HomeMy WebLinkAbout2012-11-06-PB TOWN OF ULYSSES PLANNING BOARD MINUTES 11/06/12 Approved 12/4/12 Present: Chairperson Ken Zeserson, Members- Sarah Adams, Stan Beames, Rod Hawkes, Rebecca Schneider, John Wertis, Environmental Planner Darby Kiley Excused : Peter Fry Applicants : Mark Finnigan Mr. Zeserson called the meeting to order at 7 : 00 pm. Mr. Wertis stated he would like to propose a change in the agenda order. He reviewed the change and the members agreed. Ms . Schneider stated that with the elections happening tonight she would appreciate being able to adjourn on a timely basis to follow the elections . The members agreed. Mr. Zeserson stated they have a Minor Subdivision to review, he stated the information had been sent to the members . The members stated they had received and reviewed the information. Ms. Kiley reviewed the project and introduced Mr. Finnigan as the potential buyer of the property. She had prepared a draft resolution in case the Board chose to not hold a public hearing . The board needs to review for SEQR then the Subdivision. The members discussed and were able to have questions answered. Mr. Beames MADE the MOTION, seconded by Mr. Wertis to approve as follows : Resolution for SEAR: WHEREAS : 1 . This is consideration of Simple Subdivision following Minor Subdivision Procedures, where two lots will be created — one with an existing house on 1 .256 acres and one undeveloped lot of 17 . 505 acres, located at 4005 Cold Springs Rd and bordering on Trumansburg Rd, Tax Parcel Number 25 . - 1 - 1 , Hl -Hamlet District. Karen Clarke, owner; Barbara Blanchard, agent; and 2 . This is an Unlisted Action for which the Town of Ulysses Planning Board is acting in this uncoordinated environmental review with respect to Subdivision Approval ; and 3 . The Planning Board, on November 6, 2012, has reviewed and accepted as adequate a Short Environmental Assessment Form Part I, submitted by the applicant, SEAF Part II, and other application materials ; and 4 . The Town Zoning Officer has recommended a negative determination of environmental significance with respect to the proposed Subdivision Approval ; NOW THEREFORE BE IT RESOLVED : That the Town of Ulysses Planning Board hereby makes a negative determination of environmental significance for the reasons set forth in the Environmental Assessment Form Part II referenced above, in accordance with the New York State Environmental Quality Review Act for the above referenced action as proposed, and, therefore, an Environmental Impact Statement will not be required . The vote was taken UNANIMOUSLY APPROVED, SEQR Negative Determination Mr. Zeserson MADE the MOTION, seconded by Mr. Beames as follows : 2 Planning Board 11 /6/ 12 Resolution for Simple/Minor Subdivision Approval : WHEREAS : 1 . The Town of Ulysses adopted zoning regulations in Local Law Nov 4, 2007 includes Article XVIII — Land Subdivision Regulations, Section 18 . 3 establishing criteria for Subdivision Procedures ; and 2 . The owner, Karen Clarke, and agent, Barbara Blanchard, submitted the required documents, and paid the fees for a Simple Subdivision on Trumansburg Rd ; and 3 . The lots created through the Simple Subdivision, located at 4005 Cold Springs Rd, Tax Parcel Number 25 . - 1 - 1 , H1 -Hamlet District, meet the lot requirements as set forth in the Zoning Law; and 4 . This is an Unlisted Action for which the Town of Ulysses Planning Board, on November 6, 2012 , has made a negative determination of environmental significance with respect to this project, after having reviewed and accepted as adequate a Short Environmental. Assessment Form Part I and Part II ; and 5 . The Town of Ulysses Planning Board met on November 6, 2012 and chose to waive a Public Hearing ; and 6 . The Town of Ulysses Planning Board has given due consideration to all information and comments in conducting the Subdivision Review; THEREFORE IT IS HEREBY RESOLVED, that the Planning Board of the Town of Ulysses hereby approves the Simple Subdivision, where two lots will be created, one with an existing house on 1 . 256 acres and one undeveloped lot of 17 . 505 acres, located at 4005 Cold Springs Rd and bordering on Trumansburg Rd, Tax Parcel Number 25 . - 1 - 1 , H1 -Hamlet District, as shown on application materials submitted. The vote was taken UNANIMOUSLY APPROVED, Subdivision Approved. Ms . Kiley stated she had attended the Lakeshore and Conservation Zone Public Information Meeting. There were approximately 60 people present. The concerns included stream setbacks , dock length and high water mark, impassioned stories of people diving into shallow water. Ms Schneider stated she had concerns regarding high water vs . low water. Cayuga Lake is part of the canal system that raises/changes the lake level . There were also concerns regarding 1 acre vs . 2 acres and tree cutting . The members continued to review the issues raised including lot size, Yacht Club had raised concerns-not a legal or conforming use already, Conservation Easements, etc . Could the Town start looking at ways to purchase conservation easements or establish parklands along the lake? Tompkins County is pushing the UNA etc they should put their money where their mouth is . A suggestion was made to have a meeting with Ed Marx to pursue these ideas . The procedure is to put together a list of hot topics for the Town Board who will assign a committee to continue review and edits . Flag Lots : Mr. Wertis stated he would like to review he had made some edits, the members stated they would review but would like to table for the next meeting. It was suggested an illustration be provided to facilitate better understanding . Town Board Liaison : Mr. Zeserson stated he had received concerns regarding the liaison role for Planning Board. It was noted some members felt this role should not have input or discussion during their reviews especially with the public . It is to facilitate communication to the Town Board vs . input at Planning Board reviews . ...:n, • 3 3 Planning Board 11 /6/ 12 Mr. Zeserson stated he would speak with Mr. Kerness and inform him of the Board concerns and issues .
