Supervisor Marino called to meeting to order at 7 : 00 p .m. APPROVAL OF CLAIMS Ms . Marino moved, seconded by Ms . Tyler the following : BE IT RESOLVED that the Town Board of the Town of Ulysses approves the previous examined vouchers # 230 through 277 in the amount of $ 31 , 131 . 25 . Ms . Marino aye Ms . Thomas aye Ms . Tyler aye Mr. Kerness aye Mr. Romer aye Adopted APPROVAL OF MINUTES Ms . Thomas moved, seconded by Ms . Tyler the following : BE IT RESOLVED that the Town Board of the Town of Ulysses approves the edited minutes for the Regular Town Board meeting of May 10, 2011 and the Special Town Board meetings of May 18 and May 24, 2011 . Ms . Marino aye Ms . Thomas aye Ms. Tyler aye Mr. Kerness aye Mr. Romer aye Adopted REPORTS OF REPRESENTATIVES Tompkins County Representative Jim Dennis reported on : • Tompkins County Foundation ' s meeting in May at the Ulysses Town Hall • Impact to Tompkins County' s budget with a 2% tax cap • County looking into selling their license to operate home health care services Trumansburg Fire Department & EMS — no one in attendance. Trumansburg Village — no one in attendance . Ms . Thomas attended the Village meeting and highlighted some topics they discussed : • Replacing fire trucks • Talk about community center Town of Ulysses 2 Regular Town Board Meeting 6/14/2011 • Manager of Farmers Market leaving after this season • Smoke test done to detect extra water in storm sewer system • EMS fee schedule accepted — Village residents will start being billed for EMS service on July 1st • June 27, 2011 meeting set with Town regarding EMS service in Town TOWN REPORTS Planning Board Chair Ken Zeserson said that the Lake Shore Zoning proposal will be presented to the Board soon. Highway Superintendent James Meeker reported the activities of the Highway Department for May. Code Enforcement Officer Alex Rachun was absent but he left a written report for the Board. Town Clerk Marsha Georgia reported the monthly fees collected for May and that the office mailed out notices to more unlicensed dog owners . Ms . Georgia said that she has been working on organizing a day for collection of electronic equipment through a new waste alliance network called Regional Computer Recycling & Recovery. She will provide more information to the Board. Presentation Draft Law : Illicit Discharge, Activities and Connection to the Stormwater System Mr. Darrel Sturges of Tompkins County Soil and Water Conservation District reviewed the law that the Town has to pass to go along with the MS4 Law. Ms . Poelvoorde is working with Mr. Sturges . The Board will review law further and submit questions . Supervisor Roxanne Marino reported on : • Distributed and reviewed operating statements • Discussed memo to Village Board regarding Youth Services • Attending meeting with Tompkins County Animal Control on new contract fees • Reviewed memo to Town of Ithaca on unaccounted water • Letter from Americana Vineyard requesting the Town of Ulysses to ask for temporary exemption from the off-site limit for Americana to serve to serve beer and wine at the Taughannock Falls State Park concert series • Mentioned possible raising of water rates to District 3 & 4 Deputy Supervisor Sue Poelvoorde announced the "save the date" for the Finger Lakes Trail and Greenway Conference in September at Cornell University. Town Board Members and Committees Ms. Thomas reported : • Emailed minutes from the Tompkins County Council of Governments (TCCOG) Task Force meeting • Distributed handouts from Solid Waste for the expanded collection services • Time Warner Cable Franchise contracts review of all municipalities for strength in bargaining • No meeting for the TCCOG Gas Drilling Task Force for June • Information on title insurance and land values in reference to gas leases • Karen Coleman, Youth Director retiring • Ulysses Youth may collect 1/4 of the proceeds for the Grassroots parking at the school and they will have movie nights this summer • Environmental Planner position deadline for application is June 16, 2011 - interviews to follow • Ulysses web page is being finished up and soon to go live Ms. Tyler reported : Town of Ulysses 3 Regular Town Board Meeting 6/14/2011 • Environmental Management Council (EMC) met and they are undergoing reorganization to add more stake holders • EMC Committee on gas drilling has written a couple different letters to