutes "routine or continuing
agency administration and management, not including new programs or major reordering of
priorities that may affect the environment," and thus this action is not subject to review under
SEQRA; now, therefore, be it
Resolved, that the Town Board of the Town of Ithaca hereby establishes and imposes the
following:
(1) Effective January 1, 2021 there is hereby imposed a sewer rent payable by all users connected
to the Town -wide sewer system at a rate of $5.34 (was $5.16) per 1,000 gallons of water consumed.
In addition, and notwithstanding the foregoing rate structure, there shall be a minimum base charge
for regular quarterly bills sent on or after January 1, 2021 in the amount of $26.70 (was $25.80),
which minimum charge is based on 5,000 gallons of usage, regardless of whether that amount is
actually used.
Multiple housing and mobile home parks of over two dwelling units, using a master water meter,
will be computed as follows: The quarterly master water meter reading will be divided by the
number of dwelling units and the sewer rent charge will be figured on this number as if the unit
was individually metered. The sewer rent will then be multiplied by the number of units on the
master water meter and this will be the billing rendered and the amount payable. If the calculation
of the water consumed per dwelling unit is less than the amount that would be permitted before
exceeding the minimum sewer rent set forth above, then the billing will be calculated by
multiplying the number of units served by the master water meter times the minimum sewer rent
set forth above.
The charges set forth above shall be effective with respect to bills rendered on or after the effective
dates set forth above, even if the measurement is for consumption prior to the above effective dates
(i.e., any bill rendered on or after January 1, 2021, shall be calculated at the 2021 rate even if the
sewer use occurred prior to January 1, 2021).
In the event a property is connected to public sewer, but is not connected to a water meter, the

sewer rent shall be based upon estimated water consumption as reasonably determined by the
Director of Public Works based upon recognized methods of estimating typical consumption for
the type of facility involved (e.g., gallons per day per bedroom).

TB Resolution 2020 -1.37: Increasing Water Rates Chargeable to Consumers of Water in
the Town of Ithaca Effective January 1, 2021
Whereas, the Town Board of the Town of Ithaca wishes to revise water rate schedules for a I 1
o f the Town of Ithaca Water Improvement Areas; and
Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and
its implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board
that adoption of the proposed resolution is a Type II action because it constitutes "routine or
continuing agency administration and management, not including new programs or major
reordering of priorities that may affect the environment," and thus this action is not subject to
review under SEQRA; Now, therefore, be it
Resolved, that the Town Board of the Town of Ithaca hereby establishes a water rate of $8.26 per
1,000 gallons of water consumed (up from $7.97) with the following water rate schedule:
WATER RATE SCHEDULE
Effective January 1, 2021
The rate charged for water consumption shall be $8.26 per 1,000 gallons of water consumed. The
foregoing rate will be the rate charged for all regular quarterly bills sent on or after January 1,
2021. Actual or base consumption may occur prior to January 1, 2021.
Notwithstanding the foregoing rates, the following minimum base charges shall be applicable
to the meter size indicated below for regular quarterly bills issued on or after January 1, 2021.
The table below also shows the amount of water consumption that is permitted before the minimum
base charge would be exceeded:

Multiple Housing and mobile home parks of over 2 dwelling units, using a master meter, will be

dwelling units and the water charge will be figured on this number as if the unit was individually
metered. The water charge will then be multiplied by the number of units on the master
meter and this will be the billing rendered. If the calculation of the water consumed per
dwelling unit is less than the allowable consumption for a three-quarter inch meter, then the
billing will be calculated by multiplying the number of units on the master meter times the
minimum charge for a three-quarter inch meter.
The water application fee for each new application for water service shall be the charges for new
water connections charged by the Southern Cayuga Lake Intermunicipal Water Commission
including application fees, meter charges, service tap fees, inspection fees, accessory materials,
installation costs, and any other fee or cost charged by the Southern Cayuga Lake
Intermunicipal Water Commission for connecting new water services.
An annual charge for each fire protection main serving a fire suppression system will be billed
along with the first quarterly water bill of the calendar year. The annual charge for this service
shall be $20.00 per diameter inch of the pipe supplying the fire suppression system or such
other amount as is charged by the Southern Cayuga Lake Intermunicipal Water Commission
for such systems. The pipe supplying the fire suppression system is the pipe needed to supply
the fire suppression system, installed downstream of the system control valve.
In addition to any other charges due to the Southern Cayuga Lake Intermunicipal Water
Commission or the Town, there shall also be a charge of $151.00 for disconnecting and
reconnecting water service where water service has been disconnected pursuant to Town Code
§ 261-4 for failure to pay water rates or other charges.

