Georgia . Others Present: Louis DiPietro, Free Press Reporter Ms. Marino called the Special Town Board meeting to order at 7 : 10 p.m. following closing the public hearing. LOCAL LAW # 3 OF 2011 Ms . Marino moved, seconded by Mr. Kerness the following resolution: LOCAL LAW # 3 OF 2011 TOWN OF ULYSSES, COUNTY OF TOMPKINS A local law to override the tax levy limit established in General Municipal Law §3-c Be it enacted by the Town Board of the Town of Ulysses as follows : Section 1 . Legislative Intent It is the intent of this local law to allow the Town of Ulysses to adopt a budget for the fiscal year commencing 2012 that requires a real property tax levy in excess of the "tax levy limit" as defined by . General Municipal Law § 3 -c . Section 2. Authority This local law is adopted pursuant to subdivision 5 of General Municipal Law § 3 -c , which expressly authorizes a local government' s governing body to override the property tax cap for the coming fiscal year by the adoption of a local law approved by a vote of sixty percent (60%) of said governing body. Section 3. Tax Levy Limit Override The Town Board of the Town of Ulysses, County of Tompkins, is hereby authorized to adopt a budget for the fiscal year commencing 2012 that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law § 3 -c . 4 Town of Ulysses 2 Special TB 09/27/2011 Section 4. Severability If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof Ito any person, firm or corporation, or circumstance is invalid or unconstitutional, the court ' s order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered. Section 5. Effective Date This local law shall take effect immediately upon filing with the Secretary of State . Ms . Marino aye Ms . Thomas aye Ms. Tyler aye Mr. Kerness aye Mr. Romer aye Adopted INSURANCE A representative from NIMR insurance was scheduled for a presentation tonight but he was unable to attend. He will submit a quote . E. C . Cooper, the Town ' s current provider, will also provide a quote . LAKESHORE ZONE AND CONSERVATION ZONE Ms . Marino discussed the Town Board ' s agreement previously voted on to use Bergmann Associates to update the zoning map and incorporate the Lakeshore Zone, Conservation Zone and Article III update into the current zoning law when the three sections are finished. The Board unanimously agreed that Ms . Marino sign the project agreement with Bergmann. BUDGET The Town Board discussed employees contributing to health, dental and vision insurance . Mr. Romer moved, seconded by Mr. Thomas the following: BE IT RESOLVED that the Town Board of the Town of Ulysses approves that the employees and retirees of the Town of Ulysses will contribute 50% towards their dental/vision coverage . Tyler moved, seconded by Mr. Romer the following: BE IT RESOLVED that the Town Board of the Town of Ulysses approves that the employees and retiree& of the Town of Ulysses will contribute 5% towards their health insurance coverage . Ms . Marino nay Ms . Thomas aye 4 Town of Ulysses 3 Special TB 09/27/2011 Ms . Tyler aye Mr. Kerness aye Mr. Romer aye Adopted Ms . Thomas moved, seconded by Mr. Kerness to adjourn to Executive Session. Unanimously approved and meeting adjourned to Executive Session at 8 : 50 p .m. Special Board meeting reconvened at 9 : 30 p .m. Mr. Kerness moved, seconded by Mr. Romer the following : BE IT RESOLVED that the Town Board of the Town of Ulysses approves that there will be no pay increases for elected officials in the 2012 budget. Marino recapped deadlines and decisions for budget and zoning work: the meeting for the 2012 budget presentation will be October 3 , 2011 , at 7 : 00 p .m. ; the comments from the Town Board on the Lakeshore Zone should be done and submitted to Mr. Kerness by October 1 , 2011 , ; the comments from the Town Board on the Conservation Zone should be done and emailed to Rod Hawkes by October 15 , 2011 , and she is authorized to sign the agreement with Bergman Association. Hearing no further business, Ms . Marino moved, seconded by Mr. Romer to adjourn the meeting. Unanimously approved and meeting adjourned at 9 : 35 p .m. Respectfully submitted, Marsha L . Georgia. I . Others Present: Louis DiPietro, Free Press Reporter Supervisor Marino called the Public Hearing to order at 7 : 00 p .m . and read the legal ad into the record. Ms . Marino reviewed the law to override the tax levy limit established in General Municipal Law § 3 -c and gave a brief summary of the impacts of the State Law if the budget goes over the tax cap and how it impacts the funds .