the State regarding keeping electronic records on the monitoring of problems with drilling. Currently all monitoring reports are hand written. • Tompkins County Health Care Consortium has been quiet recently OLD BUSINESS r Proposed Zoning Law Amendment Related to Gas Drilling i Ms . Marino said that there are copies of the draft proposed law available for the attendees and turned the meeting over to Ms. Geldenhuys to review the law briefly, give some background and explain what the law is intended to do . Before adoption of this proposed law the Town will have to hold a public hearing, request Tompkins County Planning to complete a 239 (1) & (m) review and also complete SEQR, which the Town will need to hold a public hearing on and have a separate resolution. Ms. Geldenhuys said that the resolution to adopt this law will have to have a very detailed and specific resolution with a list of findings, references of studies and very clear and specific health, safety and welfare land use related reasons. PUBLIC COMMENTS * *All public comments can be heard on the audio recording available at www.ulysses .ny.us Resolution to set Public Hearing/County 239 (1) & (m) Review Ms . Marino moved, seconded by Mr. Romer the following resolution : RESOLUTION OF THE ULYSSES TOWN BOARD FOR A PUBLIC HEARING ON LOCAL LAW NO. 2 OF 2011 , AMENDING THE TOWN OF ULYSSES ZONING LAW WHEREAS , Local Law No . 2 , which amends the Zoning Law of the Town of Ulysses ("the Zoning Law"), is under consideration by the Ulysses Town Board ("the Town Board") ; and WHEREAS , a local law amending the Zoning Law requires a public hearing ; and • WHEREAS, the proposed local law requires review by the Tompkins County Planning Department pursuant to § §239-1 and 239-m of the General Municipal Law NOW, THEREFORE, be it RESOLVED that a public hearing be held on June 29, 2011 at 7 : 00 p . m. at the Trumansburg Elementary School on the proposed adoption of Local Law No . 2 of 2011 ; and be it further RESOLVED that the Zoning Officer forward the proposed Local Law and all other required materials to the Tompkins County Planning Department for review pursuant to § § 239-1 and 239-m of the General Municipal Law. Mr. Romer moved, seconded by Mr. Kerness the following resolution : Town of Ulysses 4 Regular Town Board Meeting 6/14/2011 BE IT RESOLVED that the Town Board of the Town of Ulysses sets a three (3 ) minute limitation for public comments at the Public Hearing on June 29, 2011 . Ms . Marino aye Ms . Thomas aye Ms . Tyler aye Mr. Kerness aye Mr. Romer aye Adopted Review of Upcoming Meetings Ms . Marino discussed the meetings that are coming up and when to fit 'a date in to pass the proposed law. July 12 , 2011 Regular Town Board Meeting July 26, 2011 Special Town board Meeting August 9, 2011 Regular Town Board Meeting Ms . Marino felt that waiting until the August 9 , 2011 , meeting would be acceptable and give the Town more time to put together the necessary resolutions. Ms . Thomas said one other date had been discussed and that was Saturday, July 23 , 2011 . The full Board was not necessarily open to that date. More discussion followed. Ms . Geldenhuys felt she could be at that meeting and have the resolutions ready, but she will check to see if the Town can have a formal meeting on a non-weekday. The August Regular Town Board meeting was changed from August 9, 2011 to August 10, 2011 . Conservation and Lake Shore Zoning Ms . Marino said that both these zoning changes also have to be reviewed and go through different processes . Mr. Kerness said he could work on getting both these pulled together to be presented to the Board. Public Comments Mr. Howarth reported on a Penn Yan bus manufacturer seeing extreme corrosion surfacing on school buses where highway departments are using brine solution, a byproduct of the fracking gas drilling process. Ms . Hillman reported on some activities that took place with the Jacksonville Association and reiterated the concerns that Jacksonville residents have about requesting some zoning changes that would institute site plan review for multi-family housing. Ms . Hillman said that they will be working with Andy Hillman on a program for Natural Resource Management for community organizations and the Association is going to help pilot this program because they have a fairly large management responsibility with the Jacksonville Park.
