HomeMy WebLinkAbout2011-06-15-PB TOWN OF ULYSSES PLANNING BOARD MINUTES 06/15/11 APPROVED 06/29/11 Present: Chairperson-Ken Zeserson, Members- Sarah Adams, Stan Beames, Rod Hawkes, Rebecca Schneider, John Wertis, Code Enforcement Officer Alex Rachun, Town Board Liaison David Kerness Excused : Peter Fry Mr. Zeserson called the meeting to order at 7 : 01pm. He noted the first order of business is the Gleason Subdivision. The members discussed the project ,they have had a chance to ask the applicant questions and felt comfortable with the project . Mr. Zeserson MADE the MOTION, Ms Schneider SECONDED the MOTION: Whereas, Shanna and Richard Gleason have made application for a simple subdivision of Perry City Road, Town of Ulysses, and Whereas the Town's Zoning Officer has reviewed this application and deems it complete and a " legal and conforming use" , and Whereas, the Planning Board has reviewed the application with Mr. Gleason according to Minor Subdivision procedures per zoning regulation, THEREFORE BE IT RESOLVED, the Town of Ulysses Planning Board approves the Subdivision for Sharma and Richard Gleason, Perry City Road, Town of Ulysses, NY. THE VOTE IS AS FOLLOWS : ADAMS - AYE BEAMES-AYE FRY-ABSENT HAWKES -AYE SCHNEIDER-AYE WERTIS -AYE ZESERSON-AYE MOTION APPROVED- SUBDIVISION APPROVED Mr. Zeserson stated the next item on the agenda is the presentation of the Lakeshore Zone Draft. This is another step in having the zoning reflect the Comprehensive Plan. He introduced Mr. Don Smith, Lakeshore Chairperson and asked him to present the project. Mr. Smith introduced himself, he stated the Lakeshore Zoning Committee started meeting on January 2, 2010 . The team consisted of himself, Krys Cail, Terry Cool, Rod Hawkes, David Kerness, and John Wertis . He stated while gathering data for the zoning they noted the potential development sites on the Girl Scout Camp lots, Ithaca Yacht Club lot and Taughannock Falls State Park lots . He noted the Ulysses zoning is more restrictive than the Ithaca zoning. Some of the members are residents of this area and are familiar with the problems, concerns of this area. He provided a brief description of the zones. He informed the group Rod Hawkes, David Kerness and he had drafted a PowerPoint presentation to show the group . They would appreciate feedback on the presentation as well as the draft . Mr. Zeserson asked the group if they would compile questions until the end then review issues, comments, etc . The group decided this would be an effective way to manage the presentations. Mr. Hawkes presented the PowerPoint presentation . Planning Board 06/ 15 / 11 Page 1 The member' s discussion concluded with concern/comments/questions of the following : Would this zoning eliminate building on the end of docks . The zoning is restrictive and the design standards would eliminate full build out. Moorings in relationship to swim areas were a concern. The members stated they do not feel this is an issue as very few people swim as far out as the moorings are. Most people swim off end of dock, out a few feet then back to shore . The steep slope 25 % measurement, what was the rationale for using this vs . the amount in the Conservation Zone . The Lakeshore members stated they would reference their notes . The tree removal procedures . The Conservation Zone guidelines were used for the Lakeshore Zone, they felt this was the best management practice as these zones are contiguous . How would the Planning Board review the tree removal . It was suggested the permit process would have to be changed to capture the tree removal . Water Rights, how was this developed, are we legal using the parameters we are using. The discussion concluded with confirming this . The Committee used the Town of Ithaca regulations but agreed confirmation of legality of this should be done . The clarity of the presentation was discussed, the use of different colors for old vs . new was a great tool. The need to include additional maps, descriptions to indicate how and why the zones were created. Some of the public may come into the meeting not having a strong knowledge of the background . Committee agreed this would be beneficial and will incorporate these into the plan. The lots that could be built is a nice statistic, it was suggested they also list the lots that could be built with the current zoning. The increased number of septic tanks could be an issue . The Lakeshore members agreed they would work on gathering more data for presentation. Ms . Schneider MADE the MOTION, Mr. Wertis SECONDED the MOTION as follows : Whereas, the Town of Ulysses Planning Board has reviewed the proposed Lakeshore Zoning Code Draft and Whereas, the Town of Ulysses Planning Board has determined the proposed code is acceptable for presentation to the public in a public information session. Therefore be it resolved, the Town of Ulysses Planning Board requests the Town Board hold a public information session . THE VOTE IS AS FOLLOWS : ADAMS -Absent BEAMES-AYE FRY-Absent HAWKES-AYE SCHNEIDER-AYE WERTIS -AYE ZESERSON- AYE MOTION APPROVED UNANIMOUSLY Mr. Wertis stated he is concerned due to the non reaction of his procedures/policies that were distributed March 29 via hardcopy and later emailed to the members . Mr. Zeserson agreed this should be addressed, he suggested this Board convene at 6pm on June 29th, prior to the Town Board Public Hearing regarding the Gas Drilling proposal. Planning Board 06/ 15 / 11 Page 2 II . , .. .. . , _ .. , ._ MINUTES TOWN OF ULYSSES BOARD OF ZONING APPEALS 06/15/11 APPROVED 08/17/11 PRESENT : Chairman George Tselekis, BZA Members- Dick Coogan Carl Mann, Code Enforcement Officer Alex Rachun, Applicant: Patricia Splain Hillman Excused : Andy Glasner, Barbara Bristow Chairman George Tselekis called the meeting and a duly advertised public hearing to order at 7 : 30 pm . He stated they are reviewing an application to construct a garage located at 6125 Mayo Road. He asked the applicant to present the project. Ms. Hillman stated they currently have a barn on the site . It is the ugliest one in the County. The current barn is positioned within 2 to 3 inches from the neighbor' s property line. They have researched and found one they would like to replace it. The barn is currently 4 feet from the creek, they would be moving the placement of the barn so it is 10 feet from the creek but they are still not in compliance with the stream setback. Mr. Tselekis asked Ms . Hillman if the new barn would be further from the center of the road. Mr. Rachun stated the front setbacks are in compliance as are the side setbacks . The only non compliant setback is the stream setback. Ms Hillman stated it would be in a better position compared to the current barn onsite. It would also look better, she supplied a picture of the proposed barn. Mr. Tselekis asked if the neighbor notices had been sent, had any comments or concerns been sent for this project. Ms . Carlisle Peck confirmed they had sent the notices and no responses had been received. Mr. Mann MADE the MOTION, Mr. Coogan SECONDED the MOTION Whereas, there will be no undesirable change to the character of the neighborhood, and Whereas, there would be a minimal impact to the governmental regulation, and Whereas, the variation is not substantial in comparison to the requirement, this variance will increase the setback from 4 feet to 10 feet. Therefore be it resolved the Town of Ulysses Zoning Board approves the variance in the interest of justice to John and Patricia Splain Hillman to construct a garage at 4125 Mayo Road, Town of Ulysses. Ms. Carlisle Peck stated they have the minutes of 05/ 18/ 11 . The variance was for a Special Permit for the Namaste Montessori school . Mr. Mann MADE the MOTION, Mr. Coogan SECONDED the MOTION to approve the minutes of 05/ 18/ 11 . The vote was taken, ALL IN FAVOR, MINUTES APPROVED . The meeting was adjourned at 7 : 41 pm .
