IfaTMDLhasbeenapprovedbyEPAforanywaterbodyorwatershedintowhichanMS4discharges,theMS4mustreviewtheapplicableTMDLtoseeifitincludesrequirementsforcontrolofstormwaterdischarges.IfanMS4isnotmeetingtheTMDLstormwaterallocationsitmust,bySeptember10,2003,modifyitsstormwatermanagementprogramtoensurethatreductionofthepollutantofconcernspecifiedintheTMDLisachieved.IfaTMDLisapprovedinthefuturebyEPAforanywaterbodyorwatershedintowhichanMS4discharges,theMS4mustreviewtheapplicableTMDLtoseeifitincludesrequirementsforcontrolofstormwaterdischarges.IfanMS4isnotmeetingtheTMDLstormwaterallocations,itmust,withinsix(6)monthsoftheTMDL—sapproval,modifyitsstormwatermanagementprogramtoensurethatreductionofthepollutantofconcernspecifiedintheTMDLisachieved.Modificationsmustbeconsideredforeachofthesixminimummeasures.Therevisedstornwatermanagementprogrammustincludeanupdatedscheduleforimplementation.WatersthathaveapprovedTMDLsarelistedonthe303(d)listontheDepartment:swebsite(www.dec.state.nv.us/website/dow/3O3dcalm.pdf).PartIV.StormwaterManagementProgram(SWMP)A.SWMPCoverageAreaAtaminimum,MS4sarerequiredtodevelopSWMPsintheautomaticallyandadditionallydesignatedareas(4OCFRSection122.32(a)lor122.32(a)2)undertheirjurisdiction’.SWMPcoverageshallincludeallareasundertheirjurisdietionwhichdraindirectlyorindirectlytoeitheranMS4ortotheWatersoftheUnitedStates.ThepurposeofthissectionistominimizeconflictsbetweenadjacentMS4s.Forpurposesofthisgeneralpermit,areasundertheMS4sjurisdictionshallmeanareaswherethelegalauthorityexistsforthesubjectMS4todevelopandimplementanSWMPincludingthesixminimummeasures.ItisnotapermitrequirementforMS4stoimplementandenforceanyportionoftheirSWMPinanyareathatisunderthejurisdictionofanotherMS4.Forexample,itaportionofatowndrainsdirectlyintoastormwatersystemownedandoperatedbytheStateDOT,andthisareaofthetownisregulated,theDOTwillberequiredtoimplementandenforceanyportionofaSWMPprograminthearealyingoutsideofitsrightofway.Inthiscase,thetownwouldberequiredtoimplementtheprograminthesubjectareainaccordancewiththispermit,thisdespitethefactthatthesubjectdrainagedoesnotdirectlyenterthetown’ssystem.5PDESGeneralPenititforStormwaterRunotTfromMS4s.GP-02-02Expiration:January8,2008-10-