Mr. Howe opened the public hearing at 5:54 p.m.; there was no one wishing to speak on the topic
and the Town Clerk noted for the record that she had not received any comments prior to or
during the public hearing period via phone or email. The hearing was closed.
c. Pulled Adoption of the New Neighborhood Code
4. Discuss and consider approval of wages effective January 1, 2021 for: Town of Ithaca
and Southern Cayuga Lake Intermunicipal Water Commission (Bolton Point)

TB Resolution 2020-134: Approval of 2021 Employee Wages Town of Ithaca
Whereas, the governing Town Board of the Town of Ithaca has reviewed the proposed wages for
the Town of Ithaca non -collective bargaining employees for the year 2021, utilizing the 2.75%
wage scales approved by the Town Board August 10, 2020; and
Whereas, the Town Board has reviewed the wages established by the collective bargaining
agreement with the Public Works unit represented by Teamsters Local 317; now, therefore, be it
Resolved, the Town Board of the Town of Ithaca does hereby approve the said wages for the non -
collective bargaining employees and collective bargaining employees for 2021, as filed in the
Human Resources Office.

TB Resolution 2020 -135: Approval of Southern Cayuga Lake Intermunicipal Water
Commission Non -Collective Bar2ainin2 Wale Scale and Employee Wages for 2021
Whereas, the governing Town Board of the Town of Ithaca has reviewed the proposed wage
scale and wages for Southern Cayuga Lake Intermunicipal Water Commission's (Commission)
non -collective bargaining employees for the year 2021 at a 2.00% cost of living adjustment; and
Whereas, the Commission is in the process of negotiating with the UAW for a new contract, so
there will be no change in wages until the contract is approved of for those employees, except
hire to job step increases; and
Whereas, the Commission approved of the non -collective bargaining employee wage scale and
wages for 2021 at their October 8, 2020 meeting; now, therefore, be it
Resolved, the governing Town Board of the Town of Ithaca does hereby approve the SCLIWC
2021 wage scale and wages for the non- collective bargaining employees as detailed on the
attached sheet.

5. Discuss and consider the Town of Ithaca 2021 Preliminary Budget
Mr. Howe noted that Mr. Solvig sent out additional information regarding the telephone budget
lines and thanked him for that information. He asked if there were any questions or discussion
items. There were none.

Whereas the Town Board held a public hearing on Monday, October 19, 2020 to hear comments
regarding the Preliminary Budget, and
Whereas the Town Board discussed the preliminary budget, now therefore be it
Resolved that the Town Board of the Town of Ithaca hereby approves and adopts the 2021
Preliminary Budget as the Final 2021 Town of Ithaca Budget.

6. Discuss and consider setting a public hearing regarding the adoption of the revised
Official Town Map
TB Resolution 2020 - 139: Setting a Public Hearing Regarding Changes to the Official Town
Map
Whereas, Section 270 of NYS Town Law authorizes the Town Board to establish an official map
of that part of the town outside the limits of any incorporated city or village showing the streets,
highways, and parks theretofore laid out, and
Whereas, the Public Works and Engineering Departments, in consultation with the Codes and
Planning Departments, have prepared a revised Official Town Map (Map), dated October 14, 2020,
incorporating and showing proposed changes to the 2019 Official Town Map; and
Whereas, the Town of Ithaca Planning Board held a public hearing and reviewed the draft version
of the Map at its meeting on September 15, 2020, and
Whereas, the Planning Board recommended via PB Resolution 2020-019, that the Town Board
approve of and adopt the revised Official Town Map with changes as discussed during their
meeting, and
Whereas the Town Board received the Planning Board minutes detailing the discussion on the
revisions and the Town Engineer has made said changes, now therefore be it,
Resolved, that the Town Board of the Town of Ithaca hold a public hearing at the Town Hall, 215
N Tioga Street, Ithaca, New York, on the November 9, 2020 at 5:30 p.m. (under Governor
Cuomo's Executive Order Extension(s) regarding health and safety efforts associated with COVID
19 and suspension of certain aspects of Open Meetings Law, it is highly likely the public hearing
will be held via ZOOM) for the purpose of hearing public comment(s) regarding the proposed
changes to the Map

