THIS INDENTURE, made as of the 9th day of September, 1975,
BETWEEN RICHARD E. BERGGREN, residing at 119 Williams
Glen Road, Ithaca, New York, and other owners
of property who have executed this deed and
whose names are set forth below,
parties of the first part, and
THE TOWN OF ITHACA, a municipal corporation
and political subdivision of the State of
New York, having its offices at 126 East
Seneca Street, Ithaca, New York,
party of the second part,
WITNESSETH, that the parties of the first part in consideration
of One Dollar ($1.00) lawful money of the United States, a rece
whereof is hereby acknowledged, and other good and valuable con-
sideration, do hereby grant and release unto the party of the
second part, its successors and assigns forever, for purposes
of public highway or street
II ALT, THAT TRACT OR PARCEL OF LAND situate in the Town of. Ithaca,
County of Tompkins and State of. New York, being a strip of land
of •variable width, now known as Williams Glen Road, and running
from the north line of the City of Ithaca northerly and north-
westerly on a'curve to the left, which strip of land is more
particularly described in the annexed Schedule A and shown on the

ij TOGETHER with the appurtenances and all the estate and rights of
the parties of the first part in and to said premises.

TO HAVE AND TO IIOLD the premises herein granted unto the party of
the second part, its successors and assigns forever.
AND the said parties of the first part covenant that they have
not done or suffered anything whereby the said premises have been
encumbered in any way.

SCHEDULE "A"
Description of Williams Glen Road being conveyed to the Town of
Ithaca, said street being shown on the "Map of Survey Parcels of
Land to be Acquired by Town of. Ithaca for Williams Glen Road,
Town of Ithaca, Tompkins County, N.Y. made by R. L. MacDowell,
Jr., L.S. 35421, on Auqust 20, 1975", a copy of which is filed in
the Tompkins County Clerk's Office.
Williams Glen Road
ALL THAT TRACT OR PARCEL OF LAND situate.in the Town of Ithaca,
County of Tompkins and State of New York, being the westerly
portion of Williams Glen Road as more particularly shown and
described in the aforesaid survey map, the intention being to
describe that portion of Williams Glen Road which is conveyed by
this instrument as it is more particularly shown on the said
map. According to said map, the portion of Williams Glen Road
hereby conveyed may be described as follows:
BEGINNING at a capped pipe in the north line of the City of
Ithaca; thence south 83'06130" east 50.40 feet, along said City
line, to an iron pipe; thence north 5°34145" west 37.99 feet to
an iron pipe; thence north 5°34145" west 112.5 feet or more to
an iron pipe in or near the centerline of creek; thence north
