HomeMy WebLinkAbout2012-09-04-PB Town of Ulysses Planning Board Minutes September 4, 2012 Approved 10/2/12 Present: Chairperson Ken Zeserson ( left at 7 : 50), Members — Sarah Adams, Peter Fry, Rod Hawkes, Rebecca Schneider, John Wertis, Environmental Planner Darby Kiley, Town Board Liaison Dave Kerness i Excused : Stan Beames Public : Peter Grossman, Christa Bissell Mr. Zeserson called the meeting to order at 7 :00 PM , and asked if anyone had additions to the agenda as presented . No additional agenda items were suggested . Review of minutes from August 21, 2012 Mr. Wertis stated that on page 2 there is a discussion of "flag lot homework ." The language should be changed to say that Mr. Wertis and Ms . Kiley will meet to review flat lot information from other towns and draft new language . Mr. Hawkes asked for clarification regarding the previous sentence . The intent is that members would appreciate having Mr. Hawkes "be present, " not make a presentation . Mr. Wertis made the motion, Mr . Zeserson seconded the motion to approve the minutes of 8/21/12 with edits . The vote was taken : Ms . Adams AYE Mr. Fry AYE Ms . Schneider AYE Mr. Wertis AYE Mr. Zeserson AYE Mr. Hawkes Abstain Motion passed minutes approved . Privilege of floor - no one was in attendance to speak . Rice Road subdivision Peter Grossman, representing the trustees of the property, presented the information on the property and the rationale for the subdivision . The property straddles Rice Road, was acquired over years in bits and pieces by the family, and now is in a trust to benefit Mrs . Adelaide Rice, who over 100 years old . Mrs . Rice lives with Jerry Rice' s daughter and son- in - law, and another family member lives in the house on the other side of Rice Rd . The subdivision would allow the one lot to be sold with the intent that it is staying in the family . Another lot to the east was divided off several years ago and is owned by a family member. Board members expressed concern regarding the following : additional houses that could be built on the lots (given what is allowed in R1 ) , a stream that crosses the property, and that there is not a recent survey of the entire property. In 2006, the northern part of the parcel was surveyed for a 2- lot subdivision . Board members reviewed the list of requirements for a Minor Subdivision : • Sanitation and water supply — not applicable, nothing new is proposed ; • Copies of deed restriction or covenants — none exist according to Mr. Grossman ; • Proposed subdivision name —not relevant / not applicable; Planning Board Mtg . 2 9/4/2012 • Legend, true north, date, names and contact info — all of this is on the smaller 2006 survey map, not present on the larger scale map; • Subdivisioni plat is clear and legible — the plat is at the clerk' s office; • Survey exists for parcel A which is the piece being subdivided . If or when anything is done to the 16 acre parcel, then it will need to be surveyed . Most of the requirements do not apply to this request . The board will consider the 2006 survey as the application plat . 1 I Resolution : Motion by Mr. Zeserson, seconded by Mr. Wertis, to accept information as presented, understanding that it is not complete but based on review of the list, the board will accept the two maps and written description of the proposed subdivisions . The vote was taken : Ms . Adams AYE Mr. Fry AYE Mr. Hawkes AYE Ms . Schneider AYE Mr. Wertis NAY Mr. Zeserson AYE Motion passed . Resolution : Motion by Mr. Zeserson , seconded by Mr . Hawkes to hold public hearing at the next meeting on September 18`h The vote was taken : Ms . Adams AYE Mr. Fry AYE Mr. Hawkes AYE Ms . Schneider AYE Mr . Wertis AYE Mr. Zeserson AYE Motion passed . Maplewood Rd/Taughannock Blvd Simple Subdivision Mr. Hawkes chaired the remainder of meeting. Christa Bissell , with Audrey Edelman real estate , represented the owner, Anne Thomas Trust . She described that the lot number 27 . -5 - 10 is a preexisting substandard lot . Potential buyers would like to subdivide #27 .-5- 13 . 2 and also consolidate most of 27 .-5- 10 with it, while dividing a small 40' x120' strip to be consolidated with the neighboring lot . This is a Simple ( two-lot) Subdivision but needs to follow Minor Subdivision procedures . The board reviewed the Minor Subdivision requirement list . A) copy of the covenants or deed restrictions . Christa has not seen the deed . The board requests proof that there are no :deed restriction ; B ) a copy of plat, with all tracts surveyed, marked and approved pin, monument . Yes, a copy is part of the application materials; C) all on site sanitation facilities if any — none present; D ) subdivision name — not necessary; E ) names, contacts of all names of record and subdivider — names are present but not addresses (those are accessed from assessment departmet) . The Date, true north arrow, and map scale are all on the map; 2 A Planning Board Mtg . 3 9/4/2012 F) legible copy is available in the file . The board requests a copy of any covenants or deed restrictions and a map with topography. Resolution : Mr. Hawkes, seconded by Sarah Adams, to schedule a Public Hearing on September 18, 2012. The vote was taken : Ms . Adams AYE Mr. Fry AYE Mr. Hawkes AYE Ms . Schneider AYE Mr. Wertis AYE Motion passed . The board would like to know the history of why Simple Subdivisions on major roads require Planning Board approval . The meeting adjourned at 8 : 20 PM .
