TOWN OF ITHACA, N. Y. - - SANITARY SEWER RIGHT OF WAY
Sewers on Monkemeyer lands: (A) south of East King Road
(existing 8 inch line running easterly approximately parallel
to road) and (B) proposed 8 inch line (crossing East King
Road and running easterly approximately parallel to road).
THIS INDENTURE, made this 22nd day of January 1980
between the owners of Monkemeyer lands (Herbert N. Monkemeyer
and Evan N. Monkemeyer) herein referred to as GRANTOR and
the TOWN OF ITHACA, a municipal corporation in the County of
Tompkins, State of New York, hereinafter called GRANTEE or
TOWN.
WITNESSETH: WHEREAS the Grantor has constructed entirely
at its own expense sewer "A" (referred to above) to serve
GRANTOR'S Springwood development on the south side of East
King Road, and
WHEREAS GRANTOR proposes at its own expense to cross
East King Road with said sewer line and to continue said
sewer line easterly approximately parallel to East King Road
to serve its proposed Oak Ridge development on the north side
of East King Road, and
WHEREAS the Director - Environmental Health of Tompkins
County Department of Health requires that it be made clear
that Sewers A and B are both owned by the Town of Ithaca
before he will grant approval of the plans pertaining to Oak
Ridge Subdivision.

NOW THEREFORE, said GRANTOR does hereby grant and
convey to the said TOWN its successors and assigns forever;
the existing 8 inch line referred to above as Sewer A (and
shown on map attached hereto as the existing sewer on the
Monkemeyer lands south of East King Road). GRANTOR when
it constructs proposed Sewer B (Shown on map attached here-
to as the proposed sewer line crossing East King Road and
running easterly approximately parallel to East King Road)
will thereafter grant and convey said proposed line to the
TOWN.
GRANTOR also grants to the TOWN 10 feet on each side
of said sewer lines as shown on the attached map and the
right at all times to reach said lines from'East King Road
with men and equipment for construction, maintenance and
repairs.
GRANTOR reserves the right to negotiate with any person
desiring to use or connect with Sewer A or Sewer B concern-
ing reasonable compensation and reimbursement to GRANTOR
for GRANTOR expense in constructing Sewer A and/or Sewer B.
In this connection the fact must be taken into consideration
that GRANTOR has, over the years, paid many thousands of
dollars.in sewer benefit fees to the TOWN.
IN WITNESS WHEREOF this instrument has been duly
executed by GRANTORS. This instrument shall be binding on
the parties, their distributees, personal representatives,
successors and assigns.