Mr. Howe noted that there is no resolution for this, just an annual acknowledgement of the
inspection reports conducted and prepared by Michael Smith, Planner.
8. Discuss and consider approval of the Amended Municipal Cooperation Agreement
(Tompkins County Health Consortium) and authorization for the Supervisor to sign
We are now a 16 -County consortium and those changes are reflected in the 2020 amendment.
The 2021 reflects changes in the voting structure and the establishment of an Executive
Committee, which is an 11 -member board that will meet monthly for the general operations of
the Consortium.
Ms. Drake explained that every year when the Consortium accepts new members, it will have to
be approved and signed off by each municipal partner in the Consortium, otherwise, the
Agreement is reviewed and approved every five years.
TB Resolution 2020 - 140: Approval of the 2020 and 2021 Amendments to the Municipal
Cooperative Agreement for the Greater Tompkins County Municipal Health Insurance
Consortium
Whereas, the Town of Ithaca is a Participant in the Greater Tompkins County Municipal Health
Insurance Consortium (the "Consortium"), a municipal cooperative organized under Article 47 of
the New York Insurance Law, and
Whereas, the municipal participants in the Consortium, including this body, have approved and
executed a certain Municipal Cooperation Agreement (the "Agreement"; effective date of October

Mr. Howe noted that there is one vacancy on the Planning Board for a regular membership. Mr.

Board and Ms. Drake and Ms. Ritter as staff support. Board agreed.
Ms. Hunter asked how the vacancy is advertised and Ms. Rosa went through the various lists and
contacts she uses to get the word out that there is an opening, including Town social media, local
news outlets and our newsletter.
10. Discuss and consider promotional appointment of Finance Officer
Mr. Howe and Ms. Drake reported that the Interview Committee had five applicants and chose
two to interview. One applicant pulled out at the end because he took another position, and the
committee interviewed our internal applicant.
There was no discussion on the action. Mr. Howe congratulated Ms. Shaw.

TB Resolution 2020 - 142: Approval of and authorization to execute water and sewer
easements associated with an approved subdivision on King Road East
Whereas, the Town of Ithaca Planning Board granted Final Subdivision Approval on November
19, 2019 for TP 45.-2-8 located at 237 King Rd East (formerly 202 Troy Rd) to be subdivided
into two lots, and
Whereas, the two parcels (Parcel A and Parcel B) are buildable lots, and a residence exists on
Parcel A, and
Whereas, the Town of Ithaca owns and maintains or plans to install municipal water and sewer
infrastructure on Parcel A that serves or facilitates the provision of municipal water and sewer

12. Discuss and consider a resolution in support of an Over Budget Request to the
Tompkins County Legislature for a Broadband Study
Mr. Howe reported that four other municipalities have already passed similar resolutions with the
$5k contribution toward the effort and Ms. Kelles from the County has stated that a person has
already been identified to assist with this effort.
Mr. DePaolo asked about the reference to Fujitsu but we don't explain what they would be
doing.
Mr. Howe responded that he did sit in on a call regarding this, and we can add a short description
to the resolution if that is ok with the Board. Agreed.
Ms. Rosa noted that Ms. Dimas just sent a chat saying that the County unanimously approved the
request.
TB Resolution 2020 - 143: Town of Ithaca support for and financial assistance for an over
the target budget request to the Tompkins County Legislature regarding funding a
Broadband Planning Study
Whereas COVID-19 has highlighted a lack of adequate broadband access to residents and
businesses in our rural communities; and
Whereas this lack of broadband access impedes the ability of our residents to do work, attend
school, have medical appointments, run their businesses, and have virtual face-to-face
conversations with loved ones; and
Whereas access to broadband services is not a luxury but a necessary public need that must be
addressed; and

