HomeMy WebLinkAbout2012-10-16-PB TOWN OF ULYSSES PLANNING BOARD MINUTES 10/16/12 Approved 12/4/12 Present: Chairperson Ken Zeserson, Members- Stan Beames, Peter Fry, John Wertis, Environmental Planner Darby Kiley Applicants : Lauren (and Kevin) Paskin-Flevlage Mr. Zeserson called the meeting to order at 6 : 30 pm. He stated they had a subdivision to review. Ms . Kiley stated they have a SEQR and subdivision review to do on the Kwiatkowski property, it is a boundary change as well . She noted the applicants are present to detail the purpose of the subdivision. Ms. Paskin-Flevlage introduced herself and stated she and her partner are interested in sheep farming. The lot is more than what they need but have a friend who is interested in growing grains, another acquaintance is interested in the forested area of this property. They reviewed the lot and determined the lot lines for road access, where the current buildings are for each agri-business and the best areas for each purpose . This is the final map presented this evening. It was noted two of the owners already have established residences and have no interest in building homes on their lots . There may be a chance that the son of one owner may build on site but not in the plans currently. Mr. Fry asked for clarification of the lot lines, and the applicant reviewed and explained the divisions . Mr. Zeserson stated the first order of business is the SEQR. The members reviewed the document that had been completed by the applicant and Ms . Kiley. They agreed with the noted comments. Mr. Fry MADE the MOTION, Mr. Zeserson SECONDED the MOTION as follows : 'WHEREAS : 1 . This is consideration of Simple Subdivision following Minor Subdivision Procedures for the proposed boundary realignment located between Podunk and Halseyville Roads and north of Iradell Rd, Tax Parcel Number 35 . - 1 - 5 .21 , 35 . - 1 . 5 . 21 , 35 . - 1 -7 . 1 , and 35 . 4 - 10, Al Agricultural District. Joseph M. and Meredith H. Kwiatkowski, owners ; Lauren Paskin-Flevlage, applicant, and Katrina Thaler Medeiros, attorney for the applicant; and 2 . This is an Unlisted Action for which the Town of Ulysses Planning Board is acting in this uncoordinated environmental review with respect to the Subdivision Approval ; and 3 . The Planning Board, on October 16, 2012, has reviewed and accepted as adequate a Short Environment Assessment Form Part I, submitted by the applicant, a Part II, and other application materials; and 4 . The Town Zoning Officer has recommended a negative determination of environmental significance with respect to the proposed Subdivision Approval ; NOW THEREFORE BE IT RESOLVED : That the Town of Ulysses Planning Board hereby makes a negative determination of environmental impact for the reasons set forth in the Environmental Assessment Form Part II referenced above, in accordance with the New York State Environmental Quality 2 Planning Board October 16, 2012 Review Act for the above referenced action as proposed, and, therefore, an Environmental Impact Statement will not be required. The vote was taken: Mr. Beames AYE Mr. Fry AYE Mr. Wertis AYE Mr. Zeserson, Motion passed UNANIMOUSLY Mr. Zeserson asked if the members were ready to make a motion. Mr. Zeserson MADE the MOTION, Mr. Wertis SECONDED the MOTION as follows : WHEREAS : , 1 . The Town of Ulysses adopted zoning regulation in Local Law Nov 4, 2007 includes Article XVIIi Land Subdivision Regulations, Section 18 . 3 establishing criteria for Subdivision Procedures : and 2 . The Applicant, Lauren Paskin-Flevlage, and Attorney for the Applicant, Katrina Thaler Medeiros, submitted the required documents, and paid the fees for a Simple Subdivision on Halseyville Rd; and 3 . The lots created through the proposed boundary realignment, located between Podunk and Halseyville Roads and north of Iradell Rd, Tax Parcel Numbers 35 . - 1 - 5 . 21 , 35 . - 1 -7 . 1 , and 35 . - 1 - 10 , Al -Agricultural District, meet the lot requirements as set forth in the Zoning Law; and 4 . This is an Unlisted Action for which the Town of Ulysses Planning Board, on October 16 , 2012 , has made a negative determination of environmental significance with respect to this project, after having reviewed and accepted as adequate a Short Environmental Assessment Form Pat I and Part II ; and 5 . The Town of Ulysses Planning Board has given due consideration to all information and comments in conducting the Subdivision Review; THEREFORE BE IT RESOLVED, that the Planning Board of the Town of Ulysses hereby approves the Simple Subdivision, as shown on the map entitled, "Survey Map Showing Lands of Joseph M . & Meredith H . Kwiatkowski , Located on Halseyville, Iradell & Podunk Roads, Town of Ulysses, Tompkins County , New York," dated May 7, 2012, by Sheive Land Surveying. The vote was taken : Mr. Beames AYE Mr. Fry AYE Mr. Wertis ' AYE Mr. Zeserson AYE Motion passed UNANIMOUSLY Mr. Zeserson informed the applicant the subdivision was approved and Ms . Kiley could assist them with the necessary paperwork procedures . He noted the next item is to review draft minutes for 09/ 18/ 12 and 10/ 1 / 12 . Mr. Wertis MADE the MOTION, seconded by Mr. Beames to approve the 09/ 18/ 12 minutes as drafted . The vote was unanimous, MINUTES APPROVED . 3 Planning Board October 16 , 2012 Mr. Wertis MADE the MOTION, seconded by Mr. Zeserson to approve the 10/01 / 12 minutes as drafted.
