TRANSFER OF PORTION OF SEWER LINE
TO THE TOWN OF ITHACA FOR THE PURPOSES
OF THE TOWN OF ITHACA SOUTH HILL SEWER DISTRICT
'This instrument is made and executed by and between:

herein also referred to as the Company, and:
THE TOWN OF ITHACA, a municipal corporation and political sub- t
division in the County of Tompkins and State .of New York, acting
in behalf of the Town of Ithaca South Hill'Sewer District, herein

also referred to as the Town.
In consideration of the mutual covenants herein contained
and other good'and valuable consideration the receipt whereof is
hereby acknowledged, the said Company hereby transfers to the said
Town a portion of the sewer line which is now used by said Company
for the purpose of discharging its industrial and other wastes into
xM. the sewer system of the City of Ithaca.
The portion so transferred •is -described as follows:
Beginning at a point located on lands of Morse
Chain Company in the Town of Ithaca, which point
of beginning is herein described as. the Point of
Connection and which point is shown on the map
hereinafter referred as "proposed manhole" -and

hich Point, of Connection is the point where the
South Hill'Sewer•District sewer line.now being
constructed and running westerly from the Danby Road
connects with the Company -sewer line (which is
shown on said map as "existing •sewer"): j

Running thence northerly about 440 feet across the said
' land of Morse Chain Company to the point where said
Company sewer line connects with the sewer line owned
and maintained by the City of Ithaca.
Reference is hereby made to the "Map of Easement to be
acquired .for South.Hill Sewer District by Town of Ithaca,
Tompkins County, •N.Y." made by Lozier Engineers, Inc. on
July 23, '1968 (Lozier File #14580), a copy of••which is hereto
attached.
The Town of Ithaca agrees .that so long as said sewer line
is used by the Company or any of its subsiduaries or successors a
for .its industrial operations on -South Hill in the Town of

e' Ithaca,- the Town .will pay the expense of the ordinary repair,
replacement and maintenance of the sewer line so.transferred, it
being understood that said sewer line becomes a part of the
- South Hill Sewer District sewer line facilities.
It is further-Agreed that with respect to that portion
of the Company's sewer line-which lies south of the Point of
: Connection, the Town shall•be responsible for any repairs or ,
'i replacements thereto which are caused by'the entry or discharge
into the said southerly portion of said Company's sewer line of
any waste.materials_or substances from the District sewer line
which ruins from said pointof connection easterly to the highway.

It is understood, of course, ,that the foregoing does
r: not include any damage or deterioration to said Town Sewer Line
onto the southerly portion of said National, Cash Register sewer
' line eaused .by ordinary use, wear and tear.