Whereas the model for broadband buildout up until now has been that Internet Service Providers
(ISPs) get grant funding from the state or federal governments to build a system that the ISP
owns and controls; and
Whereas municipally owned internet services can better serve the public interest and a collective,
regional approach is not only possible and logical, it is already happening in many counties
around us through a regional partnership with a municipally -owned non-profit open access fiber
network cooperative, Southern Tier Network (STN), established in 2011, and
Whereas STN has developed and successfully maintained over 500 miles of fiber across the
Southern Tier of New York, with lines extending through Schuyler, Chemung, Steuben, Yates,
Tioga, Broome, and Tompkins County and increased competition to provide services and is
working to explore solutions to reach more rural areas in the Southern Tier, and
Whereas STN is currently working with a research company, Fujitsu, to study the feasibility of a
similar program in our area, and the proposal is for Tompkins County to join the study and
establish clear guidelines and deliverables to provided needed information to STN to explore
possible funding/grant avenues and explore other options the County may be able to pursue as
well as realize cost savings, if pursued, by being part of the existing base study, and
Whereas Legislator Anna Kelles is proposing a one-time, over -target budget request for a
broadband study, now, therefore be it
Resolved that the Ithaca Town Board asks the County to support the budget request and commits
to a one-time contribution of $5,000 payable to Tompkins County in 2021 if the budget request
is approved and the study is undertaken.

Mr. DePaolo asked what the impetus is for removing the hard copy records when the digital
version has been named the "official" town record. He said he took a tour today and space is not
an issue and won't be given we are not generating or keeping hard copies as we move forward.
He also asked if there are any discrepancies noted in verifying the records that have been
scanned.
Mr. Howe noted that this is separate from the next item, and this item is just to adopt the revised
State Retention Schedule which has been renamed the LGS-01 Schedule.
Mr. DePaolo deferred to the next agenda item.

14. Discuss and consider approval of the revised Records Management Policy
Mr. Howe asked Ms. Rosa to respond to Mr. DePaolo's question and give an overview.
Ms. Rosa said that in her mind, it is a mindset issue and moving forward with digitization. If a
record were to be found on someone's desk and they filed it downstairs out of habit without
adding it to the digital record, the records wouldn't match.
She felt that it is an important step to move forward with changing the mindset and procedures to
digital and to ensure that everyone is looking at the same record.
Mr. DePaolo said he thought the "going digital" is not under contention, but there is some
discrepancy on whether the verification of the scanned records has happened in accordance with
the State requirements. He added that he is all for digitization, but if we are anticipating a
discrepancy, that is more reason to keep the hard copy record.
He asked Ms. Rosa to explain how an issue could arise.
Ms. Rosa said that her concern is the habit and inclination to file instead of scanning it and the
procedure and policy being proposed includes Department Head authorization for destruction
once they feel comfortable moving forward with that.
She said that the verification of the bulk scanning we had done under the Shared Services Grant
was done according to the Vendor Verification Requirements put out by the State. Those include
a 25% verification check of each batch. The grant had the County doing that check, but
Challenge also did it, and the County and then she and her deputy did.
Mr. DePaolo asked if there is any indication that digitizing isn't happening? It seems that it will
become the new normal as we move along, and this is just a particular group of records that has
its own space, and he couldn't imagine someone filing something downstairs without scanning.

Ms. Rosa said when this started, the assumption was that we were going to destroy the records
and she has based everything that she has done for the past 5 years on that assumption and she
didn't want to move them again if that assumption was true.
Mr. DePaolo said he understands that, but there is some discrepancy on whether the State
guidelines have been followed and he would feel better about it if that was cleared up.
Mr. Howe said the RMAB has discussed this and we have added additional checks and balances
for the Department Head to authorize destruction.
Ms. Hunter turned to the packet of information and noted that the Retention Schedule requires
100% page -by -page verification and the records have not been done to that level due to a
miscommunication between the State, County and the Town.
Ms. Hunter said she has spoken to the State Archives and we have records that went through the
grant process and we have not done the verification required and we have the space.
She said there is no need to look back, but we shouldn't continue with something that we now
know was incorrect.
Ms. Hunter went through the proposed Policy and the Procedures as submitted at length.
Ms. Hunter recommended that the RMAB meet more than twice a year and suggested at least
quarterly and possibly every other month at this point.
Ms. Hunter asked about the word "removal" and suggested "destruction."
Ms. Hunter asked about the Addendums which go with the Procedures and wanted the fact that
vendors are not allowed to do verification added to the Procedures.
Ms. Hunter asked about the standardization items listed and Ms. Rosa responded that those are
the ones we use so far, and more could be added but the addresses are from the Postal Service
best practices and the others are the same as what we have historically done, going back to the
Town's original ACCESS database.
Ms. Hunter asked about the Appendix D regarding Vendor Verification and where it came from.
Ms. Rosa responded that it is from the NYS Archives Digital Archives Recommendations for
Digital Scanning section of the MU -I Schedule.
Ms. Hunter asked if the intent is to approve this Policy to authorize the shredding of the ill-
advised initial project?
Ms. Rosa responded that yes, because she has included the NYS SARA form for Records
Destruction with Department Head approval which came from Mr. Martin.

Ms. Hunter asked if that means we would be shredding Town Board minutes and Local Laws
and the boxes in the basement? And has that already happened?
Ms. Rosa responded that a few years ago the Town Board approved destruction of records and
some were before the State notified us of the verification requirements and we stopped.
Ms. Hunter said it has always been the practice that the Town Board approves the disposition of
records, not department heads and is that in the Policy?
Ms. Rosa responded that the State does not require Town Board approval, but prior policies did.
Mr. DePaolo asked if it has always been the purview of the Town Board to authorize destruction
and we are delegating that is it just something that was just tradition?
Ms. Hunter said it is the purview of the Town Board.
Ms. Rosa responded that she has never found that requirement in any State regulation, but we
have historically.
Mr. DePaolo asked if we could as Ms. Brock to weigh in on that.
Ms. Brock responded that she would have to research that.
Mr. Levine said he wanted to be clear that the electronic records are the official record of the
Town so we are talking about getting rid of records that are not official records and although he
agrees there is some historical value to some of these records and it is worth discussion, these
concerns were not raised at the RMAB meeting and maybe we should go back and discuss it.
Ms. Hunter said it is not that they are not the official record, but the digitized records have not
been verified.
Mr. Howe called the question because we have discussed this for quite a while many times.
Motion was moved by Mr. Levine, seconded by Mr. Howe.
Ms. Bleiwas asked if we have met the requirements of State law in terms of verifying what we
have digitally is what we are proposing to destroy.
Mr. Howe said that is a matter of opinion and Ms. Hunter responded that it is not; we have not
met the requirements of the State due to miscommunication at the State, County and Town level.
Ms. Bleiwas asked if we could do that and Ms. Rosa said we could, but we have over 1.5M
pages of scanned records and it would take quite a long time and she thought it was
unreasonable.

Ms. Bleiwas asked what would happen if we did not.
Ms. Hunter responded that we would not be following the guidelines of the State Records
Schedule which we have just adopted.
Ms. Bleiwas asked if Ms. Brock had an opinion and Ms. Brock said she could not voice an
opinion without doing some research.
Mr. Goodman said that he did sit in on the RMAB and we do have space in the basement so why
not just put them in an unused room. Going forward, we should ask departments to go through
them before they are shredded. He wouldn't want it to be left so in 20 years or so a future board
or staff has that burden. He added that he is going through that right now due to a move, and he
would rather do it now than leave it with someone else.
Mr. Goodman said he believes the proposed policy has the department head authorizing the
destruction when they are comfortable with the verification of their records.
Ms. Leary said she would rather take the time now and if the State wants us to verify every page
and there is a conflict in what our understanding is, she would rather be cautious.
Mr. DePaolo asked about the scanning process and said he assumes a batch were sent through at
one time, not page by page, and he has seen when pages stick together or are missed so he would
be more comfortable making sure the pages are there.
Mr. DePaolo said we went out of our way to facilitate the storage of paper records for another
entity and so he doesn't understand why there is a rush to get rid our ours.
Ms. Hunter asked for clarification on who can give permission to dispose of records and how
does that relate to electronic records.
Mr. DePaolo went back to Mr. Levine's comment and asked if the digital record actually is the
official record, if it hasn't been verified to the level in the guidelines.
Ms. Rosa responded that we have moved forward since the beginning of this project under the
assumption that the quality control at the three levels with less than a 3% error rate was
acceptable and approved. There are certain records that could be page counted, but in my mind,
we have met the guidelines and we just need to know which way to go. She added that she is
still checking records such as building permits, and whether there was a folded -up map that
could have been missed. If two pages were stuck together; that may happen, and you have to
decide if that raises to a level of such concern to check each and every page.
Mr. Howe said we are voting on the policy that says the RMAB will meet quarterly and the
RMAB will look at the issue again, but ....
Ms. Brock said the question has been called and that ends discussion.

16. Report of Town Officials
Mr. Howe reported on the COVID positive at Public Works and the steps the Town took
following that. There will be slight changes coming to the Board for an update to the COVID-19
Policy which will be going through P&O at their next meeting.
The changes are that you will need to wear a mask in conference rooms regardless of social
distancing and reinstating the temperature check each morning.
Mr. Howe added that the positives were traced to a non -work event and not through a workplace
contact.
Ms. Leary said she was hoping the protocol would be changed for masks being required outside
regardless of distance also. She felt there should be more emphasis on wearing masks at all
points.
Mr. Slater responded that crews are supposed to be wearing a mask when they cannot maintain
social distances and whenever they are in a town vehicle.
Mr. Howe thanked Ms. Drake and Mr. Slater for their work and efforts in moving through this
incident and process and added that the County Health Department has not suggested we change
anything and said we are doing all the right things.

Mr. Goodman reported that Codes and Ordinances did not meet this month because he wanted to
wait until his conversations with the City and other municipalities regarding 5G and there was a
special STR Committee meeting to seek the advice of counsel and the next open meeting will be
next month before the regular meeting.

Statement read by Andrew Molinar at the Town Board meeting of October 19, 2020
Thank you to each of you for working through the complex issue of 5G, especially with so many
other important things going on locally and nationally. I've enjoyed the conversations I've
already had with some of you. I want to talk about a couple things today.
For me, this issue is so concerning because of the potential impact on the health of my fellow
Ithacas. Thousands of peer reviewed scientific studies have proven that pulse modulated
microwave radiation of cell technology is a health hazard to humans. Not dozens ... not hundreds.
Thousands.
This is why no fire station in the country will allow cell towers near them.
This is why every cell phone manual warns not to use cell phones next to our bodies.
This is why insurance companies will not indemnify telecom companies for wireless activities.
This is why telecom companies themselves warn their investors of the massive risk to them in
potential lawsuits.
And this is why whole countries and many American communities are resisting the roll out of
small cell antennas.
The most important duty of our governments - of you - is to protect the safety and well-being of
citizens. Ithaca's current codes fail to do so. As written now, they could pave the way for
literally hundreds of towers to litter our town. That's because once you approve an agreement for
one telecom company, you will legally have to allow the same for the others. That would yield
an incredibly high amount of radiation beaming directly into the bedrooms of hundreds of
homes. Into the bodies of children, who are up to ten times more vulnerable to this hazard.
But you can change this. Despite the federal pressure, you can legally do what many cities across
this country are doing — limit the proliferation and damage of these towers by adopting key
codes. The City of Ithaca has agreed to incorporate some of these key codes, and we are now
asking the Town to do similarly. In particular, making sure that these companies prove a gap in
coverage for voice. Making sure that there is no pollution exclusion as a part of insurance
coverage. Ideally, you'd also have a revocability clause that allows changes in any agreements if
the laws change. And, making sure any new towers are at least 1500 feet away from any
residence. This number is NOT arbitrary, it is based on a scientific study, which we sent you a
link to.
It sounds as though you'll be hiring attorney Andrew Campanelli to help make our codes
stronger. But, before he begins his work, I join the others in our coalition in asking you the
Board to ensure that the Codes Committee incorporates these code changes. Campanelli should
know where the Town stands and which guidelines to include.
